Weapons of war don't belong in our neighborhoods or on our streets.

Congress let the Assault Weapons Ban expire 15 years ago, but today, we are introducing legislation to ban the sale, production, or possession of assault weapons.

Gary Martin, 45, had at least six prior arrests and used an illegal firearm, police said.

The gunman who opened fire in an Aurora factory, killing five and wounding six, was a divorced father of at least two children with a history of violent and threatening behavior spanning more than two decades, according to court records.

“I felt helpless,” an ex-girlfriend wrote in a 2008 petition seeking a restraining order against Gary Martin. “Confused and scared. I have no one to defend me. Not even the law.”

Martin had threatened to kill her, had put his hands on her and beat her, and had thrown rocks at her, bruising her leg, she stated in the petition.

It was around the time that he and his wife had stopped living together. In 2011, she filed for divorce and sought custody of their two children, now 9 and 14.

“Without cause or provocation (Martin) has been guilty of extreme and repeated mental cruelty toward the petitioner,” Martin’s ex-wife stated in her petition for dissolution of marriage.

Martin’s history of violence dates back to at least 1995, when he was convicted of aggravated assault in Mississippi, authorities said.

About 13 years later — between July 16 and August 25, 2008 — a woman documented at least seven instances when his behavior made her afraid. They lived in different building in the same apartment complex and had dated less than a year, according to court records.

The form also asks questions such as: Have you ever been convicted of a felony? Have you ever been convicted of a misdemeanor crime of domestic violence?

when it was discovered that he has acquired the gun illegally, why didn't authorities make a visit and arrest him for having that gun ? I'd think with his background, knowing he illegally had a gun ... that would be a pretty good ca se for a threat to society. Ultimately he broke multiple laws, was allowed to do it with no repercussion and when he cracked and broke it was a horrible scene.

I've presented solutions. Some of which would have either prevented or limited the deaths in this most recent shooting.

Your solution of "do nothing" doesn't seem to be working.  Guess we'll have to wait a week or so for another mass murder to revisit.
Show me where I've said "do nothing". I even gave the solution to the problem a year ago. If NRA was/is the problem, then create anti NRA groups to change the flow of money into DC. I was told it could never happen, the NRA is too strong. But, in less than 12 months, we've seen it's happening.

because Govt is ineffective for keeping databases up to date and there isn't a focus on prosecuting those who fail background checks or following up on people like this guy

did you read the link?  he was granted a gun when he shouldn't have been able to get it - the system we have wasn't good enough. after they realized it, they sent him a letter asking him to give his gun up and nobody knows if that was ever followed up on. The system wasn't good enough, and everyone agree's (gun people and anti-gun people) that our systems shouldn't fail like that. they have to be better - everyone agree's

this guy was a seasoned thug - and he broke laws over and over and over. Authorities could have stopped him maybe by following up but ultimately this guy just wanted to be violent and hurt people and he did, over and over. He chose victims that were unarmed. 

if you're suggesting him being registered as a gun owner would have stopped him I think you're wrong - he'd have acquired guns illegally to do his crime. He didn't care to break laws, laws meant nothing to him.  A registry wouldn't have helped at all here, the authorities knew he had guns and did nothing to follow up his illegally attaining them

Trump is not the entire government. It would take a massive shift from where we are now, to where I would consider our government as tyrannical.

A tyrannical ruler wields absolute power and authority, and often wields that power unjustly, cruelly, or oppressively.
There are still checks and balances in place to prevent this. Should the government shift to such position, I think you'll know. Small fractions will start to rebel forcefully. It's at that time that it will be necessary for and citizens to be armed. If aren't armed prior, it would be impossible to do so after the fact.

Hypothetically? Nothing.

In 2 years, he's probably gone. If not, he'll be gone four years after that. If he cancels future elections and declares himself the President until further notice, then I'll worry.

I don't plan on attempting to defend the the entire country from a tyrannical gov't, but maybe my family, friends, neighbors. 

