Company filled in our driveway by accident. Legal council? (1 Viewer)

So, new neighbors moved in next door. They hired a company to come fill their driveway with dirt/rocks(it is on a slight downward angle so erosion happens over time). The company filled our driveway by accident.

I fear the company will try to come after us with a bill. What do you think?

They're minerals, not rocks!!

 
If you never agreed to it then they obviously can't collect. If it's an improvement I would just tell them to take it away. They will likely just leave it, win-win.

 
Call the police. Have them charged with criminal trespass and damage to property or illegal dumping. When the company offers to recover their fill ask them how they can determine where it ends and your property begins. Sue them for interference with your property rights.

I will do this. I just wanted to make sure what I would tell the company IF the company tried to bill me for it.

You are in a prime position to have some new free gravel AND settle for some money for "damages".

Basically, something free or money...........or tell them to come get it.

Worst case scenario they come recover all the gravel, you invite a few friends over, drink beers, and watch them pick up pebble by pebble. Make sure to have that on youtube and link it here.

How does this happen? Was your driveway just dirt?

Did they put dirt and rock over your cemented driveway?

 
Was it just pure dirt before or did you have some gravel? If you had gravel, it would be fun debating which piece of gravel was theirs and which was yours. I think you just got some free gravel.

So the right thing is to reward them for their incompetence? They most certainly will know their error as soon as the neighbor calls them and asks where his driveway rocks are and they start to charge them for the incorrect delivery.

 
Did they do a good job? If so, don't worry. If they did a crappy job, I'd be proactive and tell them to fix it or remove it because future damages could happen if the job was not done correctly.

This is a joke, right? Under no circumstance is doing the right thing to throw any money at something you didn't ask for.
 
Switch houses with your neighbor, and wives.
Bang neighbor's wife, tell your wife you thought you were going to be banging her, and that it's a common mistake, happens all the time, proof is in the driveway.

They aren't going to be able to pick up all the fill without scraping the underlying ground all up & making it look like crap.

 
Assuming that this is an improvement to your driveway, don't say anything. When they come over and say... "Uh... We accidentally put this gravel here."... Just reply with "No. That is my gravel and it's always been there." If they stress that it IS what they put down just start screaming at them "GET OFF MY LAWN! GET OFF MY LAWN! GET OFF MY LAWN!" and begin talking to people who are not really there, but YOU see them. "BARNEY CAN YOU BELIEVE THE NERVE OF THESE GUYS???? WHO DO THEY THINK THEY ARE?!". Throw in a few nervous ticks and gargle sounds every now and then for dramatic effect.

They will just leave you alone.

 
Did they spread it or leave a big pile at the end of your driveway? Full 12 yards?

Do you have a skid loader? If not, ask your neighbor to rent one from the gravel company so you can do the work this weekend. Have fun!

 
I always thought this would be an awesome practical joke. Call up a rock delivery place and order a ton of rocks to your buddy's address and have it poured in the driveway. Ideally it would be done when he's gone so he'd have no idea what happened when he gets home.

Personally I prefer practical jokes that don't cost thousands of dollars.

 
I've thought about posing as my neighbor and ordering a tree service to take out a few of my neighbors trees while he is gone. He would return to missing trees and a bill. The problem is there is only one person bothered by his half dead dirty ### cottonwoods planted on our mutual property line. I would be busted in no time.

Surpringly enough 1 ton of gravel is about $10. No idea what delivery would cost.
