Man jailed after girl lied about her age (1 Viewer)

For those wondering, 18 is the federal law for age of consent but that is only if someone crosses state lines.

If you stay within state, state law apply and that can be younger for most of the country.

How exactly would the federal age of consent come in to effect?
Well as he mentioned once you cross a state line the Feds can get involved.
Cross state lines in what way? Go meet a girl in another state? Take her to another state?
Live in Phillipsburgh. Meet her in NY. Go bang her in atlantic City over a weekend after just meeting her. Continue to sleep together at each others' places. Three different states with arguably one on-going criminal action.

I was trying to create a hypo where one could easily foresee floating amongst PA, NJ, and NY since they are all so close. Pardon any geographical mistakes.

 
Is this surprising to anyone? Statutory rape is a crime even if you think she's old enough. I'd assume that's been the law in every state since any of us have been adults.
Laws should take into consideration intent. If he has correspondence showing she lied then that should be a positive defense as he had no intent of having sex with a minor and he didn't think he was. Intent should matter.
the minute this is changed, the whole law becomes irrelevant. if "i thought she was 18" was a defense, guess what everyone will say? even if they have to get correspondence as evidence - (hey, send me a text saying you're 18).
So as the law stands now, a 13-14 or underage girl can get a guy thrown in jail and branded a sex offender for life just because she doesn't like him or wants to help someone get back at a guy by coming onto him and having sex with him?Seems fair.
Well, to be fair since you're bringing in fairness, it is possible to resist the advances of a 13-14 year old. No shtick, I had a girl probably of 16 or 17 come on to me last night (she was impressed by my tennis skills) and I had enough will power to not succumb to her advances. So while I agree completely with NC's position that some level of mens era should be required, I strongly disagree with your assertion that the strict liability law somehow has created an epidemic or enough cases to draw our worry where some poor guy over 17 gets victimized by the young girl trying to get him in trouble.
Well of course it is. Geez......I guess I have to spell it out here..... AN UNDERAGE GIRL THAT LOOKS OLDER AND TELLS THE GUY SHE'S 18-19 ETC.

I'd argue it's also pretty easy to resist the advances of a 18-19 year old. Furthermore, I'd argue that most older looking 13-14 year olds probably aren't vindictive enough to go bang an older guy just so somebody else can get some revenge.
If a hot girl who you think is 18 is coming on to you there is nothing more difficult to resist

This makes it a crime to use any form of communication between states to try to get a minor to have sex with an adult. Even if the minor and adult are in the same state, if the communication leaves the state, it is a crime. For example, if both people live in the same state and use an instant messaging program to communicate, and if the server used for the communication is in another state, this is a crime.

It is also a crime for a minor to be taken to a different state to have sex. No. The sex act has to actually occur across a state line. It happens more than you'd think.
Like if she was bent over in NJ and he was still going at it from the NY side?

16 seems so young, still kind of blows my mind that it's legal in most places. Maybe it's because I work in high school and see just how childish most 16 year olds usually are. Also related to the sexting/child porn thread. It's odd that a person can consent to sex with an adult at 16, but can't take a nude picture of them self.

In my state, depending on the specific facts of the case and manner in which the state charges the offenses, it's very possible to perhaps very likely that possessing a pornographic image of an underage girl will get you substantially more time in prison than having actual sex with an underaged girls. The defense bar and, frankly, the judiciary have been complaining about this for years but the legislature never changes it.

I found out after a few weeks of "dating" when she left out her wallet when taking a shower at my house. I've never been so freaked out in my life and immediately broke up with her two weeks later after she let me go back door.

Incidentally, I was just watching a youtube video of a Letterman show from 1985. Letterman's guest was Valerie Bertinelli. Eddie Van Halen was there as well, playing with Paul Schaffer and the band. First thing Bertinelli does after she sits down is talk about how she and Paul Schaffer dated in 1976. Paul was 27 and Bertinelli was 16! Paul is uncomfortable it even came up but Bertinelli keeps talking about it.
