Today it comes out that law enforcement sent the video to some executive in the NFL.
From the article linked above:

The law enforcement official, speaking to the AP on condition of anonymity because of the ongoing investigation, says he had no further communication with any NFL employee and can't confirm anyone watched the video. The person said he was unauthorized to release the video but shared it unsolicited, because he wanted the NFL to have it before deciding on Rice's punishment.

I keep asking you why an employee would allow this, especially if it is damaging to him?
Because failure to comply is a tacit admission of guilt. The NFL does not have to abide by the 5th Amendment ... they can sanction an employee for failure to aid a "self-incriminating" investigation.
Exactly. Roger Goodell held all of the cards in that negotiation. It would make no sense for Rice to refuse to cooperate with the League. In fact, I understand Rice was cooperative.

So is the NFL spin now that they had it but chose not to view it? Probably bit that isn't really a logic I and I'm sure many others will accept or follow.
It'll probably be something like "without our knowledge or consent a person in our office obtained the video in an unauthorized way", accompanied by a public firing and a very fat hush hush settlement package for the exec who falls on his sword, probably for doing exactly what he was told to do.

So yesterday the attorney general says it would have been illegal for law enforcement to provide the video to the NFL.

These would be good reasons for the NFL to have not viewed it or used it against Ray.

Viewing it and using it against Rice are two completely different things. In today's day and age the NFL had to know this video would be seen by the general public, especially if it was sent to them unsolicited so for them not to view it before disciplining Rice is dumb on their part. Goodell could have easily giving Rice a harsher penalty without acknowledging having seen the video.

Well now, that lends more credence to King and Mortensen's sources saying people have seen it. But also shows King to be a complete NFL lackey by saying he was wrong.

Couldn't disagree more.

Terrible reason to not have watched it, terrible reason not used it see the level of violence and anticipate the reaction to a 2 game suspension, and terrible reason to (possibly) lie about having it.

How quickly is this likely to change? 82.5% already believed the NFL was lying . . .

If Goodell is ousted and King fired from SI this will be the greatest start of any football season ever.

Yes because that would have been better? We are not supposed to have this video, but it'll get leaked anyway so we might as well watch it? And after watching it we will punish Rice for what we saw, but we cannot disclose the reason nor that we saw it? Tough situation.

In any case, if Goodell loses his job over this it will be strange considering Rice ultimately got his punishment.

He'll just retract his retract and get suspended for two weeks.

From a legal stand point, if you are given evidence illegally, it is a good idea to admit to it and go ahead use it? That won't work in a court of law and it would certainly be grounds for Ray to get anything overturned. There is plausible deniability on Goodell's part if it was withheld from him (or he claims it was).

I mean how naive did you have to be to believe they didn't see it? The NFL head of security is the former Chief of the PA State Troopers. All it was would take is a phone call to ACPD and the video would be there's in hours.

In all seriousness, the NFLPA needs to get involved in this. Not to protect Rice, mind you, but to protect players in the future. There has to be a process that is followed. The league punished him. Then punished him again, arguably because they now have "new evidence".

As I've noted above, the "new evidence" is certainly not material, even if the video is itself something never seen by the league. That, in and of itself, is an issue I would expect my union to raise.

But let's assume the video is "new evidence" that would matter. All of a sudden the question of the league/Ravens actions and whether they had the video before really matters a great deal. Open the phone book and pick an attorney out at random. He could get Ray reinstated if the league had the video before the 2 game suspension.

What is the league's motivation to lie if they did have the video? To try to keep from getting their asses handed to them in the appeal of the indefinite ban, that's why. Goodell is just making this #### up as he goes now. That's a big no-no in employment practices, especially collectively bargained employment relationships.

Mark my words, someone with a big important sounding title is going to be terminated by the league before it's over. If the union takes up this fight (and they should), they will eviscerate the league.

The NFL isn't a law firm or a government agency.

A lawyer can correct me if I'm wrong, but I don't believe they would have broken any law by seeing the tape that was given to them without solicitation.

Edit to add: Rice being released and suspended are punishments from a private business. These are penalties from a court of law.

Spot on. The NFL investigates every other incident thoroughly but all of a sudden they dropped the ball. Yeah right. I don't believe the NFL office or the Ravens.

Not going to argue on the video any more, you've won me over that they probably lied. But if/when McDonald and Hardy are convicted or plead guilty, do you think the NFL does their own thorough investigation after the legal investigation or do you think they punish them based on the facts and convictions?

