Just read an email that a Northern Cal newspaper has caught wind of the situation and is already investigating this crime and will publishing an article that is tied in to the popularity of fantasy sports. I guess someone tipped them off and they are using info from this thread to locate the commissioner and co-commissioner and to gather more facts. San Jose Mercury News....anyone ever heard of them? Are they near Oakland?

Agree with this - you guys are on the right track to never give up and I wish you luck in bringing this POS to square up - for damn sure don't believe his promises until he actually delivers.I mentioned earlier another commish (Dan Bauer) who I've been trying to get my 2009 league winnings from - it's interesting he uses the same BS lines of thought - not taking responsibility for his own mishandling of league fees and hoping that you'll eventually give up on trying to collect on your winnings. I just left a message with 3 law firms close to where he lives. It's a group thing, not just me. Let's see where this goes.If they call back I'll need someone from each league to act as a Representative from that league to give me specific info regarding fees paid and money won. Talked to my buddy who worked for the Alameda DA and now works private law in San Francisco. He thinks there's an angle by pursuing limited civil liability, which may not be too complicated, form wise. It's like a step above small claims but a step below having to involve hard-core lawyers. He said he'd help me with the forms on Monday. It should not be too much trouble to get this in a court. Maybe some filing fees. The key is to get all owners together and file as a group so that the claim is sufficient enough dollar-wise to get this in a court of substance. The case can be filed in any court where a claimant lives but to have a chance of a finding, should be filed in the county where he lives (Alameda, it seems but if he moves, no big deal).Note that I am not a party to any of the leagues. Just am interested FBG that hates the thought that anybody thinks he's gonna get over. If Aquil is genuinely interested in paying people back, I'd expect to see cash advances on credit cards and winners paid out. Absent that, I'll do what I can to help out the dudes here.

The San Jose Mercury News is a major daily - it's not some local rag. Circulation a bit over 500k daily, including online subs. It this is true the story could have legs - given the popularity of fantasy football other papers and news outlets could pick up the thread and run with it.

All of this is exactly right. Not only does Aquil go down, but the next guy decides that dealing with work flak or losing his job and being the focus of a major newspaper story just isn't what he's interested in. Really great work everyone.

I just talked to someone in HR. They confirmed that he still works there. I gave them the whole story. They can't confirm whether his wages are being garnished or not, because that's something they handle in payroll, not HR. But they're very interested in this, and she was going to have the head of HR call me back soon.

My guess is he owes someone else a lot more money, and he used all of our money to make a down payment to them. If he's got a job, that's the only explanation that makes sense. Otherwise, he could be paying people back with every paycheck he gets, and he's not doing that.

I only player in a couple leagues; one with friends/family and another with co-workers. I commish one of the leagues and obviously never had this type of problem. I feel bad for those that lost money. I'm sure it ruins what is normally a fun experience.

Over the years, you begin to "know" the personalities on the forum. You establish opinions, positive or negative, about people's football knowledge, overall intelligence, and even morals. I consider some of the people who were ripped off very credible and I trust/value their opinions regarding FF and football in general.

I have to wonder why didn't the light go on when this guy was asking for out-year deposits, etc. In today's computer age, the social engineering dangers are immense - and the need to be able to recognize a scam is more important than ever.

People keep mentioning a 3% fee with League Safe, but I didn't think there were any fees charged for using Charch's service. Are there certain instances ($ threshholds) where there are and others where there aren't fees?

Paypal is 1.5%, IIRC, which while nothing is half.

Paypal is actually 0% if you send the money as a "gift." But my question is that I didn't think LeagueSafe charged a fee, yet 3% has been mentioned in here a couple times. Anyone?

LeagueSafe is 100% free for leagues that pay by e-check. LeagueSafe eats the e-check transaction fees. For leagues that want to use credit card, there is a 3% fee, because cc transaction fees are so expensive we can't afford to cover it.

Winners receive funds on paper check: $0.99

Winners receive funds via e-check: $5.

Edit: Maybe most germane to this discussion, LeagueSafe has mechanisms to stop commissioners from allocating funds (to himself or anyone else) without league approval. PayPal has no such ability.

Not sure how giving him a pass in the one area we can hurt him is NOT a good move, respectfully.Staying away from his job assumes he 1) makes enough to come up with 20K in a reasonable amount of time (2-3 months), 2) He wants to pay us back, 3) He isn't up to his neck in debt/gambling losses with people who actually can get to him first.

Are we going to try to talk ourselves into believing someone who lives in the most expensive city in the country outside of New York and has proven he can't handle his personal expenses has a means to save this money up, even in a year? And to me, a year is wayyyyyy too long. This money should've been disbursed already if he really wanted to make good on it, or had a means to pay.

The money is gone, we need to believe that. What we need to do is make an example out of this so future owners dont get duped, and future criminals take their scams elsewhere.

I'm probably out more than anyone else on this deal since I won two of his leagues, but I'm not sure how just plain harassing him with flaming e-mails and the like gets us anywhere. Put that energy to better use.I don't expect the law will have much in the way of good news for us on this, but I'm going to find out. Assuming that avenue is closed and we aren't eventually repaid I think that phone calls to:a) his bossb) Micrel's HR department (they seem to be really concerned with ethics, and obeying the law if you go the their HR site).c) his father, mother and/or wife are probably about as good as we can do in terms of making sure there are consequences for him. And for godsake don't do anything stupid and get yourselves in trouble too - don't even threaten to do anything illegal.If someone from each league could post the total amounts owed as well as the amounts being held as a deposit for future years we can tally everything in one place so we at least have an accurate total.In Field of Green II there's $1580 owed ($1740 less the $160 he took down) and an additional $1800 in deposits.In Presidential Suite II there's $1740 owed and an additional $1500 in deposits.That's $6620 just in two leagues. Looks like it might be more like $20k total?

If he's like any indian kid I've ever lived with (about 6-7) one phone call to his Dad will solve the problem, or at least get it moving in the right direction.

Yep I am minus 2 leagues as well. Sadly I am in 2 of Aquil's leagues and have 2 strong teams.

sounds like the dude has a gambling problem. from the links posted he seems to have a decent job (ie ability to actually repay 10k in a reasonable time) and has come clean, and quit leagues etc. Why can't these leagues just add a new player taking his team and go fwd. He seems genuinley remorseful, and if true that he is paying out (the 800 referred to) and continues to do so (+ interest and even some self imposed penalty 5-10%? imo) I see no reason you all have to kill the leagues u worked for.I mean we've :e:stabished he's a real person. He has jobs etc. Ultimately I have to think that he would make this right vs the opposite (tryingto hide and run) I mean he's hear taking his lumps and at least saying the right things now. Before ya'll lynch him, give him a shot to make good. TRUST me the process of forcing him/suing him is such more a pain in the ###.

Now this, if true, is an entirely different story (but I doubt it and it sounds like a pathetic lie from a compulsive gambler). However, IF TRUE it's not necessarily his fault, as he had the money in an account to pay out later. It's just that because of other outstanding debts that he owes a judgement on, that someone has seized his funds and they are frozen/being diverted to a different creditor. It's certainly possible, but the likelihood that a 23-24 year old guy could wrack up enough debt to freeze this amount of money AND have someone sue him, win, collecte a judgement, get a fiera facias, a lien and then garnish his wages is very unlikely. any follow up emails? If he is being garnished he'll obviously have paperwork on that. If he's NOT then he has just committed a helluva lotta felonies involving fraud in inducement and theft by conversion/deception etc.

I was 21 when I started running the leagues 3 years ago and went from a little bit of money I had to the temptation of having 15K at my fingertips at the same time I was introduced to poker. This is an amazing post. The self-justification this guy uses really makes me want to throw up. Hey buddy, you didn't make a mistake. You deliberately chose to steal money from other people. Immaturity or "weakness" is not an excuse for stealing thousands of dollars. Gambling isn't either. You ought to be paying the people you stole from back at THEIR terms, not yours (meaning that your income should be garnished, and they should be paid back with interest, however long that takes.) Also, you should serve some time in jail for your crime, and it should be a lifetime stain on your record.

I think whether he eventually pays it off that he stole the money owed in the interim would qualify him as a thief. Truth is an absolute defense to slander/libel.

Why do many of the snakes seem to be gamblers outside of FF? Is it because you can win or lose faster at the casino and you have to wait 17 weeks before you know if you win at FF?

