Well, maybe - it's a voluntary recusal - but that isn't really the issue. The issue is that the primary statutes dealing with recusal aren't criminal in nature, but rather ethical in nature. A criminal indictment would have to be some kind of prosecutorial misconduct or perjury or contempt indictment. Ethical might put him in front of his bar association or the Congress.
