The lawyer for Ben Roethlisberger denies allegations from a civil suit that his client was involved in a sexual assault of a Harrah's Casino employee in Nevada.The civil suit, rooted out by our own Gregg Rosenthal, alleges that Big Ben sexually assaulted Andrea McNulty after asking her to come to his hotel room to fix the television. The incident in question was in July of 2008. "Ben has never sexually assaulted anyone; especially Andrea McNulty," attorney David Cornwell said. This likely won't be done by season's end, and it screams golddigger to me.I haven't heard anybody say much for Ben's personality, but the whole thing just sounds out of place.
 
Surprised this story hasn't blown up. This is a big deal.
Not yet it isn't. No actual date on when such charges were filed, if they even were at all. Rotoworld is a suspect news source to begin with. No link either, and I'm not hunting it down.
 
Profootballtalk: Roethlisberger denies civil allegations of sexual assault

In a complaint that reads like the rape allegations made several years ago against NBA star Kobe Bryant, Harrah's employee Andrea McNulty alleges sexual assault against Steelers quarterback Ben Roethlisberger in a lawsuit filed last week in Washoe County, Nevada.

But lawyer David Cornwell strongly denied the allegations Monday night, in a statement released to PFT. "Ben has never sexually assaulted anyone; especially Andrea McNulty," Cornwell said.

In the civil suit, which Cornwell confirms was served on Roethlisberger over the weekend and a copy of which our own Gregg Rosenthal has obtained, McNulty alleges that Roethlisberger asked her to come to his hotel room to fix the television, and that he thereafter forced her to have sex with him.

Roethlisberger faces one civil count of assault, one civil count of sexual assault and battery, one civil count of false imprisonment, one civil count of false pretenses, one civil count of fraud, and one civil count of intentonal infliction of emtional distress.

McNulty also claims that the coworkers named in the complaint thereafter defamed her by making allegedly false and inflammatory statements, and by allegedly serving as aiders and abettors of Roethlisberger's alleged misconduct after the fact.

Cornwell, a finalist for the position of NFLPA Executive Director who has represented in the recent past Saints running back Reggie Bush and Browns receiver Donte' Stallworth, points to the fact that no criminal complaint has been filed, and that no criminal investigation has occurred.

"The timing of the lawsuit and the absence of a criminal complaint and a criminal investigation are the most compelling evidence of the absence of any criminal conduct," Cornwell said. "If an investigation is commenced, Ben will cooperate fully and Ben will be fully exonerated."

It's unknown at this point whether McNulty ever has attempted to file criminal charges as a result of the incident, which allegedly occurred in July 2008.

"Ben will not be baited into a public discussion about his personal life, but we will defend

him vigorously," Cornwell said. "The limited value that Ms. McNulty derived from public disclosure of these viciously false allegations is the only value she will ever receive from Ben in this case."

Regardless of how this one turns out, it has the potential to serve as a significant distraction for Roethlisberger as the 2009 season approaches, especially if the lawsuit triggers a criminal probe.
 
if this is made up, i feel bad for Ben. if its not made up he's a turd and should do serious prison time.

When Ben pleads guilty to criminal charges and gets sentenced to prison, he'll be treated just like Vick. Since these aren't even criminal charges, that isn't going to happen here.
 
Obviously we'll need to wait for facts, but my first impression is the same as with Kobe, this chick thinks she's found a payday. Guys like Ben and Kobe have women begging him to screw them, this makes no sense.

When Ben pleads guilty to criminal charges and gets sentenced to prison, he'll be treated just like Vick. Since these aren't even criminal charges, that isn't going to happen here.
If it ends up being true (I doubt it), you can bet dollars to doughnuts that Ben won't get punished nearlys as much. And forget about the public - he'd be welcomed back with open arms.

Let me see if I have this right:

Ben's TV isn't working so instead of calling the front desk he walks around the place looking for a hotel employee to fix it for him. When he finds one he likes he asks her up to his room to repair the TV. She doesn't find anything odd about this so she goes to the room alone with the man. When they get there he asks her for sex, refuses to let her leave and then rapes her.

When he finally lets her go from this emotionally distressful incident she doesn't go to the police or hospital but instead tells other employees that she was raped. They don't believe her and mock her (I assume this is what she means by them serving as aiders and abettors).

Then she waits a year and files a civil lawsuit against Roethlisberger and the hotel employees and it still isn't clear if she's ever filed a criminal complaint.