This new AP report is a bombshell that will not only cost Goodell his job, but will turn this from what was already a major scandal into the biggest scandal of all time.

It's one thing to be incompetent. It's a whole 'nother thing to be corrupt. If Goodell lied, that turns this from an issue of mishandling of a major league issue into a crisis of confidence for the NFL. If Goodell lied about this, what else has he lied about? There have been some serious issues under his tenure - concussions and Spygate coming to mind right away. The public may not have liked the way he handled these things, but at least they assumed he was being honest and forthright. If he overtly lied about the NFL not having viewed the tape - on TV on the CBS evening news, that is about as bad as it gets and calls into question every major decision his administration has made over the last 10 years. What else has he lied about? What other evidence has he suppressed? Why is he doing it???? The one thing you don't want in any organization is a crisis of confidence.

At this point I wouldnt be surprised if there's a Congressional investigation launched.

Not found guilty and no tape. No suspension.

Found guilty no tape, 6 games.

Not found guilty and a tape. Suspended indefinitely.

Watch and learn, son. Goodell is gone, it's just a question of when and how bloody the fight will be.

You have a bigger scandal in the NFL you'd like to share with us? I'm watching CNN right now and it's the lead story. And the President is giving a speech in a few minutes. You kids can keep burying your head in the sand but this scandal is now off the charts.

This is going to be another interesting angle to watch as this scandal unfolds - the news media that is in bed with the NFL. Some of these guys have lost credibility as well, particularly Peter King. It's pretty sad actually. You think it's any accident that TMZ and the AP are doing all the investigative journalism on this issue? Colin Cowherd did a great segment on this in his radio show today. He basically said that you can't trust any of the networks, including his own employer ESPN, to do heavy hitting journalism on an issue like this that could harm the NFL.

The whole thing just sucks.

Actually, a Congressional investigation is already underway... http://www.usatoday.com/story/sports/nfl/2014/09/10/roger-goodell-congress-letter-john-conyers-ray-rice/15394317/

And that's before the AP report...
That's not a Congressional investigation. The NFL has yet to even be accused of something illegal.
Oh it's the start of a Congressional investigation, no doubt about that. Congress can and does investigate anything they want, and there doesn't have to be an allegation of criminal activity for them to do it.

No doubt? There is nothing in that letter about a Congressional investigation.

For real? These guys aren't some CIA/NSA operation with much knowledge beyond ours.

I remember the writer who spent the pre-draft process with the meetings from the Browns ownership and how he mentioned they spent 90% of their time watching ESPN for updates. These guys aren't some know-alls keeping stuff under wraps.

It's ridiculous to insinuate they saw the full video and only gave him two games.

Dumbest thread I've seen on here in months... and that's saying a lot.
Some excellent analysis here. Is this a Phenix alias?

Imagine the out cry if Goodell had handed down a year suspension based on seeing a video that wasn't being released to the public.
Other than Spygate, the Denver videotaping scandal, and Bountygate, Roger Goodell has no personal history of handing down arbitrary and capricious punishments based in whole or in part on video evidence that he later withheld from the public or even destroyed entirely.
You left out the bs cap penalties he handed out to the Redskins and Cowboys.

I am just happy that the Ravens and the NFL felt comfortable with Janay RIce apologizing to us for her role in this fiasco.

"I did not have sexual relations with that woman"

This is very much like the Bill Clinton scandal but Roger isn't nearly as charming as Bill was, there seems to be a lot of people that have been waiting for this moment.

The 30 other owners asked for that because Jerry and Daniel broke their gentleman's agreement during the uncap year; and not like those 2 are the most loved out of the group.

And those cap penalties are going to end up biting the NFL in a big way. There was no CBA that season, which means it's illegal to limit salaries. Ask Apple, Google, et al what happens when you collude to suppress salaries. What Dallas and Washington did was good business. I can't believe teams didn't sign players to massive front-loaded contracts in that window. Forget a signing bonus, load-up on 1st year salaries instead. THAT would have been good business. But (almost) no one did it. I wonder why?

Like I said before -- the NFL is the worst-run league right now. Just because they have the product we want doesn't mean they're run well.

Can Roger indefinitely suspend himself? He somehow managed to make himself and the league look worse than a wife beater. He should do the honorable thing and hand in his resignation.