Lets say that Trump is unable to get his wall built and he doubles down on the state of emergency thing and sends the military to start rounding up undocumented citizens and shipping them off.  Maybe this group gets a little forceful in a Hispanic community and a full fledged fire fight breaks out.  To stop this in the future Trump decides to dismantle the 2nd amendment and attempts to disarm the populace.  This results in squads of soldiers going to houses to forcefully disarm American citizens with no due process.  My guess is that there is going to be a bunch of shooting involved and rule of law will start to break down.  I don't think that I am going to stand against 4-5 guys breaking into my house with automatic weapons, but I will certainly want to be armed as society starts to decay and I would probably make my self scarce and attempt to find like minded people who were willing to engage in some resistance.  Guerrilla warfare is very hard to stop and would be fairly effective at protecting small areas.

We have an absolutely insane person as the POTUS, and ideas that used to be far fetched and crazy now seem some what plausible.  I did not own any guns prior to Trump being elected.  Since then I have acquire several in an attempt to be prepared for when he breaks status quo.

as I read it he applied for a concealed weapon license and they found out he was a felon - and sent a letter asking him to turn his gun in if he had one and no one every followed up to see if he had or not

laws are only as good as the people who live them - criminals live outside them and he kept his gun when legally he wasn't supposed to. That authorities knew he had them illegally and did nothing .... that's where failure happened IMO. Career violent criminal ......... when will society get sick of these people ?

why do you feel the need to make up falsehoods in so many of your posts?  this didn't happen.   

if we had a gun registry and a searchable database of guns, authorities would have this information.   unfortunately, the NRA literally wrote the legislation preventing that.

Concealed carry permit can be attained without a firearm in the states that I'm aware of.
I don't think that's true - you have to shoot and show you can handle your firearm. You could borrow one for a test .... but again, this guy was known to have a gun (see above quote from article)

in any event, had this guy used a knife to kill a couple of people or a car, this would have been no news at all. Nobody cares about those deaths

Does writing a letter saying that you need to relinquish your guns equate to knowing you have an illegal gun in your possession?  If you get red flagged for being irrationally paranoid and get a letter saying relinquish your guns, is that the same as the authorities knowing what guns are in your possession?

 
Depending on the city, they would have records on whether or not he owned a handgun. (which he did) Here in Omaha, all handgun purchases have to be registered with the Omaha Police Department. I'm currently looking at my card right now from when I purchased my Glock 2 years ago. It contains my name, address, model and serial number of the gun. In addition to this document, I am also required to register with the County Sheriffs office prior to purchasing a handgun. (I carry both of these cards with me whenever I take the gun out of my home). The reason I had it in front of me is because I took my gun to the cabin over the weekend and now have removed them from my wallet. (I'm don't have a George Costanza model wallet)

If I had sold the gun in the last 2 years, the Omaha Police would have still assumed I had the handgun in my possession. Unless I sold it to another resident of Omaha, who registered it under his/her name.

I answered this a couple of weeks ago. 

If you want to play pretend, let's play pretend. Just look at some of the wars that we've fought. You can't kill what you can't see. Guerrilla warfare is still an effective method that most modern militaries have trouble overcoming. You also need to understand that their could be Law Enforcement and members of our military that don't agree with the changes in our government. There would be opportunities to secure more effective weapons. It would be a long drawn out war that probably would never end. Only in a time of total dictatorship would they bomb a citizens home and roll tanks through neighborhoods. 


What was the last war the U.S. actually won? Not the one that a POTUS claims we have won. 

For me, it was WWII. We won because it was conventional. The other side wore uniforms and fought by the book for the most part. Fast forward to Vietnam and we had trouble telling who the bad guys were compared to the locals. You're thinking about a conventional war, which is not what would be fought. There are millions of deer hunters in this country. Most are not trained to fight hand to hand combat. But they are trained to make themselves invisible in the woods and take out a man sized target at 300 yards. You also have farmers with access to tons of fertilizer. And backwoods people that know how to create explosives. They also know the land better than anyone in the military. I'm not saying it would be an easy venture, I just don't think the government would have the backing of the population to wage all out war on a percentage of it's own people. 

