advice legal et al for family member (1 Viewer)

Long story short. Family member is released from prison. He's about 65 now. Can't see and is bipolar. Prison imo dropped the ball. Was supposed to go into VA hospital but was denied. No one knows why. They were going to put him in hotel but he can't care for himself.

somebody dropped the ball somewhere as getting his housing.

What can we do?

That does not sound like a good situation. Does your state have some type of care/insurance for him? Someone would need to help with the disability process but could be a good start.

 
Well we got all the paper work for welfare to fill out.

this whole situation was not handled correctly imo.

No one had a clue until ####### friday that he was in need of housing even though he was receiving medical treatment his entire stay

From what I have heard from many, VA hospitals brush off everyone at first as if that will save and people will become disheartened.

I know a woman whose husband was treated poorly and they took a 3 hour trip to drive to one-in person, he got treated right away and spent days getting tested and treated and they really digged into what could be wrong and how to help him. I've heard from many that in-person is a very different experience.

Because by the law the DOC and state will upon him entering the release portion of his sentence.

Apply for SSI and requisite paperwork

Apply for Medicaid, Welfare if eligible

Provide housing at a facility - I forget the length of time stated in the document.

They did not do #1 #2 and #3 they were going to put him up in a hotel but he can't care for himself. So while he would not have been homeless he probably would not have survived.

Which has been documented from his doctor.

Just angry at the whole mess.

Don't expect the government to be an advocate for an ex-con in need of government housing.
even for a diagnosed mental condition that led to his incarnation?
I'm guessing that the government would probably rather have him in jail than in state-funded housing.Also, if the prison is run by a private company then they have zero interest in keeping your relative off the streets. They make more profit if your relative violates their probation.

Can't he just do like Otis Campbell on The Andy Griffeth Show and walk into the local police station and check into a cell for the night?

 
belljr sorry man. I got no advice cause I'm not an attorney. A bit more back story may be helpful if you're willing.

64 year old man goes off his meds. Tried to get him admitted against his will to a facility they say no.

does 11 years for murder , went crazy off meds and stabbed someone.

now 75 released, still need meds, legally blind and can't move his right leg.

Just want him to be under supervision. And it won't be at my house

 
GL bell- wish I had anything at all to help you here... that sounds like it ####### sucks.
I've to 5 different offices this morning. No one has a ### #### clue. Guy has zero income, is disabled and a veteran. I'm at soc sec now. Supposedly if he qualifies we can then go get food stamps , insurance and housing

You might want to go to a local legal aid office for some help. There are frankly way too many permutations to look into for someone to give you comprehensive advice online. We'd need to research his entitlement to benefits, look into whether you could get him involuntarily committed for evaluation, etc. No one lawyer is likely to have the all the information. Many legal aid offices have volunteers who specialize in veterans issues, mental health issues, and elder law so the institutional knowledge might be there.

 
Update. Applied for soc sec. Approved for retirement benefit of 1375. Went back to social services. The new wrinkle even though they separated before his incident they are legally married. I have to move him to a different house. Still not mine. Sorry i know he's old and can barely move but i have small kids.

next step is to supply life insurance document so medicaid can kick in. Once that kicks in. We can then go get his prescription s filled so he doesn't have another potential episode. Applying for assisted living need to take to a doctor to see if he qualifies. Oh assisted living does not take in account mental disorders. Only physical.

so at least we accomplished something.

Applied for VA housing and benefits. I need to apply for his discharge paper before i can apply for benefits. That can take up to a month.

how did i do this all in one ### #### day and none of the DOC or probation office could supply any of this info.

He couldn't apply for soc sec because he was incarcerated but they could gave us freaking steps to follow. Supposedly he was denied VA facility

So update.

New parole officer says the prison dropped the ball but they can put him up in a hotel. Family doesn't want that.

Social services says same thing but give us assisted living places to call and we call VA hospitals.

VA brings him for evaluations, hes seen 5 doctors so far.

Not ONE PLACE WILL TAKE HIM.

We get the run around and fill out the applications and he gets his exams. And its not that he does not qualify it's some other excuse.

They are so ready to help, then we go through their process and then it's like oh he doesn't have blood work. Ok we'll go get blood work. Oh well his Medicaid only counts if we have a full time bed. Oh so you just learned this, you didn't know that 1 week ago?

So we call 2 other facilities that were recommended. One says well we only have facilities if he was self sufficient with just the mental disorder.

The other says we only have facilities to provide care if he didn't have a mental disorder.

So basically we get the run around and it's freaking taking a toll on everyone.

tl:dr version:

74 year old, can't walk, can't see with bipolar ON medication with ZERO money or earnings

On Medicaid - Until Dec 1.

Dec 1 Social Security kicks in

Can't get medicare until July

Gets Penalized for not signing up for medicare even though legally he could not

So no place in this area will house a veteran 74 year old, can't walk, can't see with bipolar ON medication EVEN with social security paying for it.

 
Yes and yes. You apparently don't deal with VA directly but through organizations. It's a bunch of horse#### imo

yes, from my understanding is you have to call and call and call and never take no for an answer. Sucks big time.

Sounds like you're doing a great. I just feel obliged to note that if NJ is anything like my jurisdiction the two agencies would have zero responsibility to do any of this.

 
One somewhat long shot suggestion here is to check whether the jurisdiction that convicted has a Veterans Court. They may have the funding to get him housing if he agrees to enter a post-adjudication program (if they have one).

Super long shot though.

it was the freaking parole people and prison doctor to say don't worry we will go through the VA blah blah. Well he was denied. No one told us why, he was missing a form we freaking had.now we have to start all over.

Update: after a very difficult tryingmonth. After some begging and pleading and many many meetings, a little help and some good people my Fil was finally admitted to a nursing home. We are still working on VA hospital since they have a better facilities but the current place has really nice people.

lots of stress relieved today

the original probation guy still dropped the ball in many opinions
