If your license is "revoked" in one state (1 Viewer)

Okay, I got popped for a DUI early January which I was guilty of. Mid April I was pulled over sober leaving a pub with my girlfriend at the time. I hadn't even had a drink. I was hauled in by a cop who'd been on the job for two months for DUI. Was ridiculous. 3 weeks of calling the courthouse to get my blood results and they finally said "They came back inconclusive. We could not get a reading on your blood". At the time I had a lawyer for the first one but decided to talk with a PD. She said she'd take on both cases. I was offered a plea that I turned down. I was then offered a second plea - plead guilty to DUI 1 and reckless driving for the second. Loss of license for 30 days - 2 DUI classes and court fines of $780.

Was also told I could get a work license during that period. Now while this was all happening I took a sales manager position back down in Colorado and notified my PD. Before I mailed in the plea we went over the terms. She said work license would be part of the package. What she didn't know is that they cannot issue a work license out of the state which would clearly effect my plea. I would have fought it. Anyhow, the person I was living with in SD told me they saw some mail from the DMV which they could read through the little window "Your right to drive has" and not the rest. I didn't want him knowing my business as he is someone I do work with from time to time. Procrastination took over and I didn't even want to know what was up because I am so busy with work.

Fast forward to today. I was given a company truck and they finally said they had to add me to the insurance. I decided this would be a good time to stop procrastinating and figure out if my license was valid. Apparently preheating was on the 31 of June or July _ I honestly forget which and sentencing was on August 4th. My PD never called me back after I sent the plea package. My 30 days never started because I never surrendered my license. Called SD DMV and they stated my license was revoked and I needed to surrender any license I had to begin the 30 days.

My friend in Jersey said "You can just get a license in CO. 99% sure. You just can't drive in SD". Bells went off. I had never actually lost my right to drive here and had just got a new license less than two years ago. Called DMV - Good standing. Case closed. Don't go back to South Dakota.
Habitual drunk driver blaming it on the rookie cop. Classic. :lmao:
Didn't even have a drink that night. Was at the coffee shop helping my girl do cover letters for jobs and stopped for some pulled pork chips. I barely ever drink. Cop saw my prior DUI arrest and a hot chick in the front seat and hauled me in. Typical cop...

I should say when I applied I never mentioned my Colorado license. I just rolled in with 2 forms of ID and walked out with a local license.
Did you have to take the written exam and the actual driving exam?
Nope. I just gave them a couple forms of ID. Tax document and my birth certificate.
They must share databases with CO and saw that you had a license, in which case your CO is no more.
Well I just called the DMV and they told me I could come in a purchase a duplicate. I said I can just come in "everything's cool"? Yes, Mr. Finless, your license is in good standing with the State of Colorado.
They're waiting with handcuffs.

 
Does your employer know about your multiple mDUI arrests?
Yes, why?
Sometimes it can be difficult to get a company vehicle (and put on the company insurance) with them on your record.
Yeah I just talked to a girl in production about this. We hired a new kid last week and they gave him a truck to drive but he has to buy his own insurance because of a DUI. None of that matters to me. Insurance is nice but if I have to I'll pay for it. I feel like somehow I found a loophole as long as I never bring my SD license into the equation. As far as the DUI goes, the owner knows. He's a friend of mine. He's also sober :unsure:

 
what i do not get is if the taillight was not out and there was no alcohol in the blood why you'd plead guilty to reckless driving?

Serious question - for what? They do have agents at the DMV here for people who show up with warrants. Who knows, maybe they are setting me up. I did get in a small "fender bender" with a pregnant lady before I left town. She was fine but apparently her husband called the company I worked for and said she was hurt like a month later. Never heard anything else about it again :unsure:

Because I'm from CO. One DUI here automatic license lost for 1 year. They packaged the two DUI charges one of which I legit together and offered me a please of 30 days. I wasn't getting out of the first one. But the package they offered was as if I had only been found guilty of 1. I talked to a friend of mine in California who said it's not unheard of to still be found guilty by a jury of DUI with no BAC evidence. I told her my plea offer and she said take it. The lawyer I was paying said I would be stupid not to take it and my PD said it would be stupid not to take it. Part of the deal is it's all sealed and will not show up on my record. I forget what they call it but I guess you get to use 1 in your lifetime....a suspended Imp?

 
Legally you are driving illegally. Practically, I don't see how anyone would ever find out. I think you are good, until either state discovers the situation in the other state. And then you would be screwed.

The answer is likely very state specific. If a particular state has given you a license to drive, you are possibly okay to do so. However, if you drive in another state, even one that didn't suspend you, you could be in violation of that states law since your original state suspended your privilege to drive.
No my original state didn't. The only reason I got a license in SD is because I lost my wallet. My original license was in CO, where I am now.
Original was a generic term there.

In my opinion though, while you may be valid to drive in CO, if you drive in another state, even if it isn't SD, you may be in violation of a law in that other state.

For example, in my jurisdiction, a person caught driving in your situation would likely be charged with driving on a suspended license, a class 1 misdemeanor, and face up to 6 months in jail and up to a ~5k fine because your privilege to drive in another state has been suspended.

Most of the states share databases. My understanding is only California and a couple others do not.

Surprised you still have your Co DL. A few years ago my dad died and I went back home to Kansas and picked up a Kansas Id to cash some checks and kept my Colorado DL. But Colorado canceled my DL since you can't have a DL and a ID. Maybe it's not the same thing.

 
In Colorado, you are supposed to surrender your out-of-state license when you get a license (or ID) in Colorado. If you read the paperwork that they give you it asks if you have a license in another state. I guess you can always lie or say you didn't see the question.

There is a "uniform" law, I think it is called an interstate compact, that recognizes license suspensions and revocations imposed by other states. So if you ever get stopped and they look and find it, they can charge you with driving under suspension. I think a first time DUS carries five days mandatory jail.

So make your choice and take your chances.

Most of the states share databases. My understanding is only California and a couple others do not.
Sure they share data bases, but all they have to correlate a person is by DL # and name. Many people have same names, but they are not suppose to have 2 DL #, so I am not seeing how they figure out it is the same person.

ETA: But if it is pointed out somehow they are the same person, then he becomes screwed.

I'm not applying for a CO license. Mine is apparently still active here.

 
You should check to see if your state submits info to the national driver registry. It's a some what new database. You can't do what your doing anymore if your state checks it. I actually went to renew my license 2 years ago and they would not let me because they said my license was suspended in Maine for a 20 year dwi which I 100% cleared up. Had a license for 16 years 3 renews ect. no problems. Said the they never received copy of completion of dwi course which they had or I never would have gotten my license back in the first place. Place I took my course said they did not have the records from that far back (93) Had to take another course. This new registry can be a ##### but I don't think every state complies and western states seem like the kind of states that may not.

Yeah I get all that. I'm not renewing it. I never turned the old one in when I got one in Colorado. It's still valid and in good standing according to the registry.

 
Well that didn't work out so good. Went in and they asked me for my SD license. Said I surrendered a CO license for a SD license. Thinking maybe I surrender my SD license and they issue me a CO one?

 
When I go to the dmv to renew my license they give me a temp. license on a piece of paper and mail me the laminated one a few weeks later. There is a sign that says they can't issue you the laminated one that day because of the Homeland Security Act. Wouldn't this be the same for every state? I think the OP should just continue driving in any state he wants to as it's not likely he'll get pulled over anyways :lol:
