But even so, if the choice is getting a DUI, losing your license anyway, and facing jail time, why give a police officer evidence to convict you on a DUI when otherwise youll recieve a lesser charge? Well in Maryland if you don't take the field breathalyzer they arrest you and take you to jail, then force you to take the breathalyzer at the station. The test at the police station is the only one that is admissible in court, however if you take the field test you can requet your lawyer to administer the test at the station, or opt for a piss test, or a blood test.Having your lawyer show up gives you some extra time to sober up a bit.Oh yes, in most states that is the case.
