There is no clause or special power the NFL has over the cap/bonus implications, correct?

I mean, what happened in the Rae Carruth situation? Did the Panthers just have to suck it up as if their guy were injured?

I believe the Patriots will eventually try to recoup some of the $12.5 million he was paid as a signing bonus or some of the additional money that was guaranteed but not paid as a signing bonus. By releasing him before he was suspended by the league, to the letter of the CBA, they are not entitled to cap relief as he would be recorded as a regular player release and subject to an accelerated cap hit for his unaccounted for signing bonus money. NE would have the option of taking the cap hit all at once or spreading it out over this season and next season.

However, they may be able to file special circumstances or argue that AH voided his contract first by breaking morals or conducting unbecoming clauses in the player conduct section of the CBA (even if it was not written directly into his contract with NE). That's what I was alluding to pages and pages ago that there could have been discussions between the team and the league as to whether they could pursue that at a later date.

But as things stand right now, the Pats will have to eat the cap hit for the remainder of his signing bonus.

The equity in the house, chattels and whatever may be in the bank. The lawyers will get a big chunk of cash on hand and may have him sign liens. There are several plausible scenarios that could justify AH's innocence. Perhaps he's so deep in gang b.s. that he was forced to murder his buddy. If he doesn't comply then he would be tortured/killed/ or his family tortured/killed. There have probably been thousands of "slam dunk" cases historically where the defendant is legitimately innocent (sometimes not discovered until years later). Being setup should not be ruled out as an explanation for AH's involvement. It's hard for me to understand how dumb he'd have to be to do everything exactly wrong. In fact, it's so ridiculous I think a setup is more likely than AH murdering someone.

I agree that the trial will play out regardless of what we think at this juncture.

But I think you are far underestimating the ease of which such a solid framing or setup could be done. There are just too many aspects to the evidence involving too many sources that interlock perfectly for a framing to have occurred.

The duress aspect might be plausible. I'll defer back to the post about Occam's Razor. (Given two theories, the simpler of the two is usually the correct one.) In this case, "Dumb Criminal" trumps "vastly complex setup."

They have AH with a gun on his hand in the video. It may be too grainy to confirm that its the 45. But in any case, he's not cooperated with the police to tell them where that gun is. Wouldn't this key piece of evidence coupled with his non-cooperation be enough evidence to pin the murder weapon on him. Put another way, couldn't the prosecution say, if you didn't do it, then produce the gun and absolve yourself of guilt. If you don't produce the weapon, everyone assumes your guilt. At some point, he's going to have to produce the weapon if he wants to continue to maintain his innocence, or cop to the guilty plea.

I'm not a lawyer but I doubt it.

"sources" had said that once the motive for the killing came out, it would be jaw-dropping. If Hernandez killed this guy to keep him from talking about a previous double murder he committed, that would qualify as jaw-dropping.

Also, don't know if it's been mentioned, this "new evidence" linking Hernandez to the 2012 shooting is obviously (to me) coming from one of the two other guys with him on the night of the Lloyd shooting. I could just see cops grilling a guy, telling him, "We know all this, we know what happened, you have to give us something we don't know if you want to make a deal." And this is the trump card the guy pulled out to get himself a lesser charge.

See Scott Peterson. They had no murder weapon or direct evidence that he killed his wife. But the jury convicted him based on circumstantial evidence of the way Peterson acted after his wife went missing.

Not saying AH is innocent, just weird things happen at trial and sometimes evidence or testimony can be dismissed.

From the first FBG bulletin about Hernandez being questioned:

"The Sun Chronicle of Attleboro, Mass., reported on Tuesday that police identified a rented 2013 Chevrolet Suburban with Rhode Island license plates in connection with the possible homicide."

Well we know from the arriagnment that the vehicle at the scene was a Nissan Altima. We also know from the stories about the July 2012 drive-by shooting that the vehicle in question was an SUV with Rhode Island license plates.

This makes me believe that the police were already investigating the July homicide as part of this case (possibly even before the murder in MA) early on - that is that it's not a new thing that they are looking at this other case.

On July 16, 2012, Boston police responded to a call just after 2 a.m. ET, according to the report. When authorities arrived, they found three people in a car at a traffic light who had all been shot -- two of them fatally.

The two men who were killed were sitting in the front seats. A third person shot was in the backseat and survived. There were also two other passengers who were unharmed. Witnesses said they saw a gray or silver SUV with Rhode Island license plates at the scene of the crime.

The Boston Globe has confirmed the Fox 25 report and also has new details on the investigation.

Investigators believe a fight broke out at Cure, a club in the South End, between two men and a group that included Hernandez.

The two men, Daniel Abreu and Safiro Furtado, friends who grew up in Cape Verde, left the club with three other men in a BMW sedan.
Abreu, who was driving, stopped at a traffic light on Shawmut Avenue, about to make a left onto Herald Street, when a silver or gray SUV with Rhode Island license plates pulled alongside the sedan. Someone from the SUV opened fire, killing Abreu, 29, and Furtado, 28.
The working theory, according to the Globe, is that Odin Lloyd -- the man Hernandez is charged with killing -- might have had information about Hernandez's role in the double slaying.

The silver SUV connected to the killings was never found.

It's possible, it still being early in the morning, that he was planning on recovering and disposing of the body, but never got a chance to, and then panicked and did all the stupid things he did, like breaking the phone and the surveillance system. He may have had a plan, but it didn't go the way he thought and he freaked.

During his first 24 hours in jail, Hernandez has been "polite and cooperative" and a "model inmate," Bristol County Sheriff Tom Hodgson said.

Hernandez was being held in the jail's medical unit, which is standard for someone who hasn't been incarcerated before, Hodgson said.

The former pro athlete showed "no apparent nervousness" in jail, Hodgson said, but he noted the difficulty of going from having thousands of people cheering for him to being "just a number."

While in the medical unit, Hernandez will be locked up for 23 hours a day, with a break for a shower and phone calls, the sheriff said.
