In fact I'm going on the record that he has probably already failed another test.
Yes, that'd cause a huge delay in the process, for sure.

Or it'd make the decision 1000x easier. Case closed.

Id take the latter 100% of the time.
IF there was another failed test, wouldn't they also have an opportunity to appeal that test as well?that would certainly delay the announcement, no?
Sure, they could.

Goodell would also laugh in their faces and hit 'em with the REJECTED stamp immediately.

Two failed drugs tests in a "single" period... ya, there wouldnt be a delay, it'd just be game over.
huh, you could be right.i had assumed there was some sort of process that they had to follow.
I would assume your assumption is correct...Even if he failed another test during his appeal process....they would have to go through the process...It is the players right provided him by NFLPA.

The NFL suspended two players for the year on the same day nearly a month ago for not only failing drug tests but because they had already been suspended multiple times. Will Hill, three times, PEDs, Adderall, pot, and Daryl Washington two times for pot and while they were considering Washington's latest case he got charged with assulting a woman.

The most logical reason for the delay between those two and Gordon is because Josh Gordon has only been suspended one time and his suspension was cut from 4 to 2 games. He would logically not be facing the same length of suspension as the other two who had already had more than one suspension.

Add the league announced in April it was considering increasing the low threshold that causes a positive test that they deem a marijiuana violation.

it is quite likely that the league is going to officially announce they are going forward with that annuncement and will be adusting the threshold of testing positive for pot.

On today's Browns Daily radio program the hosts hinted that JG 'could have' tested positive if he inhaled second hand smoke since he hangs with a crowd who partakes.

They said that maybe the league is using his case to announce the change in the low thresholds for pot that had announced that they were considering in April.

The NFL is econonomical in using press releases where they make two announcements at one time, like using the same day to announce the suspensions of Will Hill and Daryl Washington.

It wasn't a coincidence the league announced those two suspensions on the same day. They carefully plan any press release. If Gordon was facing the same suspension as Hill and Washington he would have gotten the same day nearly one month ago.

Something is different with his case.

IF they change the threshold, i would almost guarantee it's not going to be retroactive and will have no bearing on Josh Gordon's case.

The NFL test for marijiuana is ten times LOWER than the legal limits for imparment.

Why test for limits that low knowing players would be subject to second hand smoke?

We know the NFL released they are considering changing their low threshold that constitutes a positve test for marijiuana.

It makes sense to use the same press conference as Browns Daily suggested to announce any possible suspension for Browns WR Josh Gordon linked to their previously anniounced plan to change their low threshold for testing positive for pot.

Also don't rule out that Gordon may have made a successul appeal.

In any event it doesn't look he will face a year long ban that Hill and Washington are serving.

i'm not ruling anything out. it's POSSIBLE that his suspension could be 0-2-4-6-8-16 games. just saying it's highly unlikely that IF there was a positive marijuana test that they would make the new rule retroactive.

and i still don't beleive that the fact that the NFL suspended two guys a month ago has anything to do with his case. could you admit that is at least a possibility?

Really?

You honestly think it was mere happenstance that the National Football League announced two players were banned for the 2014 NFL season on the same day in the same press conference? Do you think the league hands down suspensions willy-nilly or do you admit the fact both of those guys had been suspended at least two times for drug violations had something to do with the fact they got year long bans and the fact Gordon had only been suspended one time and his suspension got cut in half might possibly have something to do with the fact he won't get a year long ban?

i don't believe we know anything for a FACT at this point. i understand you have a theory, and you could be correct.

Their are some facts.

- the previous suspensions leading to year long bans.

- Gordon had one suspension cut in half.

- and their has nearly been one month since the two players who had multiple suspensions were handed down punishments

People are speculating why their is a delay but saying their isn't any connection to the previous bans does not make sense to me.

Logically you have to consider why those two players got year long suspensions and why Josh Gordon didn't get suspended on the same day they did.

I'm sorry but I can't agree with you and don't see my logic as a theory. It seems cut-and-dry.

If you see it differntly then I'm fine with that.

Peace. :banned:

Gordon's last suspension being 4 games cut to 2 is a FACT.

Not speculation.

That's the ONE fact we have. Using that fact some of us are using ACTUAL NFL LITERATURE to make our point.

That's it.

People need to stop bringing up Will Hill's PEDs, Blackmon's arrests, Daryl Washington's altercation and even Gordon's speeding violation (with friend's marijuana) as evidence of anything. These do not fall under the Substance Abuse policy and do not affect the suspension under the Substance Abuse policy. The NFL does not mix its suspensions under various policies, and they do not build upon each other either.

Daryl Washington was suspended indefinitely because of failed drug tests, not because of failed drug tests plus his altercation. Just because Josh Gordon has not been arrested does not mean he would get less games than Washington or Blackmon.

The personal conduct policy is the document that gives the league the power to hand down discipline.

The personal conduct policy is the document where all previous incidents and any criminal proceedings are taken into account when determining disciplinary action.

This document also states that cases will be addressed in a timely manner.

On matters involving NFL players, the League will timely advise the NFLPA of the investigation and outcome.

Personal Conduct Policy

… Criminal offenses relating to steroids and prohibited substances, or substances of abuse;

… Violent or threatening behavior among employees, whether in or outside the workplace;

Discipline:

… Discipline may take the form of fines, suspension, or banishment from the League and may include a probationary period and conditions that must be satisfied prior to or following reinstatement. The specifics of the disciplinary response will be based on the nature of the incident, the actual or threatened risk to the participant and others, any prior or additional misconduct (whether or not criminal charges were filed), and other relevant factors.