Pretty weird story.

Apparently some of the hotel employees are named in the lawsuit as well.I am not a lawyer and didn't stay at Holiday Inn Express last night but I am pretty sure the burden of proof is much less in a civil case than criminal. I wonder if that had anything to do with her filing civil complaints instead of going to the police.

Why is she ugly? I just find the wording odd, the lawyer should have just stopped at "anyone".

At least she filed a criminal complaint first lending some credibility to her claim (although I agree as the $ made her drop it).

I doubt if that is her story. Sounds like she's saying other hotel employees helped to get her to go upstairs to "fix the TV" and that is why they are aiding and abetting.I don't buy the whole Ben has women throwing themselves, so why would he do this line. Celebrities do strange things, and can think they should get everything and anything they want. The whole thing sounds pretty weak though, the no criminal investigation seems pretty damning on her side. I would guess that this will blow over.

Yes. The criminal standard is there can be no "reasonable doubt" that Ben did it while a civil action just requires it to be "more likley than not", but still I don't see how some one who claims she was raped doesn't go to the authorities and decided to just sue the guy. Makes it seem far less credible to me.

I would be pretty hard pressed to find in favor of plaintiff (even with burden of "preponderance of the evidence") without forensic evidence and results of a medical examination.

The lack of criminal charges is much less troubling than, say, the lack of evidence other than her word.

 
Athletes really have to be careful .Its almost to the point of where they need a witness or a flip camera to protect themselves in one on one business encounters .

I'd like to see a picture of her for further judgement of the merits of this case

According to the story above: 1) McNulty alleges that Roethlisberger asked her to come to his hotel room to fix the television

2) "McNulty also claims that the coworkers named in the complaint thereafter defamed her by making allegedly false and inflammatory statements, and by allegedly serving as aiders and abettors of Roethlisberger's alleged misconduct after the fact."

It sounds to me like her complaints about her coworkers was their actions after the incident not before.

 
Why is everyone condemning the woman when any intelligent person knows that a large majority of sexual assaults do go unreported. It takes a ton of courage for a woman to report a sexual assault.

The timeline of events after the alleged sexual assault remain fishy, true indeed. But, the mindset of a woman, child, or any person for that matter, after a sexual assault, is completely misconstrued.

Let's see how this plays out because no criminal charges have been filed yet but they could be coming, maybe no one but the complainant knows.

I am not condemning the woman -- I just think the story sounds a bit fishy. True, I have never been raped and do not know the mindset of someone that has but I am guessing that if I were I would either file a police report immediately or at least within a few days of the incident or I would try to blot the entire ordeal from memory.If I did decide to go after the perp I think that I would want to want to see him behind bars and file a criminal complaint before I went after his $.

I think the fact that she is charging a celebrity in a civil suit where there is money to be gained, makes you at least question whether she has motives other than just seeing him punished. I am not saying she did not get sexually assualted, just that there are probably a far higher percentage of false claims of sexual assualt when it is a celebrity civil suit then when it is a non-celebrity criminal case.We will just have to let the legal system play out.

Was it? I can't recall. I was thinking it was a Cowboy for some reason. I just remember being shocked at the initial report...then it came out that she was just trying to extort money.
I thought it was Irvin as well. Some woman claimed he (and a couple of his buddies) raped her. She later admitted to making it up.The Bettis story was a woman that claimed she went out to his car to get an autographed football for her son and he forced her to give him oral sex. It later turned out her brother or boyfriend (can't remember which) put her up to it and had been demanding money from him to keep the story quiet. I believe it also wasn't her first attempt to extort money from a celebrity.
 
Look. I can beleive this happened.

McNulty admits that she didn't try to fight Roethlisberger, citing his size and strength. She claims that she "communicated her objection and lack of consent," and that he nevertheless began "fondling [her] through her dress and between her legs."

She claims that he pushed her onto the bed, and despite her alleged protests he "pulled her underpants off and proceeded to penetrate her."

McNulty claims that she told him, "You don't want to do this." She also claims that she said, "Please don't," and that she told him she was not on any type of birth control.

She claims that he said in response, "Don't worry, I'll pull out," which he ultimately did.

I can see a guy who is used to getting what he wants thinking that if the girl isnt yelling and fighting he is ok. It is not right to think that way, but I can easily see this happeneing...
