Yes but then he was fired not resigned which has some implications here.Many states are “at will” so you can get fired at anytime for any reason......other than the normal illegal reasons to terminate someone.
One thing I would NOT do is the whole threaten to sue them thing above. If you ignore them they won’t actually withhold your pay unless they’re downright stupid. Making a bigger issue out of it is unnecessary and could cost you a negative reference from former employer. If it were me just stop talking to them and let it blow over and cash your last check.
