Yeah, right! What's the difference between having a beer and then driving somewhere versus having a beer while driving? Little to none, but if you have a beer and then drive, your BAC is higher because it's already in your system. But one beer, especially a 4.x% lager, is not going to send your BAC up much. Of course, the cops would "frown" on an open container.
