they are both in error
the ONLY chance he had of losing that game was to decline the penalty and fumble one of the 1 or 2 victory formation snaps (43sec) with SEA one score away (1 in 10000? chance - it has happened twice before i believe in NFL history ... Rivers a few years ago and Eagles/Giants 30+yrs ago)
accepting the penalty assured the victory... i'm estimating about the same chance of losing as lightning striking a primordial soup of carbon, nitrogen, hydrogen and oxygen and creating our one-celled ancestor, the equivalent of 1 chance in 10 to the 50th power (which in science is defined loosely as impossible) that he could have lost up 9 with SEA starting from their 30yd line that all of the following could happen with 43 sec and no timeouts ... a successful onside recovery of the free kick, one 30yd gain, one run up to spike ball, one 57 yd successful FG, another successful onside recovery, one hail mary with simultaneous possession awarded to SEA

You're just wrong. Once he declined the penalty, the game was over. No one has EVER lost out of the victory formation. Your two examples are both wrong. The Miracle at the Meadowlands involved a fumbled handoff, and Rivers' fumble was when they were driving deep in Chiefs territory in a tie game. As impossible as it would be for Seattle to come back from 9 down starting with the free kick, there were more ways for that to happen than for them to win down 7 with Alex kneeling on the ball. Then add on top of that the fact that the victory formation doesn't involve trotting your defense and special teams players out for more plays, and it's really a no-brainer.Now what I want to know is this: Harbaugh was allowed to see the results of the measurement before making his decision. The ball is short, so he declines the penalty. But then they go to the booth review on the spot. If the review had actually resulted in re-spotting the ball for a first down, would Harbaugh have been given the option to accept the penalty at that point? I'm assuming he would have been, but if not, then you clearly need to accept the penalty and not gamble on the outcome of the replay review.
