DENVER --

Fox 31 News has learned that Denver Broncos running back Travis Henry, the team's leading rusher, has tested positive for marijuana use and could be subject to a one-year suspension.

Henry, 28, previously served a four-game suspension from the National Football League for violating the leagues substance abuse policy in September 2005 as a member of the Tennessee Titans.

Henry can appeal the latest violation. However, if the appeal is denied, he will begin serving a one-year suspension immediately.

I thought he was out of the one year suspension club after his first week of practice this year. I don't think this is legit.

This is the reason I dropped him before the season last year when he was with the Titans. Guess I was a year off on my prediction.

 
This would be crazy! I did search almost every credible news source and found nothing additional on this. I hope it's untrue (for the sake of the 9 kids, not for the fact that he was my 1st round pick)

 
Oh yeah, and I'm absolutely speechless if this is true. How dumb would you have to be to not wait a couple of extra weeks just to be sure?

Henry fired the first salvo in the case Sept. 20 when he attempted to get a restraining order in Suffolk County Supreme Court to block the NFL from using a urine specimen against him and to stop the league from disclosing the test results.

Court papers filed in the state court action couldn't be reviewed late Thursday, and Henry's attorney Robert Dapelo of Patchogue declined comment. But papers filed by the NFL on Monday in federal court suggested that Henry may have failed the test because the documents stated that Henry was trying to stop the league from testing his specimen and "suspending from his employment with the NFL."

While the Suffolk court granted the temporary restraining order against the NFL, the league got an appellate court to vacate that order, court papers disclosed.

The NFL is seeking to have the litigation transferred to Brooklyn federal court because the issue involves interpretation of the league's collective bargaining agreement, which generally is covered by federal labor laws. Henry claims that the NFL violated league substance abuse policy by not allowing his experts to be present for testing of his urine specimen, court papers stated.

The 28 year-old Henry was signed by the Broncos in March after stints with the Tennessee Titans and Buffalo Bills. He leads the league in rushing this season with 433 yards.

NFL attorney Sean O'Donnell of Manhattan declined to comment late Thursday.

Does rotating out mean that the player will not face any suspension if he fails another test?

He'll simply receive a warning and be subject to frequent testing again?

 
www.myfoxcolorado.com sounded like a fabricated domain to me. Then I looking at the site it didn't look so hot. Was thinking potential hoax, but did a google search for "fox colorado" and that's indeed their site.

Failed Test has to be before Week 3 game. I would imgaine if he did fail, that the test would have been from a few weeks ago since it takes a little while to run them.LINK to Denver Post

I thought so as well. Does anyone know how the rule is written?
I don't know what week he had to wait until but I was fairly certain it was 4-6 weeks into the season before the NFL wiped his slate clean.
If General Zod has his way, Henry will serve a lifetime suspension and will not even be able to subscribe to NFL Sunday Ticket.
