What makes Pola's case different from the Rick Barry case, for example (where he could not play for ABA while under contract with NBA team)?
This has nothing to do with breaking a rule. It's interference with contractual rights.Look, I hate USC, but it's pretty dang unlikely that they broke any rules. The NCAA is a separate employer from the NFL; a tampering clause in an NFL coach's contract has no bearing on the NCAA. Pola might have breached his contract, but even that is unlikely; a contract that says you must obtain written permission before interviewing for a job with another employer is unenforceable.Anyway, it's just a publicity stunt. You mean his team that just lost a coach because USC and that coach violated a contract that he had with Fisher's team? And it is not a pointless lawsuit. A lawsuit like this will let other rule-breaking schools and coaches like USC and Kiffin know that, if you break the rules with no regard for anyone else, there will be consequences. I know accountability is a tricky thing in this day and age, but Kiffin and USC are simply gonna be held accountable for their actions.
Perhaps you can explain how a ruling on the issue of the validity of a non-compete clause is relevant to someone who is actually under contract. In America, you have the right to look for another job.http://news.cnet.com/8301-1001_3-10010724-92.html for one example of a relevant court ruling. "Non-competition agreements are invalid...in California even if narrowly drawn."Pola might have breached his contract, but even that is unlikely;Everyone involved admits that this is EXACTLY what happened. The Titans never gave Pola permission to interview and they never gave Kiffin permission to interview him.
How so?a contract that says you must obtain written permission before interviewing for a job with another employer is unenforceable.
The relevance is that you can't write contracts which abridge people's rights; they're unenforceable. Despite the best efforts of corporations, U.S. citizens still have some rights.Perhaps you can explain how a ruling on the issue of the validity of a non-compete clause is relevant to someone who is actually under contract.

Every contract "abridges" the parties' "rights." That's the entire purpose. You agree to do something you wouldn't otherwise do in exchange for something the other person wouldn't otherwise give you. Now, could you answer my question?Your second sentence is more or less a statement of the obvious, and maybe just some gratuitous rhetoric, but your first sentence is definitely incorrect. The whole point of entering into a contract is to create rights and obligations that otherwise would not exist under common law. You've referenced and linked to the law of non-compete agreements, which are enforceable in most cases if properly drafted. But this isn't a non-compete case and its not a breach of contract case so that is not directly relevant in any case. Its a two-count claim, the first based on Tennessee statute (Tennessee Code Annotated Section 47-50-109 - "It is unlawful for any person, by inducement, persuasion, misrepresentation, or other means, to induce or procure the breach or violation, refusal or failure to perform any lawful contract by any party thereto; and, in every case where a breach or violation of such contract is so procured, the person so procuring or inducing the same shall be liable in treble the amount of damages resulting from or incident to the breach of the contract. The party injured by such breach may bring suit for the breach and for such damages.") and the second a common-law tort claim along the same lines. It is doubtful there is much certainly either way at this point in the process, so I really just take issue with your statements suggesting there is some certainty in the law as to the enforceability of the contract and the merits of the lawsuit.
The hook is punitive damages and attorneys' fees.sholditch said:For the legal team, what damages can Tennessee realistically claim here? Not like they were selling out of Pola's jerseys. Even if the running game were to seriously flag, it would be near impossible to prove that this was caused by his departure.Isn't this one of those cases where the Titans are legally right and should win, but it's not worth pursuing because they can't show any real damages?
Of course its not illegal. This has nothing to do with NFL Rules or protocol. This is a civil lawsuit in Tennessee state court.Nothing was illegal. It was just not protacal. Its not a violation in NFL rules.

You can get attorney's fees in Tennessee? Can't in Bama I don't think (not a lawyer). So what are the punitive damages for tortuous interference with a contract? The hook is punitive damages and attorneys' fees.sholditch said:For the legal team, what damages can Tennessee realistically claim here? Their theory is that this is Kiffin's custom and practice. The purpose of punitive damages is not to reward the plaintiff but to punish the defendant and deter the defendant from acting in the same manner in the future. The defendant's assets and income are taken into consideration when determining punitive damages because if it's determined that punitive damages are warranted the award must be sufficient to deter the defendant from acting in the same manner in the future. Kiffin's contract with USC is $4 million per year. If the jury thinks Kiffin acted maliciously they could hit him with a sizable award. You can get attorney's fees in Tennessee? Can you seriously not interpret that as a misspelling of "protocol"?protacal?Nothing was illegal. It was just not protacal. Its not a violation in NFL rules.
If this old man can shout back a little.Old man shouting at clouds here but what Kiffin just did to Ole Miss - in November - is awful. What LSU is paying him is awful. The millions in player salaries is awful. The landscape of college football today is awful. It’s all awful.

