Has this been discussed yet?http://usnews.msnbc.msn.com/_news/2012/05/11/11660804-marissa-alexander-gets-20-years-for-firing-warning-shot-after-stand-your-ground-defense-fails?lite

Marissa Alexander gets 20 years for firing warning shot after Stand Your Ground defense failsMarissa Alexander, whose case brought allegations that Florida's Stand Your Ground law is being unfairly applied, was sentenced to 20 years in prison Friday after being convicted of three counts of aggravated assault after firing a warning shot during a dispute with her husband. The case sparked a confrontation between a congresswoman and the prosecutor after the sentencing in Jacksonville, Fla., WJXT-TV reported.Alexander, 31, claimed she fired a shot from a handgun into the wall to protect herself during a confrontation with her husband, who she said had abused her, WJXT reported. Two children were with him when she fired a shot in his direction, and she was charged with three counts of aggravated assault. Her attorneys claimed self-defense and cited the state's Stand Your Ground law, which gives people some protection from prosecution for using potentially deadly force in cases in which they feel their life is threatened. The law came under nationwide scrutiny during the Trayvon Martin case, when neighborhood watch volunteer George Zimmerman shot an unarmed teen and authorities waited weeks before charging him.But a jury agreed with prosecutors that the law didn't apply because she left during the argument, got a gun and returned to confront him, WJXT reported. Last week, State Attorney Angela Corey, who is also handling the Zimmerman case, said she personally met with Alexander and reviewed the evidence in the case, WJXT reported. She said she offered Alexander a three-year sentence before trial, despite the case qualifying for a 20-year minimum mandatory sentence. The case has sparked rallies on Alexander's behalf, and WJXT described a heated scene outside the courtroom after the sentencing: "Three years is not mercy and 20 years is not justice," U.S. Rep. Corrine Brown told Corey in an animated confrontation in the hallway. "If there ever was a stand-your-ground case, it was this one." ... She said she has been in contact with some of the best domestic violence attorneys in the country and will be involved in the appeals process. "This is the beginning, not the end," Brown said of Alexander case. "Clearly there is institutional racism."At issue in the case were Alexander's actions leading up to the firing of the shot.Alexander has said that 36-year-old Rico Gray had physically abused her in a dispute on Aug. 1, 2010. She testified that she fled into a garage and got a gun, but was unable to leave the home because the garage door was stuck. She testified that she went back into the house, where Gray was with his two sons, and fired the shot. But Corey argued that Stand Your Law did not apply because Alexander acted in anger. The judge agreed, saying that by returning to the house, she showed she was not in fear for her life.Gray had been arrested twice on domestic battery allegations, but Alexander had been charged with domestic battery four months after the shooting, Jacksonville.com reported. The 20-year sentence was a mandatory minimum under Florida's "10-20-Life law," which mandates sentences for crimes involving a firearm, the Grio.com reported. After the hearing, Alexander's attorney, Kevin Cobbin, said the Stand Your Ground law isn't always applied fairly, NBC station WLTV reported."The law was made for people like Ms. Alexander," Cobbin said. "They did not make it for people running around on the streets shooting people. They made it for women in their homes trying to defended themselves against abusive mean men."

Stand Your Ground
I don't think Zimmerman has claimed Stand your Ground applies to him. In any case Stand Your Ground has been very inconsistently applied in Florida.
The 20-year sentence was a mandatory minimum under Florida's "10-20-Life law," which mandates sentences for crimes involving a firearm
Florida has one horrible law after another.

Yep. And they apply them haphazardly. "Unintended Consequences"...

So he shot Martin because he was Mexican?
No, he shot Martin because he is an idiot. His being Mexican has nothing to do with it.
I thought he shot Martin because martin was threatening his well being in a vicious attack..What evidence do you have that Martin was an idiot? Link?
You may be right; Zimmerman is quite possibly more of a ##### than an idiot, but I think it's a toss-up at this point.

George Zimmerman, the volunteer neighborhood watchman from Florida charged in the killing of unarmed black teen Trayvon Martin, could face federal hate crime charges, WFTV out of Orlando reports.

If Zimmerman, now charged with second-degree murder in the Feb. 26 shooting death, is convicted of a hate crime, he could face the death penalty. The Justice Department says it has been investigating all aspects of this case, including the question of hate crime charges, since earlier this year.

"The independent investigation remains ongoing, and we continue to provide support and resources to the local prosecution,'' Justice spokesman Wyn Hornbuckle said Tuesday.

Im torn on this. Im thoroughly disgusted by the crime. But hate crime seems to be a reach. While i do this prejudice may have played a role, i don't know that i would categorize this as a hate crime. I wonder if there is more evidence that they have that we are unaware of.

agreed. i dont see a problem with cheering for the death penalty depending on the circumstance. If it was a pedophile who killed a child or something like that, i know i would be giving a thumbs up!

A medical report compiled by the family physician of accused Trayvon Martin murderer George Zimmerman and obtained exclusively by ABC News found that Zimmerman was diagnosed with a "closed fracture" of his nose, a pair of black eyes, two lacerations to the back of his head and a minor back injury the day after he fatally shot Martin during an alleged altercation.http://news.yahoo.com/abc-news-exclusive-zimmerman-medical-report-shows-broken-204911351--abc-news-topstories.html
Two lacerations is interesting. I wonder if the autopsy revealed anything under Trayvon Martin's fingernails. The ballistics report and autopsy could prove very revealing in this case.

