ACLU to fight religious harrassment in rural Louisiana school (1 Viewer)

Unfortunately, Carolina Hustler is representative of far too many conservatives these days. A lawyer tells them that having a religious billboard on school grounds defies the Constitution, and they challenge the lawyer. A scientist tells them that global warming is indeed happening, and the scientist has to be full of ####. A statistician attempts to prove that Obama has a 90% chance of winning the election against Romney, and they attack the statistician.

They live in their own little world, in which facts don't really have a place unless they already fit with what they want to believe.

I could say the same thing about Tim after watching MSNBC. He takes it all in hook, line and sinker every time.

Good to see the law enforced; and they settled pretty quickly too which is nice. Glad the family got some justice. Ridiculous that it was this prevalent.

Injunctive relief, $40,000.00 in fees and costs, $4,000 for the cost of going to another school during all of this, busing for the future so the kid can keep going to the new school, and $1.00 in nominal damages each the plaintiffs.

Cost to settle:

$44,005.00, plus stopping what they're doing and retraining their staff. Seems fair.

hey brohan they probably paid there legal guys a bunch of money and i know you and some other guys are lawyers so how much do you think the shcools attorneys would get on something like this one thanks brohans take that to the bank

When civil right violations produce largely inchoate damages, there isn't a strong disincentive. In many cases, there won't even be $40,000 in damages. Just the attorneys' fees. It seems pretty low risk to do what you want and just agree to a consent decree when someone is serious enough to file suit.

Whose lawyers? The agreement gave $40,000 in legal fees and costs to the plaintiffs. I don't know what the defense attorneys made.

 
i mean the schools attorneys i am wondering how much you law guys think that they would have gotten paid to work on this mess because it seems to me that the taxpayers down there who are going to foot the bill for the laywers should be pretty damned mad at the school and its leaders for the payout plus whatever they paid attorneys and i am just wondering what the total number is that will hit the tax payers i just think it is crazy that the people that cost the taxpayers all that cashola will get to keep there jobs that is all i am saying brohan take that to the bank

I doubt they billed more than the plaintiff's attorneys. The plaintiff had to bill for producing a complaint and negotiating a consent decree. The defense only had to do the latter. Maybe they filed an answer, but that's a lot less work than drafting a complaint.

Doesn't seem that they let it get that far if the plaintiff's fees were 40K. Of course, for all I know the lodestar rate in rural Louisiana is $13/hr.

If the school board's attorneys were on staff then it likely cost nothing extra and was just part of what they did for multiple days, instead of doing something else.

In my experience, a school board's attorneys usually handle state court pleadings in Louisiana. When it's in Federal Court, they hire outside counsel.
