Can't believe the number of people in here that are actually taking this latest news as a positive. Yesterday, the possibility was still out there that he just missed showing up for a test, as opposed to failing one. Now, we are much closer to certain that he is still, in fact, smoking weed. Regardless of how this turns out, that fact is really bad news for him moving forward.

The league isn't testing just to see who has weed in their pee its to see who has exceeded their arbitrary limit.

Again, without know the metrology testing device but having a background in this field where two samples have been run with one exceeding a threshold and one failing the threshold the decision on what to do with conflicting results varies on what you are testing but in this case its a legal matter with dire results so the first thing the defense is going to do is call into question the metrology and how two consecutive samples could possibly get two different results.

They'll go to the logs and I'm positive they'll find lots of evidence of false positive results due to poor metrology.

It is a matter of exceeding a threshold not whether or not THC was in his system and the only evidence the league has rides on the unfailing accuracy of their testing proccess and it obviously has flaws if two consecutive samples produced two different results, one positive and one negative.
IIRC there were a bunch of cases of DUI/DWI that got thrown out around the country after the calibration of the equipment was called into question. With police not doing annual or semi annual calibration, the breathalizer devices were inconsistent and unreliable enough to place reasonable doubt on their reading. I wouldn't be surprised if the same thing is happening here.

Also, if anyone has done enough chemistry, you'd know that even with known quantities tests can have a huge delta from one reading to another.

 
Keep in mind too that the NFL test ONCE a year, and if you pass that test you can go full chimney.

IOW, the test is only designed to catch guys who have a problem giving it up for something like 4-8 weeks (i.e. the guys who have a problem).

Josh Gordon has been tested 70 times because he's failed at least a few previous tests.

 
Florio is a lawyer but a law degree doesn't mean he's an expert or has any knowledge of potential causes of abarent testing results.

Three primary uses of metrology, scientific, technical, and in this case, legal.

I dealt with the technical metrology of silicon proccessing so our thresholds were miniscule and we had allowable variances.

Iits intuitive on my part but I think its obvious that legal thresholds have zero allowable variances. Thus they cannot have two outcomes on the same urine sample. That simply cannot be with zero allowable variance.

I have no background in legal metrology but even I could make minemeat of their testing procedure if one split sample produced one postive and one negative outcome and I'm far from an expert.

Gordon's defense team should hire a statistician and sick her on the data and she'd destroy the league's test results.

The fact the league and the NFLPA agreed to a policy doesn't mean an agreed upon policy can turn one urine sample into two vastly different outcomes or that policy that could produce two different outcomes would have a legal leg to stand on in a civil court of law.

I'm not sure if we should be considering this good news or bad... Additionally, is it possible that if the league loses this battle that they are less forgiving on the DUI case? This is a tough one to ascertain.

there's a reason everyone hates Gooddell. He's going to have that sh* eating look on his face while he announces that Gordon gets a year for second hand smoke while the wife-beater gets 2 games. And he's going to collect his $45 million dollar salary and not give a crap about what anyone else says.

The fact that more and more news points to how ridiculous it is to have a testing level that accounts for trace amounts of a non-performance enhancing, soon to be legalized plant... that's just going to make us hate him more.

That isn't entirely accurate. It is certain that he is still, in fact, hanging out with people who smoke weed.

It has been demonstrated, and referenced in this thread, that second hand weed smoke can yield a 25 ng/dl positive test.

It is neither here nor there as he tested positive but do you think he should be punished if he wasn't smoking but hanging out with smokers? I think that would be pretty messed up personally.

I think if he was hanging out with guys who were smoking to the point that he tested positive based on the NFL ctireria then yeah he should face the penalty. He's tested positive how many times now? I also think the odds he didn't smoke and just hung out are extremely low given his past. When you have a checkered reputation, as Gordon does, it's more important that you stay as far away from this kind of stuff as possible. Unfortunately this isn't the same as a guy who's never failed a test.

It's a fair point. I am not willing to say definitively whether or not he smoked but in a situation where he did not smoke I disagree that he should be punished just for hanging out with people who are smoking.

The Mayo Clinic's website about such testing says that amounts > 15ng/mL are a strong indicator the person has used marijuana.

The substance abuse policy was agreed to by both NFL and the players union. It looks like they went with a value accepted by the medical community as being more than "trace amounts".

No. Being in a room where they pumped smoke in for 24 hours yielded a test in the 3-4 ng range. We're looking at 14-15 ng here.

As far as I can tell readings that high(!) are theoretically possible if you're sitting in a deep fog for hours, but are very unlikely otherwise.

And, again, either way Gordon's got no one to blame but himself.

How do we know it doesn't enhance performance?

This isn't right at all. I was on probation for two years and had positive tests from second hand smoke yet their threshold was higher than the NFL... It was 25 ngs. I've tested in the 30s for being at a house party the day before a random test. For the NFL to have a threshold of 15 is absolutely ridiculous. The Olympics changed their to 150ngs a year ago I believe.

That reminds me of Shawn King. I remember when he finally got caught by the NFL with his fake pee. He always saved up clean pee in Gatorade bottles, and he dropped his last bottle, and the pee spilled everywhere so he called his girlfriend, and she expressed him some via the mail. His urine sample came back positive for being pregnant. :lol:

This second hand defense is completely sound. I would guarantee any clinical rehab counselor could verify it. The threshold is so small it wouldn't take much at all to get a positive reading... Such as riding in a car with someone who was puffing... Which he had been doing and was pinched for.

Yeah I think it's more likely he smoked like 8 days before the test, and if he had smoked 9 days before the test, he would've passed. The second-hand argument is probably not likely, but its possible. That possibility, plus the fact that the NFL has a lower threshold than other sports leagues and the federal government, plus the wife-beater saga = SoulFly fer dayz.

Based on my ten years of experience as a family court social worker, I can offer some anecdotal evidence of my own: 100% of people testing (+) for weed play the "must have been second hand" card, and the judge / magistrate buys it 0% of the time. Because the non-anecdotal evidence says it's total BS. Tons of scientific studies out there prove that it's damn near impossible to test positive just from second hand smoke.

Most employers have thresholds triple that. I can understand using the norm of 50 ngs or more as a threshold and saying with certainty that it couldn't happen, but with such a low threshold I don't think it's such a certainty. I had been a regular smoker since high school and entered a probation and rehab program when I was 22. I stopped smoking and it took me 4 months to pee clean and I came up positive after partying in a basement at a house party for a few hours. There were blunts and a volcano down there. The clinic said their threshold was 25 and I came in around 30. I said I was told I had nothing to worry about with second hand smoke... I was told wrong.

Whether the limit is too low or not, this entire policy (including the limit) has already been collectively bargained with the players union - yes?

I would imagine the results would highly depend on the potency of the weed they pumped into the room vs the potency of the weed that produced the 2nd hand smoke in Gordon's case. I would imagine Gordon and his friends smoke 'da bomb.

just for reference whats the standard at like a regular job screening? must be higher than probation or the NFL

 
With how much media attention this is getting with comparison to ray rices suspension I wouldn't be surprised if he only gets 4 games suspended plus an additional 2 to 4 game checks with held. On the grounds of extreme low results one over n one just under the threshold. However, this will be his last chance . Either way it goes reduction in the suspension or not. Dude has to be on that last straw . I own him in my main Dyno and I'll be riding him till the wheels fall off.
