So if an acquaintance of mine texts me a child pornographic pic without my solicitation, and I immediately delete the text and respond, "Don't ever send me something like that again," I can still be charged with possession OR reception of child pornographic materials?

Similarly, if I receive a package in the mail with physical photographs and throw them away immediately, and the police raid my trash, can the same logic be applied?
It is a defense to the charge that you received it on a cell phone/tablet or through visiting social media.

I would of thought "traveling" would have been overseas. It's crazy to think there are child prostitution rings here in the US. Hopefully the FBI gets all the people involved in this. The victims families have to be involved in this as well.

 
I'm curious as to what he would've gotten if he had not taken the plea deal and gotten convicted.
The NY Post has a new story up with some details. I assume they could have hit him with 15+ charges. He would have spent the rest of his meaningful life in prison.

Why would they offer him a plea when it's pretty obvious they found evidence at his house? What's the advantage for the FBI?
Trials are long and difficult and occasionally get lost even when you have the guy by the #####. A case like this could require that the victims take the stand and testify about having sex with Jared. The photos of child pornography victims engaged in underage sex acts would be shown to judge/jury/etc. And at the end of the day, juries are generally idiots.

Up to now, the only information in the case was that he allegedly possessed child porn, but the case is far more serious. According to the complaint, between 2010 and 2013, Fogle traveled between Indiana and NYC to engage in sexual acts with minors. The complaint says Fogle paid for sex.

The complaint says in text messages with one of the 14 minor victims, Fogle said he would accept a 16-year-old girl while stating that "the younger the girl, the better."

The complaint says he asked some of the victims to send him pictures of themselves.

The complaint says the child porn authorities found photos and videos of boys and girls. It's unclear the gender of those with whom he had sex.

Part of the case involves images Fogle received from Russell Taylor, the head of Fogle's foundation. According to the complaint, Taylor sent Fogle photos and videos from hidden cameras in Taylor's house, featuring children as young as approximately 6.

Under the plea deal, Fogle agreed to serve at least 5 years in prison and must pay restitution of $1.4 million -- $100,000 per victim. And he must register as a sex offender.

Part of Fogle's punishment ... he can't possess obscene materials, he must participate in a sexual disorders program, can't have unsupervised meetings with minors, and his computers will be subject to random checks.

Fogle turned himself into the FBI today and he's currently being processed.

The recklessness of it is so baffling. How could the face of a company put himself in those kind of situations? Maybe the risk was part of the thrill for him? Even "regular" infidelity would have been risky from an image standpoint. This is obviously a million times worse. What the hell was he thinking?

Sounds like it was a shopping list or catalog he was reviewing, deciding which minor to purchase sex with.
I was more talking about the part where he knew the guy with his foundation was surreptitiously taping minors staying at his home and then sharing the images with Jared. Really gross stuff.

I posted along the lines of this before.

You and me think "What the hell? Even if you are into that sick crap- why would you risk all you had?" but if you are sick enough to be into the sick crap that means there is something seriously and deeply wrong with you. Regular thinking of something like risk/reward is not relevant

I mean, we are not talking about a guy stepping out on a hot wife and could end up losing half his assets etc for some random chick. In that, the question of 'what the hell was he thinking?' is relevant because looking at/wanting to sleep with women you come in contact with is something most men deal with on a daily basis. Most men think 'risk/reward' and even if half of them at some point decide the 'risk/reward' makes sense to act- the thinking process is usually there.

Once you start thinking of a 13 year old in a sexual way- then they are so twisted that 'thinking' is off right to begin with. I mean, do you ever ask what a pyschopath was thinking?

Not me. I hope he suffers until he's eligible for parole and then he dies a terrible death at the hands of his fellow prisoners.
