Lawyerguys Help: Son Pulled Over and Given Ticket For Not Having Virginia License (1 Viewer)

My son's been living in VA since July after graduation college.  He still has an MD license since he's planning on moving home in May.  He was pulled over in VA for speeding and then given two tickets (60 and 90) days for not having a VA license.  

Have any FBGs heard of this before?  You have to get a new license for the state you're temporarily living in?

 
Been there seven months after graduation? What's the living situation? Is he couch-surfing with friends, or, does he have an apartment and pay rent? Is he employed?

 
He's employed as a scribe getting medical hours so he can apply to PA school in the spring.
Not a lawyer, but the VA DMV says: "NOTE: If you're a temporary resident, you don't have to get a Virginia license unless you stay here for longer than 6 months or become gainfully employed." Looks like he's dinged by both. For tax purposes it's 183 days as well.

If he's established residence by paying rent somewhere, yeah, he probably should have gotten his license. I see people put if off as long as possible when moving here to CA, here the cops don't seem to care as much. If he got pulled over by the wrong backwoods cop with nothing better to do, though, he's probably SOL.

Like the post above, some states make you get a license after being there two weeks or even a month. CA is one of them, likely because of illegal immigration and also driving fees.

Even I got mine. And I'm a total slack. Just go take the test.  
The test isn't super easy, but, at least it's written only. At least, assuming that his original DL is still valid. After 10 years, many states aren't... Arizona I think still would be, but for an expired license he's probably looking at having to take the driving portion as well.

That's actually what I thought when I read that post. I skated by after about a year or so and went before my CT one expired, but his entire license must be expired by now.

I am good until i am 65.

I had a state trooper in UT try to ticket me for this. I told him I had two homes and spent half the year in NJ and half the year in UT for business. It was horse ****, I was living in Utah for 18 months at that point, but I still owned a condo in NJ that I was subletting. No ticket. 

 
I got a ticket my very first day in CA.  :rant:  I didn't even have an address yet, they had to send it to my new job. The place had a lot of illegals so when it finally arrived it was like getting a Blue Letter from Hudsucker - people were getting away from it.

ETA: the ticket was not for an out of state license.

In all likelihood, the officer wrote the license tickets as a break to your son, so he wouldn't get a moving violation. Cop gets his ticket, city/state gets some fine money, son doesn't have his insurance go through the roof. Win/win.