You also don't factor in the assistance that may come from outside our borders. Would Canada or the UK stand for a dictator ruling our country in that manner? 

There's more to this make believe exercise than just Joe Six pack shooting his rifle at an Abrams tank. 


It's not just the weapon. As people like to point out in the gun thread, it's the effectiveness of a weapon to kill someone. Today's weapons do that. Unless the government finds a way to make personal force fields around each soldier, it won't matter how much firepower they've developed. The greatest weapon we have is an ICBM. I don't see them using it on American citizens.

Didn't read the article, but headline at Chicago Tribune right now pretty much says that Illinois State Police coming clean and stating that they wrongly issued the gun license that allowed the Aurora shooter to take 5 lives

I hate to say this, but it makes at least me have very little faith in what strengthening our gun control laws would accomplish and I'm in the 'if it saves just one life....'; camp. When we can't handle the logistics that come with the paltry policies we currently have in place its hard to envisioning anything else making a difference.

Considering we've never tried to establish a gun registry and ATF is prohibited from having searchable databases (and in many cases even using computers), it doesn't seem like we've really tried very hard.  There's no funding and no coordination to have meaningful background checks that result in enforcement.  We've done a half-assed job of establishing minimal regulation, and the anti-gun control crowd argues, "well, that doesn't work so we shouldn't do any more."   Maybe if we tried gun control regulations that aren't written by the NRA and provide funding for them it would make a difference.  On a state level, states with stricter regulation have less gun violence.

Yours is a pretty broad question. You're asking for a specific answer. I gave a broad answer above. There are millions of unregistered guns in this country. The ones that are registered would probably be confiscated and resisting 1 vs 8 would not be very effective. I see it as something similar to the French resistance during world war II. They lived among those they fought. Carefully choosing the time and places with which to cause the most disruption to the tyrannical government.

I'm currently looking at my card right now from when I purchased my Glock 2 years ago. It contains my name, address, model and serial number of the gun. In addition to this document, I am also required to register with the County Sheriffs office prior to purchasing a handgun. (I carry both of these cards with me whenever I take the gun out of my home). The reason I had it in front of me is because I took my gun to the cabin over the weekend and now have removed them from my wallet. (I'm don't have a George Costanza model wallet)

If I had sold the gun in the last 2 years, the Omaha Police would have still assumed I had the handgun in my possession. Unless I sold it to another resident of Omaha, who registered it under his/her name.

Guns killed all of those kids.  More kids will probably die today.  My focus is on saving kids.  That’s why I work with my state legislature on gun control, why I correspond with my representatives, why I donate money to gun control organizations, and  why I participate in demonstrations supporting gun control and protesting gun violence.   In my state at least, we’ve made great progress, and we’ll be a model for more regulations nationwide.   

Your false equivalencies are nonsense, and won’t become more compelling by repeating them another hundred times.  It’s good to be reminded of the ignorance, fear and propaganda that we’re up against though.

of course it is, but that's when you get when people just repeat NRA talking points.  spin the wheel, spit out some propaganda.  It could just as easily have been "why aren't you trying to regulate handguns,"   "gun control didn't stop gun violence in Chicago," or "criminals don't obey laws so we don't need more laws."

You figured wrong. And probably didn't take the time to understand my opinion on the subject. It's why SC and I don't necessarily see things the same, even though the lazy here want to lump us together. (when I do that, and lump together the anti gun crowd, I'm raked over the coals)

I don't see a need to protect myself or family outside my home. Even then, I see it as a very small need. 95% of my guns were purchased for hunting. Nothing more. Probably the same reason I don't own an AR. I don't have anything I would hunt with one. 

 
There's a different thread for that conversation.  You'll find everyone is against kids dying from alcohol.
There's also a suicide thread. Please be sure to direct posters there the next time suicide is mentioned in this thread. 

I said the deaths of children from guns is a sad number. So is the deaths of kids from alcohol. 1147 vs 4300 annually. Do you think the people on this forum, or in society, care or are outraged 4 times as much over one than the other?
