The constitutionality of protest permits has already been adjudicated: Cox v. New Hampshire 1941. Good luck overturning it.

"The obvious advantage of requiring application for a permit was noted as giving the public authorities notice in advance so as to afford opportunity for proper policing. And the court further observed that, in fixing time and place, the license served 'to prevent confusion by overlapping parades or processions, to secure convenient use of the streets by other travelers, and to minimize the risk of disorder'."

"If a municipality has authority to control the use of its public streets for parades or processions, as it undoubtedly has, it cannot be denied authority to give consideration, without unfair discrimination, to time, place and manner in relation to the other proper uses of the streets. We find it impossible to say that the limited authority conferred by the licensing provisions of the statute in question as thus construed by the state court contravened any constitutional right."

Oh, I'm aware of that. The SC has chipped away at our freedoms since its inception. Doesn't make it the correct decision. And I'm also aware it won't be overturned. Too many people rely on the state and feel that the police protect them.

Here's the thing--the people cracking down on this protest aren't the wealthy or corporate America. The mayors of Atlanta and Oakland are both Democrats. Bloomberg is Independent (though he is wealthy). The police are unionized 99%ers. The fact that the crackdowns aren't coming from those that the protesters directly oppose, but those that they tend to affiliate with or allege to represent says a lot about the nature of the protests.

I think it's as safe as any other group of people. There are scum out there. When they rape or otherwise hurt someone, they should be caught and punished. Those concerns do not override peoples' rights to assembly and free speech.
Are your concerns really about people's right to free speech and assemble OR the rights for a group to Live in and take over a Park?

I'm pretty sure many groups still apply for and get permits to assemble and speak all the time in NYC.

I can't believe more people don't see the potential here for a catastrophic result given the people from all walks that this attracted.
My concerns are genuine. Not sure why you set up the OR statement. Occupying this "park" is the method these people have chosen to be heard. I'm not doubting that NYC still approves permits and such. The fact that they require permits is a huge problem. Permits are about as clear of a restriction of free speech as I can think of and should be abolished immediately. As should most restrictions placed on protests.

No I don't see much potential for a catastrophic result. If that was the city's fear, they should take 90% of the cops and send them back to their normal duties. Let the remaining 10% enforce any meaningful laws that are broken.

I thought the bolded was an interesting point. I kind of agree with it. Why do you need a permit to assemble on public property?
1) If you're the Westboro Baptist Church so the popo can plan to protect your 1st amendment rights instead of letting someone kill you.2) To be able to accommodate multiple groups requesting the same time/place.

I'm sure there are many other reasons but those are a couple that come to mind quickly.
People should be responsible for their own actions. I have no problem with a group that actively antagonizing people from requesting police presence. They should pay for it, but that's fine. A city should not require people to get a permit to have a demonstration though. If two groups happen to meet in the same place, they need to deal with it. If they start fighting, then police should show up and enforce the law. Just like they would if public fighting broke out anywhere else.

Planning? Administration? Fairness? I would like to protest the NBA lockout this weekend at Zuccotti Park, however with the Occupiers there, my message was not being heard. Now I will have my time to have my voice heard in the location of my choosing.
Go protest it. If they try to forcefully remove you, call the cops.Also, on the location thing, I don't believe people should be able to go to go and occupy most private property. The NY folks were smart/lucky in picking Zuccotti since it's private in about name only and the legal issues around it are grey. If they had picked a public park they would have been beaten and removed long ago. That's a problem IMO.

But Justice Michael Stallman later ruled in favor of New York city officials and Brookfield properties, owners and developers of the privately-owned park in Lower Manhattan.



The order does not prevent protesters from gathering in the park, but says their First Amendment rights not do include remaining there, "along with their tents, structures, generators, and other installations to the exclusion of the owner's reasonable rights and duties to maintain Zuccotti Park."

It just shows the truth. That our country's problems are due to both political parties. Yeah, a lot of people at these occupations still blindly think the Ds care about them or at least that the GOP is far more evil. Maybe this will be a teaching moment for some of them.

When the cops raided Zuccotti Park, lawyers for Occupy Wall Street woke up a judge with a civil liberties background and asked for help.

Manhattan Supreme Court Justice Lucy Billings signed an early-morning order temporarily barring cops from keeping protesters and tents out of Zuccotti Park.

But within hours, she was off the case as court administrators chose a new judge — and excluded Billings’ name from the list of candidates.

Billings’ biography notes that before she became a judge in 1997, she spent three years as a lawyer for the American Civil Liberties Union and also worked work community legal services.

“I have devoted my career to public service, especially the disadvantaged in desperate circumstances,” she wrote in a 2007 pre-election statement.

Lawyers for Occupy Wall Street phoned Billings after cops moved into Zuccotti Park early Tuesday, evicted the protesters and got rid of their tents and other camp equipment.

Asked why they called her first, protest lawyer Daniel Alterman wouldn’t say, remarking that he’s not a “gossip guy.”

I work in downtown NYC in a commercial bank and we have a casual Friday policy in which you can wear blue jeans. We received notice today from Human Resources that Friday's dress policy will be permitted Thursday "to enable employees to blend in with people on the street and avoid being targeted by the protesters."

A protester was arrested in Zuccotti Park Wednesday after he threatened to fire bomb the city — and his rant went viral on YouTube, police said.Nkrumah Tinsley, 29, was busted after cops saw a video of him claiming he would torch the city during Thursday’s mass protest posted online, police said.“On the 17th (of Nov.), we’re going to burn New York City to the f---ing ground,” an angry Tinsley told a crowd of demonstrators in the video posted on Tuesday.“In a few days, you’re going to see what a Molotov coctail can do to Macy’s.”When officers from the NYPD’s intelligence division saw the video, they immediately began working on trying to identify the raging man, police said.“We didn’t want him out there [Thursday\]. We wanted him in our custody,” said Paul Browne, top spokesman for the NYPD. “He was specific as to date, location and method for the fire bombing ...maybe it was just a rant, but we didn’t want to take that chance.”Cops later identified Tinsley at Zuccotti Park Wednesday and collared him about 5 p.m., police said. The NYPD (among others) stopped things from being peaceful quite some time ago.
 
Passed through Occupy Chicago yesterday. It was like a dozen people, half of them looking homeless and the other half just holding up signs like "honk if you hate bankers". I felt bad for them, it was kind of pathetic.

Its because thursday has been called a "global day of action" and his bank doesn't want any of its employees to be one of the action items.

The police should not be pepper spraying innocent people. I'm very confident that the vast majority of police do not do this.

Protesters should not threaten to firebomb Macy's. I'm very confident that the vast majority of protesters do not do this.

We are all victims of a bad habit that humanity has- to take the actions or behavior of a few and apply it to the many. No matter how many lessons we have demonstrating the terrible results of this, we continue to do it over and over and over. I'm no different in this regard than anyone else. I'm convinced this is the root cause of a great many of our problems in this world.
