15.6 years doesn't seem like enough time
From a purely theory of punishment standpoint, these situations are truly fascinating. It's one of the few areas where most laws lump producers and consumers into the same basket while sentencing them (whereas, in contrast, most laws differentiate greatly in sentencing ranges between a person who sells or makes drugs and a person who merely uses drugs). The theory there is that CP (common acronym for child porn) is so uniquely awful that it's worth any deterrence, no matter how potentially "unfair" to the consumer, offenders can experience while considering making the stuff. I gotta admit when I have to view this evidence it's easily the most definitive proof that I have ever seen that God does not exist.

All that said, I'm still of the opinion that 15.6 is still overly harsh for simply possessing child porn.* I don't see a market causation argument since there is no "market" for this stuff, in a pure economic sense, as the pictures are usually shared in some peer to peer network. Arguably, the majority of the harm to the victim has already occurred and the odds of the victim coming to learn that the otherwise "normal" guy who has this disgusting fetish for this material that he leaves alone in the middle of the night in his home study viewed the material is pretty minimal (my understanding is that a lot of this stuff comes from overseas). Additionally, it seems counterintuitive to punish a cp consumer the same (or, in many case, worse) as somebody who actually committed these acts. Ignoring any 8th amendment arguments, it just seems like a bad idea from a policy standpoint because it creates no incentive for a person with these awful desires to view cp instead of seeking out his own victims and actually acting on his desires (the worse of the two evils).

*The most recently linked article alludes to Fogle also distributing cp. If that's the case then 15.6 seems right in the wheelhouse and, to me at least, appropriate since that furthers the harm to the victims. But my understanding is that he pled to possession only. Alas, this is why I always don't trust a media article on a court case but they so often get details wrong that, legally speaking, are hugely important.
I've always assumed CP consumers are punished particularly severely as an attempt to stem the demand/market for it.

 
Yeah, I can see that but it just doesn't seem with fact or other legal theory.

First, I've yet to see a case where there is evidence of any sort of currency exchange. I'm sure these guys may trade, but, since it's not a finite resource, it seems more like pure sharing.

Also, regarding other situations where it's a crime to sell/manufacture/produce as well as possess, even where there may be a market theory reason to criminalize the possession the same, it just doesn't seem to be the case. I've already mentioned the drug example. Similarly, it's just much "worse" to steal something than to receive stolen property. So, even if that is a valid reason to punish so harshly, it's inconsistent with other areas.

Are you suggesting that I should stop losing weight or ill develop an affliction for children?
 
My assumption has always been that any conviction should stand up to the most rigorous defense possible. Innocents being incarcerated is tenfold the injustice of the guilty going free.

From an article I read a bit ago that's about equivalent to 1 year per terabyte (yes, terabyte) of CP found.

 
6. I'd note that Jared has not been charged with sleeping with a six year old and, from what I can gather, has not even been charged with attempting or soliciting sex with a 6 year old. He had sex with 16 and 17 year olds - suggest that he's a hebephile or ephebophile. He's also been charged with possessing child pornography. Nothing indicates that that he produced any porn or tried to sleep with a small child. He's committed bad and disgusting crimes, but those suggesting he should get the death penalty or that what he did is worse than murdering two people in cold blood are irrational.
Agree. These girls were underage prostitutes right? And he is into barely illegal porn. That's quite different from kiddie porn and raping kindergartners.
My impression is that very few underage prostitutes get into the game themselves because the local Orange Julius isn't hiring over the summer. There's a decent chance that any underage prostitute is a victim of sex trafficking, which we might look at more harshly than if this was just an Amy Fisher situation.

I don't think you could classify the child porn as "barely illegal," whatever that means.

That's a heck of a lot. Certainly an aggravator.
That's an insane amount. I used to collect concert bootlegs, had thousands of them. I think the largest hard drive I ever had was 400GB. That seemed huge to me at the time. 15TB would have to be hundreds of thousands of photos or weeks of video right? Sick *******. I hope they ram a can of soup in his ###.
 
Yeah I've never seen anywhere near that amount. Most I've seen was around a terabyte.

While there is definitely too much of this stuff available, it's not like there is sooo much of this stuff a consumer can always find more. I've been told that movies especially are pretty scarce. It's possible 15 terabytes is a very large portion of the cp available.

Assuming the judge knew that I could definitely see that as a factor for upward departure.

Earlier this year I bought a harddrive filled with almost 10,000 CD titles with some titles being 20+ multi-disc sets and it also has 25-30 full length rock n roll movies. All of it completely fills the 2TB hard-drive.

Having 15 TB of any kind of pron is a crazy amount.

 
If my math is right, 15 TB is about equivalent to 35 standard double-layer Blu-Ray discs (@ 50 GB apiece). I figure there's some space taken off the top of each Blu-Ray for OS formatting.

It would be 300 discs if they're 50GB. 15 trillion divided by 50 billion.

You're right. I was off by a factor of 10.
You were really close if one considers the infinite nature of numbers.

Well, he could be housed on a yard with inmates convicted of similar crimes.  Even on those yards there's a hierarchy. 

That said, no ####### way do I trust an "inside source" revealing something to a magazine called "In Touch."  

 
FCI ENGLEWOOD

A low security federal correctional institution with an adjacent minimum security satellite camp and a detention center.

He was sent there to receive psychological treatment.  TMZ posted this this morning.

Jared Fogle got a surprise beatdown in federal prison from an inmate who has major issues with child molesters ... TMZ has learned.

According to docs, Fogle got jumped in the rec yard at Englewood prison in Colorado back on January 29, and it was not much of a fight. An inmate named Steven Nigg pushed Fogle down and then unloaded a barrage of punches to his face.

Nigg, who's in for a weapons charge, left Fogle with a bloody nose, swollen face and scratches on his neck. 60-year-old Nigg was also injured -- a small cut on his left hand from delivering the whuppin'. Prison officials put Nigg in solitary as punishment.

We spoke to Nigg's family and they're not surprised. We're told Steven's pissed because so many child sex predators are housed in the low security facility, and Fogle was just the last straw.

Jared's attorney had no comment. We don't wanna say karma, but ... oops.

I don't have much sympathy for the guy, but I believe he has a right to safe and humane treatment. Meh, f him actually. I don't care if he takes a shiv to the kidney. He wanted to bang little kids.
