Woman gets $5M from Geico for contracting STD in a car (2 Viewers)

Spin off thread - how much would it take for you to get a STD on purpose?  I don’t know anything about HPV but if it were one of those where it just burns when I pee then I’m thinking 5M is “sign me up”.

HPV increases the odds of a woman getting cancer by a pretty significant amount.

 
She's suing for an insurance payout.  Suing Geico is somewhat misleading
That’s not my understanding. My understanding is she made a claim and it was denied. So she sued them and it went to arbitration because that’s what their policies require. But they lost, surprisingly, in arbitration to the tune of $5M. GEICO then tried to get the arbitration decision thrown out and moved into actual court but was denied and now they’re in a place of trying to argue that their own arbitration clause was garbage and shouldn’t have been allowed, or some such garbage.

At least that’s the way I heard it on the news.

Sort of.   She sued the guy, he tendered to Geico.   They denied defense and coverage so he went to arbitration and settled (guarantee it was a settlement with a covenant not to execute with an assignment of rights against Geico).    Geico then tries to appeal, but loses.   Since they didn't defend, it's bad faith and their limits no longer apply.

They screwed themselves by denying defense,

 
So what's next then?  Someone gets an STD in a house and the homeowner's insurance policy will have to pay for that now?

The article doesn’t say what the policy limits are. The arbitrator would likely make an award without reference to limits. As @Fish notes above, it’s possible Geico waived its limits by failing to defend their insured. Likely explanation is Geico made a big gamble based on their legal opinion on coverage and lost.

No one from a personal insurance standpoint unless you have a high net worth.   Maybe commercial insurance but geico writes mostly personal.  
I carry a $5M umbrella.   Umbrellas are cheap.

When Geico refused to defend it committed bad faith, so the policy limits no longer matter.  They became liable for the entire judgment amount.

Yep, the insurer did this to themselves, although I can't say I would have played it any differently. 
But it's still such an odd angle. The woman's lawyer can drop the mic after this win.

I guess HPV carries the risk of cervical cancer, but the going rate for most STDs is about $75K on a failure to disclose claim.  I've seen homeowners insurance pick up the defense and pay settlements before, but never an auto policy.

Yeah, but almost every sexually active adult has it.

We estimated the average lifetime probability of acquiring HPV among those with at least 1 opposite sex partner to be 84.6% (range, 53.6%-95.0%) for women and 91.3% (range, 69.5%-97.7%) for men. Under base case assumptions, more than 80% of women and men acquire HPV by age 45 years.
It’s really crazy to think she was awarded that much for a usually benign infection to which we’ve almost all been exposed. But you’re right, it does cause quite a few cancers, and warts.

Awesome, so no HPV….got that going for me.