With respect to repeat offenders, the Commissioner may impose discipline on an enhanced and/or expedited basis. In such cases, the timing and nature of the discipline will be determined by the Commissioner based on several factors including but not limited to: the severity of the initial charge and later charge; the facts underlying the later charge; the length of time between the initial offense and later charge; and the player or employee’s compliance with counseling and other programs. ..

Other Provisions:

“Disposition of a Criminal Proceeding” –

Repeat Offenders – Persons who have had previous violations of law or of this policy may be considered repeat offenders.

So the NFL is purposely delaying the appeal, so Rosenhaus and the Browns can argue he did not get a speedy process (the literature does state it should be done in a reasonable time) and he will get off w a minimal hit due to technicalities

NFL scheming like a boss

If he HASNT yet been suspended

And ESPN Cleveland is reporting the Browns are showing a sense of confidence re: Gordon

...... This could get HILARIOUS in here.

So the NFL is purposely delaying the appeal
They are?
Unless I am wrong, you have 5 days from the time of suspension to demand an appeal. So ya, one party is delaying... And if Rosenhaus was the one delaying, hed only have 5 days worth of delaying in his favor
perhaps he hasn't been suspended yet?
LOLHow amazing would that be
i dunno... probably would've been better to get the ball rolling earlier?

So did he violate the drug policy by using drugs or did he just miss a drug test ?
Same thing according to the policy.
Imagine the scenario... it turns out that Gordon was traveling, there was a flight delay which caused him to miss a test, after investigation it is determined that the cause was legitimate and that no punishment is necessary. Has not been brought to the attention of the media until leaked at a later date. Week one, Gordon catches 10 balls for 189 yards and 2 touchdowns.

The above players were all suspended under the substance abuse policy, not the personal conduct policy.

I'm not sure what you mean.

He HAS NOT been suspended yet. If he had, it would have been announced.

Again, we only know about the failed/missed test because the news was leaked. The NFL never announced that he was suspended, and the leaks all said that he was "going to be" suspended.

The delay could mean the NFL and Gordon/his agent are trying to come to some sort of settlement.

The delay could actually not be a delay, and just be the normal process in these situations (which we are not normally leaked news of until after the fact).

The delay could be because Gordon was tested again after the police stop & tested positive.

The delay could be for any number of reasons, but I doubt that the reason for the delay is because the NFL is trying to delay the process, in order to give Gordon grounds to argue that the NFL took too long, that way they don't have to suspend him. :loco:

i would love for Gordon to be able to start the year with Hoyer, but i just don't see it happening.

8 games seems like an optimistic scenario at this point.

That would be fun.

Interesting note: if Gordon gets a full year's suspension, the clock starts ticking from the date it's handed down. So if the suspension gets handed down, say, in the middle of August... that means that Gordon wouldn't be able to resume activities with the Browns until midway through preseason next year.

Basically, the longer this goes, the more of next year's offseason activities Gordon will wind up missing if he gets a full year's suspension.

The only thing I am sure of is I cannot believe what Josh Gordon says or what his agent says, but I really want to see Gordon play this year, gotta find out if last year was a fluke or if he is indeed a top WR. With those monster games he had, it will be a shame if he doesn't play.

The whole time I was in Utah, I never ended up testing positive for any administrative test given by the administrative people there,” Gordon said. “It was just their choice to test me and just make sure I was staying clean.”

exactly. that's why IF this latest report is true AND he's suspended a year, it's terrible for his future.

i thought the reason he made himself legible for the supplemental draft was because of a positive test?

Even if Josh Gordon receives less than minimum 1 yr ban, he could still be banished from #Browns facility while suspended, per source.

technically that's a true statement. as far as i know, suspended players are not allowed any contact with the team.
Exactly. It's a true statement. So why is it posed like it's some revelation, or that the Browns are coming down hard on him?

He only admitted to testing positive after he was drafted by the Browns, before that time he denied he failed any tests by Utah. But, the Browns might have known the truth, Josh Gordon could have just been lying to the general public I guess.

Adam, just curious, right now you have Josh Gordon ranked #35 for dynasty WRs, if he doesn't get suspended or only for say 4 games, what would you ranked Gordon at?

I can just feel it in the air.

This will be the BEST thread on FBG soon.
Why do you continue to try to make this thread about you? It is extremely hard trying to keep up on the Josh Gordon news with how to respond to every single comment with something in regards to you trying to down play every tidbit. Everyone on this planet knows how you stand so why would this be the best thread ever?

Continuing with Gordon, The fact that there has not been a scheduled appeal date means he has been issued a suspended as that would be the reason he would need to appeal and since the NFL has not announced it publicly means his appeal time has not lapsed.

This is not good news for Gordon as maybe he doesnt have a grounds for appeal and if you think the NFL is slowing this down for any reason you have not been paying attention to how the NFL works the pass couple of years. They do not show favorites.

Sounds like YOU'RE trying to make it about me. I dont mention ME in what I write, I mention US.

Secondly, are trying to infer that FIVE DAYS have not passed since he was suspended?

Seriously?

Cuz you know... if you use actual NFL policy, you'd know he has FIVE DAYS to appeal.

No my point is that the time has passed if the date the suspension was issued was at the draft, unless it goes from the time the NFL makes it a publicly known which they have not obviously.

Maybe he doesnt have a grounds for an appeal or that he is preparing an appeal and it is taking him a long time to get prepared because he is in deep deep trouble. I have been posting very little in this thread so I am not making it about you. But again, you respond to everyone who is not on your side as if they have no right to feel as if it is bad news for Gordon. You almost seem shocked every time someone points out that this is not good for him.

For all we know with all the league could be talking banishment if he failed another test recently, which after his citation could entirely be possible.