The other thing that seems to "common" in some of these cases, are these "commishes" are damn KIDS (by kids, I mean guys in their early 20's). I've seen several of these "situations" now (on our old Fever site, as well as this one) where people are sending/trusting college age kids with a TON of $$$$. I'm about a "normal" guy as there is out there, and I know when I was in college, I was living on mac & cheese and top ramen..........trying to scrape enough beer money together on weekends. Are these the type of people you'd trust with holding large sums of monies?? Disasters waiting to happen in my book. I also think many of these "kids" fall into the category of what Coin Flip is alluding too............they gamble on sports/poker/ect. Another HUGE red flag (although wagering/gambling is an issue with commishes of ANY age). Not saying everybody that partakes in these activities are "untrustworthy", but it's something to be aware of (at the very least). I personally gamble quite a bit (FFL/pools/sportsbook/poker), but I do not commish leagues either (other than my local league, with buddies of over 30 years). I think people need to be a little more thorough when selecting commishes to "trust" with their hard earned money. Even then, (like in cases like MCM..........that Coin Flip and I both got burned) can seem like "perfect" situations, and still blow up in your face. In MCM's case, he's a known gambler (casinos/poker rooms/ect)...........so he somewhat fit the "profile" of a potential problem waiting to happen.

I really could care less about the money...It's just sad that people do that, there's a lot of risk of ripping people off. Look at Bernie Madoff's son, who "committed suicide" in his apartment (we all know he was murdered). There's people who would get very angry about 15K, who clearly are. I have an honest job, and I don't play fantasy for the money, I play for fun. The only reason I don't stick with free leagues is because they suck and nobody tries. I couldn't imagine wanting to risk my life or health or job for 15K, regardless of the situation I was in.This Aquil guy is an idiot, and probably has hit rock bottom. You know he's reading our internal league emails, and you know he's following this board. The funny thing is that this guy probably makes 80-100K a year if he's in Northern Cali as a computer nerd. He's going to wind up losing his job over this, because I'm sure if it hasn't been done already he's getting calls at his work. Or someone in his company will find out from a simple facebook or google search, as I'm sure his actions are high on search engines now. Companies arent going to risk sensitive informations systems with a guy like this. He's going to be blackballed in his industry.I just find it amusing that he always presented himself as a complete #ss on his boards and was the most unprofessional commish I ever met. I was going to quit the league anyway so I'm not worried about that. I just feel that he completely messed up his life by doing this. There's six pages of comments on this board in about 12 hours and our email thread from just my league is just as long. So Aquil, since we all know you're reading this, I just have to ask, is 15K worth it? You were probably saving that much per year based on your job title, expected salary and cost of living expenses. Is one year of savings worth potentially ruining your life?

I think Madoff offed himself. Imagine if EVERYONE you knew was someone your Dad bankrupted/stole their life savings from.

sounds more like a story for Gamblers annonymous. I doubt he intended all of this, or he would have used aliases etc. Thsi is a case of a young dumb kid getting in over his head. Hope it has a happy ending...

Before it's too late, you guys need to do the following:

Contact MFL and have them create a mirror page of the league. This way, if Aquil starts to delete everything, you still have a record of it. They did this for me in a similar situation without questions asked, no charge. It's essentially a duplicate of the league with all the current info and settings and YOU would have access to it. You could also make it public if you desire.

Doesn't a fee get hit for CC on Paypal even if it's a gift? I've heard that as of late, but normally don't use my CC on Paypal.

Not sure about gift, but If the person sending money chooses the personal tab, then clicks payment owed, the person receiving the money does not get charged a fee. I've been told that gift works the same as payment owed. However, if the person sending money just accepts the default given, then yes, the person receiving the money is charged the fee.

This. However when choosing this option one loses the ability to later protest the charges (so don't use this option for ebay to save 2.9% etc).

I just talked to someone in HR. They confirmed that he still works there. I gave them the whole story. They can't confirm whether his wages are being garnished or not, because that's something they handle in payroll, not HR. But they're very interested in this, and she was going to have the head of HR call me back soon.

Ditto..he's trying to get rid of all the evidence. Since we're not gonna see our money , might as well get him fired and humiliate him as much as possible. As far as I'm concerned Allan Fernando knew about this dude, recruited for him and is in on it as well

I said this several pages ago, Allan is JUST as guilty, if he really is a different person. And I still think they are one and the same. I've got proof that both emails were used in of my leagues by the same team/owner. And there were no "co-owners" in this league.