The season timeline is too long. 12 regular season games in 14 weeks, then a week for conference championships, then an off week, then the playoff is going to stretch for 5 weeks (one of those is Christmas though). The national championship game is not until January 19. If you wait until that's done to have signing day and the transfer portal open, that will take another couple weeks, but the spring semester of school already began weeks prior. You can't have student athletes transferring into a new university in February. If this old man can shout back a little.Old man shouting at clouds here but what Kiffin just did to Ole Miss - in November - is awful. I understand this can be very geographical but I'm the only person among my friends and people I knew growing up that preferred the pro game over the college game. My friends could never understand this and I had few reasons but two major one's were I thought the players were treated unfairly with respect to how coaches were treated and the lack of a playoff system made me feel empty on the meaning of it all.
So for me, if coaches can get paid millions and have no loyalty I can only be happy that players can do the same. Getting paid is a big part of that, as well as no longer needing to sit out a year. I certainly agree the money for both sides is getting obnoxious, but I got so tired of hearing the coach BS about "it's about the kids" when they got all the money and could leave when they want that I'll happily accept this.
Love the playoff system vs what we grew up on.
But all these coaches leaving teams with conference championship games and playoffs is obnoxiously gross. Fine if you want to leave, but can nothing be done to put a freeze on this kind of stuff until like January? Push back signing day if need be. I don't follow this stuff as much as the NFL so maybe it's been discussed to death already and no solutions exist.
Exactly.

Bill Frieder says hiWont happen but would be pretty funny if they won the championship without him.
I am basically same page as you as far as preferring NFL over NCAA football, so this also leaves me behind the 8 ball on most of the intracacies of how everything works, especially with all the changes in recent years. But I do listen to a few podcasts that cover all sports, so I absorb some info. Take with a grain of salt; but what I've heard on the Kiffin situation is that he was perfectly ok with staying to coach Ole Miss through the playoffs and it is actually the school/boosters/other involved parties that told him to pack his bags. The reason is similarly obnoxious and gross though - apparently there's a track record of these lame duck coaches spending more of their remaining time trying to poach players to follow them to their new school than win whatever playoff/bowl game they made. One of the major factors in deciding what school to attend is the coach, so Ole Miss seemingly doesn't want to give Kiffin any extra personal time with the guys and lose half their recruiting class following him to LSU.If this old man can shout back a little.Old man shouting at clouds here but what Kiffin just did to Ole Miss - in November - is awful. This guy has gone from the NFL to Tennessee to USC to an OC at Bama to Ole Miss (with a stop at FAU) to LSU and you think he’s going to take a low tier job now? He just had 3 SEC schools fighting over him, if he fails at LSU he’ll just and up at another top-40 program.Once he's fired at LSU he will be coaching a lower tiered program.
I agree with you. If I'm Lane Kiffin, my next (and last) gig is head coach at University of Hawaii.Once he's fired at LSU he will be coaching a lower tiered program.
You're probably right, but Lane is creative at flaming out. And designing offenses. This guy has gone from the NFL to Tennessee to USC to an OC at Bama to Ole Miss (with a stop at FAU) to LSU and you think he’s going to take a low tier job now? I hardly know a thing about Lane Kiffin. Saw he signed a big coaching contract recently. Keep hearing people upset about him. I haven't yet figured out what people are upset about, not that I'm exactly digging into it.
I see, thanks for that summary. If true, then yeah I can see some reasonable issues there.I hardly know a thing about Lane Kiffin. Saw he signed a big coaching contract recently. - Lane coached Ole Miss to its best season in decades, eligible for the playoffs for the first time in school history.
- A few SEC schools that DO have recent championships in their pedigree fired their coaches while the season was still going (Florida, LSU and Auburn).
- Rumors and buzz were that two of the schools (Florida and LSU) were in hot pursuit of Lane. If you had Brett Favre or Aaron Rodgers or Tom Brady fatigue in years past related to their will he won't he play nauseating indifference that drove headlines and sports talk, that's what this was with Lane. He was non-committal for weeks as speculation swirled all around him. Fatigue set in for me early on. Just make up your damn mind.
- Lane provided the world with a deadline on when he would make his decision on where he would coach, but dragged that out to nauseating degrees as well.
- Lane chose the LSU job after he coached his final game with Ole Miss. Many people in Ole Miss feel betrayed, including players, fans and probably other coaches. He will not coach Ole Miss in their playoff game, should the committee put them in the playoffs (and they should).
- Lane tried to blame the AD at Ole Miss for not letting him coach the Old Miss team in the playoffs, but I'm not sure that was accurate. Some feel Lane was making unreasonable demands and I'm sure Lane feels the AD was being unreasonable. Regardless, a team that just concluded their most successful season in half a century won't have their coach for its conclusion and there's a fanbase that's livid about it.
- Lane prayed to god a lot. Lane left his dog in Oxford. Lane is on Ozempic. He probably killed five hookers with Craig James.

Not proven yet, but some texts are surfacing between him and ole miss co-edsLane also gave up alcohol and drugs - which happens when you take Ozempic - so it could be that sober Lane is a better version of old Lane.

He’s a nepobaby
He became a good OC/coach he bombed and screwed over multiple big time organizations figuring that out. He doesn’t get those chances , including the rehab at Alabama, without daddy. Just my opinion. Also my opinion, he’s a world class jerkHe’s a nepobaby
I'm far from defending Kiffin, but I don't fault him for having a very successful football coach dad. By all accounts, he earned the opportunities he got. Clearly, he has other issues, but he's an exceptionally talented offensive coach.
His dad, Monte, worked for him as the DC when he was here at UT.
