He was arrested not convicted.  Calm down.

There's even a quote in the story "“I suspect that being arrested is the least traumatic thing that has happened to him in the last 24 hours. While I understand that the police have to speak to him if someone has died in his home..."

78 year old guy kills an intruder and is taken away in cuffs? Don't care if he was not convicted. That's not right. Was the pensioner a flight risk?

3. Maybe it is in the UK.

4. I don't know.  Is he?

And if you read the reports the police do not know exactly what happened.

What are your rights if someone breaks into your home?

The CPS and police urge people to always call the police first - if you are able.

But according to official guidance, anyone can use reasonable force to protect themselves. 

As a general rule, the more extreme the circumstances and the fear felt, the more force you can lawfully use in self-defence. 

The law doesn't require you to wait to be attacked before using defensive force, but does not protect you if, for example, your action is over-the-top or calculated revenge.

You are given greater protection under the law if force is used to protect yourself or others when dealing with a burglar or trespasser on your property.

The CPS says if you have acted in reasonable self-defence, as described above, and the intruder dies you will still have acted lawfully.

The police can only speak to people they have arrested?

 
“While the area is lovely, there’s been a definite increase in crime over the past few months. Just recently my partner was threatened with a knife while walking our dog, and we’ve both been stopped countless times by people trying to sell us drugs, which is quite a shock given that this is a quiet suburban street.
yeah, that area sure does sound lovely.

 
In all seriousness, self-defense in the UK has taken a fatal blow in years past according to Glenn Reynolds and co. over at Instapundit. It's a real issue. Thanks to otb for posting this. Should probably be removed to the political forum, though.

This is what happens when you don't zealously defend your natural rights. #### like this happens. That he can't defend himself is ridiculous.

nah, facts fly in the face of that - inasamuch that there was a second dude who fled the scene, and both the "intruders" were half the old codger's age ... think we got a slam dunk here. 

now, one should always wait for all the facts, and should never say never - but, to quote the esteemed Richie Aprile: "in this case you can say never ... from now on, he's a shopping cart"

So if you add them together they equal the same age as old dude.  Seems like a fair fight to me.

  not really, he looks to be a virile 78, so ... more like a combined 78 tangling with a 65 year old - so they had a distinct advantage.
