Pretty stupid is right. Incredibly idiotic is doing so on a holiday at 3AM when the cops are just licking their chops looking for drunk drivers, and going 15 miles over the speed limit to boot to call extra attention to yourself. Why not just put a flashing sign on top of your car with an arrow pointing towards you.

I can drive easily at .09, but won't since I don't want to risk a DUI. I'm sure you can too, but there others that can't. They need to form a level and apply it to all, and I agree that having a stricter limit than more lenient makes sense. This is a different discussion regardless.

You do realize that by the time he gets in the car, is stopped by a cop and is made to do the field sobriety test he has less BAC than when he left the bar? He could have potentially been more drunker.

lol I looked again and it was a 2016 pick. I snagged it.
I have a team where I would pay that for Gordon right now. It's a stacked team and I'm quite confident the 2nd rounder will be extremely late (the last two seasons, it has been the last pick of the round). I'm crazy-deep at receiver (by staff consensus rankings, I own 8 of the top 27 receivers), so a guy needs crazy upside if he's going to crack my regular rotation. Given that unique combination, Gordon's downside becomes almost irrelevant.
Under more ordinary circumstances, I would not trade a random 2015 2nd for Gordon right now. I have to go through my rankings, but I think I'd value Gordon somewhere in the pick 22-28 range of rookie drafts.

I agree .08 is BS but that doesn't make Gordon any less stupid for speeding around on a holiday with enough alcohol in his system to be borderline even. I have a high tolerance myself and drive fine but I don't speed when I've been drinking and I'm especially careful around holidays.

....and having said that I spent my 2014 1.3 rookie pick on this guy a month ago and the same guy I got him from offered me a 2015 1st yesterday to get him back. I'll wait until I'm sure he's heard this latest news before accepting but this is it for me. Even if he doesn't end up suspended for the year this year it's obvious now that it's just a matter of time. Twice now he's been in a jam while awaiting this decision and at this rate there's likely to be even another incident.

Let's say, for argument sake, he never peed positive since a drug test since last summer. Let's say he was well on his way to being negotiated down to 6 games suspended. What does a DWI do to the negotiation process? I think this could be as unique a case as we've ever seen, as far as the leaked failed test months ago, and two subsequent boneheaded actions that may or may not affect the appeal that is currently going on. I'm am dying to know what he gets.

Grasping at straws here: Can we draw any parallel to this situation and Marshawn Lynch's? Lynch was arrested in July 2012 in California and blew a .08 (the lowest level above the legal limit). I think Lynch plead guilty to a lesser charge (an unsafe lane/wreckless driving charge) and didn't have to attend a four-month DUI class in California. Goodell didn't/hasn't suspended Lynch for the violation. This wasn't Lynch's first run-in with the law. Lynch was also suspended for three games under the personal conduct policy in 2009 for a misdemeanor weapon charge.
We don't have all of the details regarding Gordon's appeal in July, but I think this arrest is a completely separate issue.

I'm having a difficult time agreeing that people should be able to have more to drink before they drive, because they already drive #####.... but, I found a state police breathalizer in my house when I bought it and it to be really unreliable. Using it at the bar, I'd find that it'd jump around by .02-.05% without having had any additional drinks. Knowing that the tools the LEO's use to say someone is impaired is shoddy at best, I don't trust a .08 limit to really indicate that someone is "drunk" when they're pulled over.

Any imposed limit is arbitrary and subject to change depending on the political climate.So yeah, it's bull#### because everyone doesn't suffer the same level of impairment at a given BAC.I know there are those that don't buy that but that's the truth. The political climate obviously changed and many states imposed lower limits based on lobbyist movements (see MADD), and that's likely not about to change ever.

Sure potato chips can be addictive. Will power and not being a ####### idiot keeps you from eating 12 bags in one sitting. It is not addictive, you are foolish to believe someone could be addicted to it. Could they crave the feelings? Yes. Can they create a dependency on it? No.
I agree with you... This Is a very interesting case...Marshawn had a DUI thrown out and was not penalized for just being charged with the DUI...
There is a good chance that Gordon gets this thrown out (0.09). It will be interesting to see if the arbitrator (or whoever makes this decision) takes this into consideration...
It's obvious that Gordon has a lot of growing up to do. Maybe he can pull it together if he is not judged/roasted by everyone on this message board or in the press....

Awesome dude. Point is its the law. I agree with you but also understand that if I have a couple at the bar and drive, I am LEGALLY flirting with trouble. So the guys is too dumb to realize the life he could have versus the life one more tiny beer might cost him. How you or anyone else operates at 0.08 is irrelevant.

Even if it's below .08 PD has discretion to charge w/DUI 23152 a or B or issue a "wet reckless" 23103....as others have indicated...he is toast......

You are foolish to think that somebody who cannot fight the craving is not an addict.
I say having one more beer should not have an impact on the type of life that you should be able to have/live when the limit is .08.
If the limit is .08 - then we all need to understand what we are dealing with. A different world when it comes to drunk driving....
Drunk driving will be more like a speeding ticket in this environment....

I guess when it comes to his guilt or innocence, the question is whether they use your standard or the legal standard. I'm guessing your opinion doesn't carry much weight there. Be as outraged as you care to be.
The NFL provides free taxi service to its players when they want. He admitted to having 3 drinks and driving - and speeding to boot - on a holiday where cops are known to be very proactive and have an increased presence. That's poor judgment no matter how you slice it. Not if you did it, of course. Just Gordon in this case.

Do we know if he was administered the roadside sobriety test or not? I'm assuming he was, pretty much standard procedure. Maybe he failed that as well
I find it hard to believe that a finely tuned athlete would fail a roadside sobriety test at .09.
Maybe he was high as well???? That would put things in a different context...
And he is clearly thinking exactly like you are. It probably shouldn't matter but that is irrelevant. If you can't get why realizing its a problem is a concern, well then I can't help you....

Appears I deleted my post on accident. No I do not believe that gambling or any other form of "addiction" that isn't based on chemical dependent is an addiction. Weed is not addictive. Not is gambling. Cigarettes, alcohol, meth, oxy... That ####s addictive.

The DSM distinguishes between "substance-induced disorders" (such as withdrawal, and which all of the substances you listed would result in) and "substance use disorders".
At the end of the day, whether you believe weed is addictive or not, the people who valued Gordon as if he had an addiction problem were able to make actionable predictions and dramatically outperform the market when it came to valuing Josh Gordon. Whether we consider Gordon an addict or not, to this point, valuing Gordon as if he hypothetically did have an addiction problem would have produced superior fantasy outcomes. I would be more sympathetic to the idea that Gordon isn't struggling with addiction if his behavior wasn't exactly what one would anticipate seeing from someone struggling with addiction.
My opinion differs ALOT from Matt Waldman's normally - but he had this pegged better than Nostradamus!
