Story

A 16-year-old boy who drunkenly killed four people got probation this week because the judge with no apparent irony agreed with the boy's defense that he was a victim of "affluenza," whose parents taught him wealth and privilege shield consequences. The teen had faced up to twenty years in prison.

Sixteen-year-old Ethan Couch admitted to four counts of manslaughter after he and seven other boys stole alcohol from Walmart, piled into his car and struck and killed four pedestrians while going 70 miles per hour in a 40 zone. One of his passengers remains in the hospital with severe brain damage, and nine other bystanders were also injured.

Couch's BAC was a .24 and he also had Valium in his system. According to reports, he was belligerent at the scene, at one point saying, "I'm outta here." Prosecutors were hoping to get up to 20 years.

Couch's defense was that he was a victim of his parents' wealth and privilege; in that he never had to face consequences, which an expert summarized prior to sentencing.

He said Couch got whatever he wanted. As an example, Miller said Couch's parents gave no punishment after police ticketed the then-15-year-old when he was found in a parked pickup with a passed out, undressed 14-year-old girl.

Miller also pointed out that Couch was allowed to drive at 13. He said the teen was emotionally flat and needed years of therapy. At the time of the fatal wreck, Couch had a blood alcohol content of .24, said Tarrant County Sheriff Dee Anderson. It is illegal for a minor to drive with any amount of alcohol in his or her system

The moment you realize that the moving the goal posts argument strategy is very easy to recognize, is when you will understand why I feel that way. And I know it's not all lawyers which is why I erased it.

You and Christo use the exact same style. Everyone knows it for what it is. You're not fooling anyone.
I love when lawyers act like they're the only ones who can possibly understand the law since they're the one who have a law degree. If our law is so complicated that a reasonably intelligent, well-read person can't possibly understand it, well that's a huge problem. Lawyers act like law is brain surgery, rocket science or something really intellectually demanding.
If it's that complicated to understand then only lawyers should be required to abide by the law.

 
This is where the kid finally gets locked up but the mom who helped him flee only gets probation because she's a victim of wealth and privilege.

Couch is 18 years old, and Texas generally releases incarcerated juveniles at the age of 19 a potential punishment that Wilson said was "not enough for taking four lives." If Couch remains in the juvenile system, he could ultimately spend just a few months in jail. He turns 19 on April 11.

By transferring Couch to the standard adult justice system, prosecutors can try to make him serve more time, though they cautioned that an "anomaly" in Texas law limits how much time can be added when a juvenile is transferred to the adult system.

Based on a new report, sounds like his family is pumping money into a deportation delay that could last "weeks or months." From the article: ""It seems to me they could pay them as much money as they want to, to make this thing drag out as long as they want to," he said.

So, safe to assume the tactic at play here is paying to string out the deportation in order to limit whatever time he's sentenced to spend in a juvenile facility (which would end when he turns 19, in April next year) and pay more to contest any efforts to move this to the adult system? Gee, I wonder what could possibly cause a kid to think he has no consequences for his actions.

Hopefully the mother pays the full legal price for her own role in this mockery.

These people are clearly lowlifes but i dont blame them for the mockery.

I blame the original judge.He ultimately is responsible for this.

He basically accepted a defense that he is too rich to go to jail. Had no convept of his actions.

The POS lawyer said "affluenza" in court.

Yes. I would have accepted that.
Gotcha. I agree. That would've been a much more appropriate punishment.

 
I could be wrong, but thought I'd read the defense was not 'accepted' by the court and ultimately he received no different punishment than other juveniles have/would for this type of offense. Seems crazy to me.from the facts describes re: his conduct.

Now his mother, she is an adult and is the focus of my anger. Particularly following that type of defense, to scurry her kid out of the country to avoid what lame consequences he received seems inexcusable. I'd prosecute her to the fullest extent of whatever laws they can find.

Shark move by the Mexican government. The family was going to string this out for as long as possible until they found someone in authority who would make a "clerical error", and release them again.

The kid can't make a tinkle without his mother in the room. He's probably begging to come back to Texas. .

 
Looks like Affluenza Teen is back home in Fort Worth. I reckon he'll be calling the hoosegow home for a while now.

 
i hope they put this little snotrag strait in to general population and let whatever happens happen i normally do not like violence but sometimes you just gotta say hey man karma take that to the bank bromigos
