What the hell insurance is that agent from?  You mean they didn't just pay to have it it fixed for the $11K - what did they offer?

Doesn't your insurance company "take over" in this kind of instance?

Note:  It's pretty clear that I am naive about this kind of stuff.  Been lucky with these kind of situations.  
Sorry.  My insurance company ensured that my car was fixed, and they will get reimbursed from the other insurance.

What I was hoping to do was file a "diminished value claim", which represents the loss value of your fully repaired vehicle.  For instance, let's say you have a car worth $20k resale and then get in an accident requiring $10k in repairs. Even if it is fully repaired, the resale value will plummet.  No one is going to pay $20k for that vehicle after running a carfax.

In some states, the at fault driver's insurance company can be on the hook to reimburse some of this.  I don't think it is commonly done because most people don't know you can even do this.

Thanks - hadn't heard of that until recently.  An attorney friend was recommending that to my wife that had someone plow into her Jeep.  

We haven't tried it yet.  

 
Son had a febrile seizure while my in laws were watching him tonight. Thankfully i had read about it here and was able to stay calm for my wife and her family. It's a scary thing to have your young kid suddenly go unconscious and have a seizure but apparently pretty normal if it's your whole body and the kid is 6 or under. They can't always handle the sudden increase in temperature of a fever. He's home now and we are staying home with him tomorrow but for now things have settled down quite a bit. 

I'm not really a share but I'm sharing this in case it happens to some of the other parents here.

Tomorrow I meet with my lawyer to file my first ever lawsuit.  Can't remember if I told you guys when I get hit in March.  Car was less than 2 years old and had over $11k in damage.  Other driver's insurance offered a very small settlement on my medical claim, which I was fine with, but he denied any offer for diminished value on my car.  

I feel a little sleazy, but when I told the agent that I'd have to hire a lawyer if he didn't make me any offer, he said, "You do that".
If you're having to file suit for that, your lawyer sucks.  

And you should be carrying gap insurance on a new car.

People seem to have strong opinions on brussels sprouts. I don't typically post much to Facebook and when I do I usually get a couple of comments and some likes. Posted about brussels sprouts last night and there's like 30+ comments. WTF?

My son had one pretty young...maybe 2 or 3.  

Never had another.   

Definitely scary though and not something first time parents are generally aware of

What are you estimated legal fees vs the diminished value?

Gap doesn't traditionally cover diminished value.

shuke, I was in the same boat as you.  I ultimately determined it wasn't worth it because DV on my car wasn't likely to end up being all that much by the end of its life.  Especially since I'm probably driving this thing until the wheels fall off.  But I wanted to sue out of spite, even if it ended up costing me more than I recovered.  'Cause F them, that's why.  Ultimately my stupid wife talked me into something called reasonableness, apparently.  Whatever that means.

What are you estimated legal fees vs the diminished value?
Diminished value estimate is somewhere in $5k-8k range.  

Lawyer's fee is maxed at 1/3, and is based on whether it actually goes to court.  My assumption is that most of these get settled prior so there won't be additional fees.  I don't have all the details yet, I am meeting with him today.

What else should I be asking?

Glad he's ok, scary for sure. Be careful and make sure his pediatrician is aware of what happened.

You are playing it right. THe other party caused your loss of value. It was their fault, they should be responsible. Your attorney is on contingency, so he's motivated to get as much as possible.

Right.  Rover is just doing the lawyer thing by parsing your imprecise words.  You're not filing a lawsuit.  You're hiring a lawyer on contingency to get a settlement.  He will threaten to sue but it is very unlikely that he files suit for that amount of money.

 
I have a recruiter hounding me about a pretty interesting position.  Love my job and where I work, so I am not thinking of a move. I spoke with the guy once, but he wants to talk one more time to pitch me more salary info etc. How should I handle this if I am 99.5% sure (if salary is crazy there is a chance) I am not interested?

Yeah this.  If you're hiring a lawyer, fine.  If he can't settle this without filing suit he sucks.

He may just be trolling and not even have a job for you.  "the job fell through but I have some others you may be interested in".  The salary pitch isn't worth anything unless its coming from the hiring company. Why would the salary be crazy more if they don't even know anything about you yet?  If you are happy where you are just tell him you aren't interested or ignore him.

Me neither.  I had no idea we had so many proficient water heater guys in here.  Jesus, I wouldn't even begin to know how to repair a water heater.  I'd probably just move if mine broke.

Yeah, this is one of those very good PSAs for parents of young children.  Hazel had two of them.  Eyes rolling back in her head, shaking uncontrollably, no response....not what any parent wants to ever see.  But, they are quite common and although terrifying, it's the brain's way of dealing with the high temp spike.  Pleased to report Hazel hasn't had another one of these in almost two years.  Chances are good this will be the only one of these for 'Lil BFred.

My.mother in law called an ambulance and went in with him. My wife and I each got there separately, a few minutes after she did. He looked like a smaller version of himself. Too fatigued to be scared. Not able to communicate at all.  Eyes partway open while he drifted in and out of sleep. It was a scary scene.  My wife and her mother were terrified. 

But I also remembered that you'd been through this, and that it was every bit as scary, and that things were ok afterwards even if not right away. That helped a lot. Thank you.

This, 1,000 times.  I get hit up by recruiters constantly.  Have never had one pan out.  Many, many times these folks are just trolling for people to enter into their databases because they work on quotas.  They'll see people on LinkedIn applying to jobs, or changing statuses to "looking for employment' or what not and pounce(not that LRJ is doing that. I get that.)  

The past few years, I've began turning the tables on them and vet them before they waste any of my time trying to vet me.  They start asking questions and I drop "Let me back up.  Have you read my Linked in profile closely?  Because it probably answers just about any question you may have for me." on them.  If the answer is anything other than "Yes.  I have" I disengage politely.  If there IS a legit company behind a position these recruiters may have, the last person I want repping me to them is someone who didn't bother to take 3 freaking minutes to go click a couple of links.  

/end rant.  Went a little off the rails there.  Oops.  Recruiters generally drive me nuts.
