Jodi Arias case (2 Viewers)

If I was a juror, Martinez would offend me the way he is grilling the doctor. So he bought her a book, big deal.

I know what his point is but too over the top for me.
I loved it. This psychologist guy is a clown.
I agree he is a clown, but the way Martinez acts sometimes makes himself a side show also.
He's a lot of bluster and is too theatrical. Some of that can be okay, and you certainly need to maintain witness control, but a raised voice is like using a highlighter- if you highlight everything, you have highlighted nothing. He's able to get away with it here because he's got so much ammunition and there's so little sympathy you can muster at this point for Jodi and her hack psychologist, but if he had a sympathetic defendant, e.g. the classic battered wife who murdered her husband, he could very well engender sympathy with his bullying approach.

Anyone watch HLN after dark? Tonight after Nancy they have replicated Travis's bedroom/closet/bathroom/hall... to see how plausible her story could be. Should be entertaining if not interesting as well! :popcorn:

They better get right into production because Lohan is closing fast on Jodi's psychosis level. Pretty sure I would not want to be on duty on her ward over the necxt 90 days.

This is historic. I doubt we see another circus like this in our lifetime. This is also probably the hottest woman to ever be convicted of murder 1.HLN devoting 4 hours a night to a murder trial. OJ's probably jealous AND trying to get in contact with her.

It's unbelievable. I was on the edge of my seat waiting for where Juan Martinez was going with the psych eval. It seemed like he was leading up to the fact that he could prove that Jodi didn't answer the questions honestly, and they dragged it out and then BAM.When the Samuels guy said, "I probably should have re-administered the test." Holy carp. That would be Game. Set. Match.
 
I love how this "renown" psych in his field was told by Arias "I'm contemplating suicide" doesn't report it to any jail personnel! WTF is this I told the attorney! That's big actually, let alone to all the other testimony that Juan shredded today such as not re-administering the test when it was known she lied about the ninja story and counting something a 6 instead of 4 and and...

Look at Jodi toward the end of the trial today, almost in tears. Ruh Roh... :popcorn:

But..........all it takes is one dumb dumb jury member, and unfortunately no exam is given to potential jury members to determine average IQ.

 
Anyone else kinda feel sorry for the ole psych dude? I mean the defense obviously didn't prepare him in how to handle cross (can't believe they didn't know ahead of time what could happen...)and he's left up there sinking. His credibility imo is ruined. :unsure:

Not really. On the one hand, this is what he does for a living (he doesn't see private patients anymore) and he gets paid a lot of money by the government btw to do these evaluations and the guy is clearly an incompetent puddle. However, I can't imagine he will ever work again after this so I can have a little sympathy. But WTF... seriously? You give a psych evaluation to diagnose someone with PTSD, and at some point you become aware that they falsified the information on the test and you don't re-administer the test?? And everything down to him not having all the documents and he thought they may be on his desk and his inability to actually say what the test acronym stood for? A total joke.I'm so confused about what exactly went down today though. At first JM alluded to the fact that the defense attorneys had never seen the raw data for the test so they were unaware that she lied on her answers. That makes a little sense to me if it is supposed to be an independent evaluation and he just provides the results of the tests. But at some point JM obviously got his hands on the raw data for the tests. It seems maybe Samuels sent them to another psych to corroborate the results and maybe she gave them to JM? But he would still have to share that with the defense attorneys before being able to admit them as evidence I think? So did the defense team really have no idea that she lied on the tests that were used to diagnose her? Or did they just never review it? Or did they know and still put this guy on the stand which would be idiotic. Can't wait for tomorrow and then the jury apparently gets to ask this guy questions which should be pretty awesome.

Who the hell knows what he's rambling on about. Dude would still be alive if he didn't set her off. You have to know how to handle these psychos. He screwed up and is dead because of it. He broke it off. She called up wanting to see him. He knew the risks since he beleived that she a. slashed his tires a couple times and b. predicted that she would kill him. his #### said bring it on. His brain said no. his #### won out and we see th results. Doesn't mean she's not hot, she is. ;)

She is cute at times and if the nudes are real she has a decent body but she isn't "hot" to me. Just kind of cute.

Doc is getting slammed again today. JM just caught him again on the stand. Doc admits she lied to him multiple times and said he didn't change his notes about her story because he didn't think the lies were a big deal. :doh:

Getting ready to play a video for the doctor to show yet another lie. ugh! This doc is bad!