Thats big news.Nothing ever showed to be broken nose, blacked eyes or the requisite swelling for either. It is the family doctor though. Wonder when this report was done.

That's what's curious to me about the use of the term "lacerations"; which clearly implies blunt force trauma. The (admittedly grainy) video showed a very coherent looking Zimmerman with no evidence of a broken nose, or anything that resembled blunt force trauma. This would seem to be unexpected for a man who was pummeled to within a few inches of his life an hour or so earlier.Perhaps these things showed up later, perhaps the family doctor is a good friend. The autopsy, medical (from that night) and ballistic reports should clear things up.

Not sure why we're giving any credence to a report by the liberal agenda-driven media anyway.

Pathetic.
The whole concept of hate crimes is an assault on the fundamental fairness of our justice system. If they can turn a potential self-defense case into a death penalty case, it is beyond ridiculous and it is absolutely sick that anyone would even suggest it or cheer it on. One of the top reasons Obama should not be re-elected is the embarrassment that Eric Holder is. Obama should have fired Holder over two years ago when he ####ed up the whole Gitmo fiasco.

We dont know if that is the case or not as of yet. Your assuming. In the case where i believed a disgusting hate crime did occur, then i would be ok with the death penalty. I think that's where sac bob is coming from. Really, none of us have enough evidence to determine whether the charge is valid. We are all speculating. however, if the FBI is bringing up these charges, i would assume they know more than we do.

Acquittal on the state case will pretty much kill off any hate crime case. You can't exactly have a self-defense hate crime.

Family doctors.

Lets not leave that out of the discussion.
If a doctor puts his name to it and it's used in court, he's subject to perjury if it turns out to be fabricated. Plus I imagine he would lose his license as well. I prefer to withhold judgment until we see the actual report, but I'm not going to go along with doubting the integrity of a professional. There's been far too much of that in this case already, particularly from the pro-Zimmerman side.

Actually zimmermans brother has said that he was beaten within an inch of his life by Trayvon and had he not shot the kid he would have wound up a vegetable on life support.I guess we can say that the family doctor is as credible as the funeral director who said he saw no evidence of a fight on treyvons hands or body other than the bullit hole

Thats big news.Nothing ever showed to be broken nose, blacked eyes or the requisite swelling for either. It is the family doctor though. Wonder when this report was done.
"the day after he fatally shot Martin during an alleged altercation"

Family doctors.

Lets not leave that out of the discussion.
If a doctor puts his name to it and it's used in court, he's subject to perjury if it turns out to be fabricated. Plus I imagine he would lose his license as well. I prefer to withhold judgment until we see the actual report, but I'm not going to go along with doubting the integrity of a professional. There's been far too much of that in this case already, particularly from the pro-Zimmerman side.

Report: Feds weigh hate crime charge in Trayvon Martin death

USA TODAY, Full Article

You cheer on the death penalty?.. You're a warped individual..
Depends on who is dying.
What if Zimmerman had died at the hands or Martin? Would the cheers be so loud? No. This wouldn't even be a news item.

Sure it would: 17 year old with no history of violence suddenly beats man to death while walking back from convenience store. Immediately arrested and charged with 1st degree murder, prosecutor intends to seek the death penalty.

Not you in particular. But go back and read through this thread how the lead investigator and the lead prosecutor have had their integrity challenged again and again. It's been embarrassing. Accusing them of making mistakes is one thing, but they have been accused of deliberately lying, making up evidence, etc. Legal experts such as jon_mx and Carolina Hustler have challenged everything they've done.

Then the right person would be dead.

It's easy to decipher from SacBobs posts in this thread that he already knows what happened..It's a bit childish to cheer on the death penalty without knowing the facts of the case.By the way, the Death Penalty option was the conclusion of the reporter, it does not say the justice department was seeking or even considering the death penalty for this case..

So both the photograph evidence showing injury as well as the medical reports are fakes?

Terrible mis-quote by you here. His brother said that Zimmerman moved his head off the concrete on to the grass to avoid damage that might case him to be a vegetable.. He never said he was beaten to within an inch of his life. He specifically says the shot was taken to avoid being disarmed and having the gun used on him..Brother:

“George was out of breath ... his last thing he remembers doing was moving his head from the concrete to the grass, so that if he was banged one more time he wouldn't be -- you know, wearing diapers for the rest of his life and being spoon fed by his brother,”

“What Trayvon said was, either to the effect of, I believe, ‘This is going to be easy, you die tonight or you have a piece, you die tonight.’ And then attempted to disarm him. So when [you say,] he had a bag of Skittles and an iced tea ... nobody just stood there with a bag of Skittles and iced tea. “You return force with force when somebody assaults you.”

The funeral directer is qualified to make these distinctions in what way?

The doctor has a degree, and is trained to make these diagnosis'

Sometimes you have to be a big boy and realize big boy realities.. Lost any respect I had for you here..
I don't get it. SacBob and I haven't agreed on diddly in this thread but if Zimmerman is found guilty of a hate based murder then what's the problem here? Should hate based murders not warrant the death penalty?
No, murder should warrant the death penalty; if Zimmerman was black would Martin be just as dead?
