Didn't whoever was involved know that eventually these cars have failed emissions testing in droves?

My understanding here was they had a "testmode" where the diesel ran cleaner with less power.  The software hack somehow knew when testing was taking place, and set the card into that testmode until it was over.

So given that it is unlikely that it failed many, if any emissions tests.