 
I'm afraid Juan is not looking good today because he is "body slamming" the witness. He doesn't let him answer the question before saying "sir, that's not what I'm asking" which could very well turn the jury off.

About those notes psych dude, put those damn things in date order or something. Can't believe so much time is spent digging.

He's getting $250 an hour and Juan just said is this the best you can do? :boxing: Now we are listening to the defense on redirect basically letting psych dude finish answering Juan's questions.......

Hopefully after this it's jury questions and Juan has a witness himself to present..

Eh....Rather than just stating the legal name of the objection, it's either:

1) arguing the factual basis of the objection (in front of the jury, which has been/will be told to avoid speculating about the meaning of objections which the court may or may not sustain, so it sort of defeats that instruction to the jury; arguments about the basis of any but minor objections should be outside the presence of the jury or at sidebar), or

2) coaching the witness as to how to answer or avoid substantively answering the question by explaining the objection, e.g. explaining how the question is "vague and ambiguous" such that it doesn't pin down the witness to a particular answer on a given topic, or consists of an "incomplete hypothetical" which leaves out certain critical assumptions.

Stop watching Law and Order... or, at least stop taking it seriously. "Badgering" is not an objection in Arizona. "Argumentative" is the closest we have. I guess to your credit though I have seen a real, actual, licensed attorney make the "badgering" objection once.

ETA: Also, your explanation wasn't off. I should probably have cut you a lot more slack. One of my pet-peeves is people who think I can object to "badgering" just because the cross-examiner is being confrontational. Generally, the usable objections there are relevance, argumentative, or asked and answered. And you're right that the proper way to object is to stand up and state "objection, [legal rule]" then asked to approach if you want to argue it for the record if you lose the objection.

It's a dig at Willmot. When she was questioning the good doctor on the first day, Juan would object and explain why he was objecting and she got all snippy asking the judge if she could please ask Juan to stop giving "speaking objections" because it could influence the jury or something. And that's all she's been doing now for the past two days.

I can't imagine he doesn't have a psychologist coming to attest to the invalidity of these tests and his ultimate diagnosis.
 
Juan lost me today. Just got too into useless details. He's not getting to the meat. I eventually turned the channel. He should have just got to the points...

1. He had a unethical relationship with the defendant. He sent a book, cards, and tried to assist the defendant.

2. Deal with Jodi's lies during the tests. Jodi lied while taking the tests therefore making the tests invalid.

3. Jodi's lies to the doc. If she lied to the police, doc, everyone...why should we believe anything?

4. Doc only used Jodi to come to his conclusions (which only makes the lies bigger). He didn't talk to family, friends, etc.

That's it. That discredits the guys testimony in my mind. Who cares if the book he uses is 2000 or 2010 or if he uses pen or pencil? I don't.

To me, the most precious resource that you are borrowing form the jury is time. Therefore, the highest respect you can show them is to use your time efficiently to present your case. It doesn't sound like the prosecutor does this. He needs to be more surgical and pare down his examinations rather than simply :deadhorse:
 
Wow... so far this trial has cost Maricopa county tax payers over $800K and counting! Holy.... There's probably at least 2 more weeks to go.

 
How is this not over yet? I haven't been following closely but didn't everyone rest a couple weeks ago? I know there were new questions from the jury but how has that led to a much longer trial.

The defense questions witnesses rather slooooowly. Lots of 'ums and 'now lets sees'. The prosecutions asks questions and it takes defendants about 3 tries before he hears what he wants to hear. Lots of sidebars. They don't work on Fridays. They take long lunches.

I bet the defense now wishes it ended a couple weeks ago before this "expert witness" testimony of "oh I made some mistakes," "I should have dated some of my notes," "I forgot to put down 3 criteria being met for ptsd, I just put down 2" .... :crazy:Next up more psych dude answering jury questions. They didn't take notes during Juan's cross exam according to some audience members but did on the direct/redirect. Probably will be like last time they asked questions: how do you expect us to believe this bs???! :popcorn: They should deduct from his $250/hour salary how much time is wasted on his fumbling through his mess of papers that are not labelled or in any kind of order.If I were a tax payer there, I'd be pissed!

We saw Jodi taking something with water yesterday. Bet it was a xanax! :excited: Oh man, more redirect! Noooooooooooooooo! I thought it was done yesterday and we'd start with jury questions! :cry: Changing the channel until we get to the jury questions, which who knows, it may be tomorrow... :thumbdown:
