At NYC jury duty... AMA (1 Viewer)

Im in civil court...missed the Trump porn case by a single day.

I'm a strong believer in serving Jury duty, but am set up as an independent contractor and won't be payed for this beyond the $40, so will need to opt out if possible. I can't afford to stay.
First off, how are you doing?

That moment taught me the importance of serving. If I, or anybody I knew and cared about every got out on trial, I'd need somebody to cancel out that moron grandmother.
I also served on a murder trial. It was 3 months but really cut and dried about the guy being guilty. The difficult part (and why it took so long to present everything) was that the person didn't die from the beating they took. They actually survived that and was in the hospital for a week before dying of a pulmonary embolism brought on from the beating and subsequent hospital stay. Because of that the prosecutor had to present a lot of medical testimony and legal clarifications on how the law works with respect to causation.

There were also a lot of other charges included (because more than just the beating took place) so it took us awhile to work through each of those charges. We ended up finding the defendant guilty of all but one charge. That charge had to do with intent and two holdouts could agree that they "intended" to kill the victim because the victim survived the beating and died later. I tried to explain that when you choke someone out three times to the point of them going unconscious you are trying to kill them because it's not like you can control your strangling to the point of just making them pass out. The intent was there even if it didn't do the job. But the two holdouts couldn't ger passed that part. Very fascinating process though.
I served on the opposite - civil trial where a "hurt" lady sued her own insurance company after an accident. It had everything - shyster doctors, multiple chiros, outrageous damages. I was 18 at the time and one of the claims was loss of consortium. When we got to the jury room one of the 50ish guys on the jury turned to me when we got to that part and said "that ain't worth that much - we do it way less that you youngsters". :lmao: In the end the insurance lawyer (obviously well paid and good) shredded the plaintiffs and they ended up getting a tiny fraction of what they asked for.

HOA review board approval took a full year. My bosses designed a French Provencal styled thing before I started at the office- it was what I had to work with and what was approved and will get built someday. But I wouldve designed something more... Dunno... CA beach style ffs. 3 doors from the beach with killer beach and ocean views, but designed so that it's all about what it looks like facing it head on from the street. It does that really nicely, but has almost nothing to do with the site. Excited to get it built, but wish I had designed the thing.
 
Everyone intelligent finds a way out of jury duty. Which I'm sure you will too. $40/day is pretty standard and laughable. Most people make that per hour. If they want bright people to be on juries (and that's a big if), they gotta pay $200-$300 per day. I doubt the defendent's lawyer ever wants smart people on a jury though. the dumber and lower rent the jury is, the more likely their guy gets off.

Also, where in NYC is this courthouse?
I strongly disagree, as I just wrote.

Selfish people will get out of it... But it's one of our only civic duties that really matter. Do your duty.
As somebody who does this for a living and who gets to experience firsthand the gravity of when a jury says one word for their verdict instead of two, all we can ask of any potential juror is that he or she takes their duty seriously, pays attention, and truly tries.

Or, if you have no interest in being there, that you answer a question in a way that lets us know. There's nothing worse than a potential juror who isn't happy to be there but doesn't provide any meaningful answers in voir dire.

A little tough to do though, working across many interrelated files and no remote access to the server... Dumb office. But still is a lot I could've done. But then I wouldn't be able to do an AMA

A little tough to do though, working across many interrelated files and no remote access to the server... Dumb office. But still is a lot I could've done. But then I wouldn't be able to do an AMA

Yep, basically.

Anything drawing creation related is best to happen in the office due to heavy external references across the server.

I'm reviewing some PdFs on my phone, and sending emails, but the heavy lifting has to happen in the office. Intentionally on their oart- prefer in office to remote workers

I usually just tell them my Dad is a criminal defense attorney and I have a degree in Criminology. That usually is enough.

Again... I missed the opportunity to get on the Trump case by a single day- they filled the last spots on Friday.

That would've been pretty amazing, but no way I put my family through that as I know our info would leak and crazies from both sides would be up in our business.

I served on a civil case about 10 years ago... Family of a building super who had been taken as a hostage during a running shootout through the streets of NYC (in my old upper west side neighborhood) after a bank robbery.

It was about 2 weeks and pretty amazing. Testimony from the guy who literally wrote the book on hostage negotiations for NYC and many other large cities around the world, as well the guy who wrote the book on swat team engagement. And a bunch of scumbag former NYC police.

Learner that cops are trained- once the gun is drawn-it's life/death, and their gun is there for that purpose, not to wound or maim. They're trained to aim at largest mass so they are more likely to hit their target.. largest target is the torso. That's why they don't shoot somebody in the leg or arm to deescalate a situation.
My cousin was with the FBI and did hostage negotiations. A story he heard from other agents, and which I've shared on these boards before:

Ted Kaczynski, the Unabomber, lived in a small place on a hilltop, and he used to ride his bike down the hill and into town, where he would mail his bombs. A lady let him leave his bike by her fence while he was in town, obviously unaware of what he was up to. As a thank you, he would bring her a bag of tomatoes from his garden. The FBI interviewed her, and she said that Kaczynski invited her one time to come up and see his place. It was small, and it didn't have a bathroom. She asked him where he "went," and he pointed to his garden. "I told him not to bring me any more tomatoes," she said to the FBI.

I would love to become a professional juror. I enjoy jury duty as the process fascinates me. I wish I could volunteer.
We have very few responsibilities as US citizens...follow the laws, pay taxes, don't even have to Vote, but vote...jury duty is the most important of these IMO and the most interesting.

I also served in a murder trial here years ago. Pretty open and shut case given the testimony and evidence. As we're leaving the courtroom to go deliberate and finally able to discuss the case, the old woman I'd been sitting next asked me...

He looks just like a boy that lives down the hall from- the sweetest boy you'd ever meet, helps me with my groceries and around the apartment and always so kind. He couldn't possibly have murdered somebody!

Probably the most unpopular movie opinion that I hold is that Twelve Angry Men is a story about an anti-social villain who uses high school debate-level sophistry to set a guilty man free.

I can't remember every having an architect in one of my jury pools. Depending on the type of civil case, it could swing either way. If I want someone that will feel pretty strongly about doing things correctly and following instructions, I'd want one. If it was unrelated to that type of issue, I'd probably pass on someone that carries professional liability insurance and has difficult clients. They may not want to hand out a big verdict.

If you want to get excused, work in as many misused latin phrases as you can. Prima nocta would be a good one.

Dude, if I can do heavy 3D CAD in CATIA over VPN, downloading and uploading files to the PDM software I don't know why n architect can't do the same for Revvit or whatever you're using.

One time I was sitting through Voir Dire on a case involving $60 in counterfeit bills and this one juror had the selfish audacity to say to the judge “your honor this is a waste of everyone’s time, I’ll give the state $60 bucks right now so we can stop wasting everyone’s time and get back to our lives, look how many people you have tied up over $60 bucks”. To the judge’s credit she admonished him very politely and basically said something to the effect of “we expect to have trust in our American dollars that they are valid for exchange for the goods and services we transact in, please answer the lawyers questions and do not address the court again in this manner.”

I was ready to fly an F16 into the heart of the alien mothership for America after her speech.

So I assume you have someone to run your plans around? I side gig as a permit expeditor and would be happy to help you out if you need someone. Many, many years of entitlements and permit processing under my belt.

We're 3 doors from the beach.

HOA review board approval took a full year. My bosses designed a French Provencal styled thing before I started at the office- it was what I had to work with and what was approved and will get built someday. But I wouldve designed something more... Dunno... CA beach style ffs. 3 doors from the beach with killer beach and ocean views, but designed so that it's all about what it looks like facing it head on from the street. It does that really nicely, but has almost nothing to do with the site. Excited to get it built, but wish I had designed the thing.
Will you be visiting OC or is your portion being done from NYC?
I think once we start construction I'll be out there. But I need to review our contracts... We have a local architect who will take care of a lot of the boots on the ground stuff.
So I assume you have someone to run your plans around? I side gig as a permit expeditor and would be happy to help you out if you need someone. Many, many years of entitlements and permit processing under my belt.

That's why they don't shoot somebody in the leg or arm to deescalate a situation.
They don't do that because it's not a thing. No one, not even an expert, can do that reliably in an active situation. That's Hollywood stuff.

When I was younger I used to be called for jury duty on a constant basis, but they never wanted me for some reason. It's probably been 20 years now without receiving a jury summons. Maybe my statue of limitations ran out? 🗽
 
Im in civil court...missed the Trump porn case by a single day.

I'm a strong believer in serving Jury duty, but am set up as an independent contractor and won't be payed for this beyond the $40, so will need to opt out if possible. I can't afford to stay.

What is your most egregious plan for getting out of jury duty?
I usually just tell them my Dad is a criminal defense attorney and I have a degree in Criminology. That usually is enough.
Im in civil court...missed the Trump porn case by a single day.

I'm a strong believer in serving Jury duty, but am set up as an independent contractor and won't be payed for this beyond the $40, so will need to opt out if possible. I can't afford to stay.

I'm in Orange County, maybe 20 minutes from Emerald Bay. I think that's County land, so you'll submit to the County, of which I have plenty of experience with. :)

Called 6 times.

2x long distance to CA when I was in college/grad school and still using my family address for everything. Obviously didn't have to go.

4x in NYC, including this one. Served the two I mentioned.

So 2/6
That's kinda crazy to me. It seems like you've both been called and selected far more than the average bear.

NJ seems to have a backlog of jurors. I got called for late January when I was going to be out of state. I had it deferred until this month. Then they deferred it again until late July, when I am also going to be out of state. I had it deferred again until mid-September. Something similar happened to one of my co-workers, who lives in a different county. All of his deferrals were from the court, not because of his schedule.

I got called once in my 20s (only had to go in one day and didn't get picked) and then NJ had this habit of calling me for my previous address just after I moved to a different county. But in my current job/residence, this will be the third time I've been called. My employer pays for up to 2 weeks of jury service and I think the courts know that. The first time I never had to go in. The second time, they tried to put me on a car-accident civil case, but as soon as the defense attorney heard that I was once editor of an orthopedics trade publication, they nixed me.
