If it's within the first trimester, is that not ample time to get a divorce before she becomes pregnant again? What is the average length of time to get a divorce? He claims she became pregnant again immediately after having the child but I find that hard to believe. For most women, there would be a bit of a lag from the time a child is born to the time they conceive again.
Probably 10-12 weeks, but you can't make her do that - it's not free of risk to the fetus. Realistically, it will be once the baby is born;

Our divorce is not no fault. In NYS you cant have a no fault divorce under 6 months so she claimed I hit her. Had to wait 9 months for her to have the first child, which CPS took because she broke 9 of his ribs. Then 6 months for the court ordered DNA results.
As soon as it was confirmed I was not the boys father the papers were amended that she was at fault for infidelity. As soon as that was done she got pregnant again and the papers were changed again until she had the second baby, a girl, which is not mine because im 2500 miles away but still married to her and legally assumed to be the father.
She tested positive for drugs 6 months in to the second pregnancy, did not cooperate with the treatment program she was ordered to, and her and the infant tested positive for drugs when she gave birth in may. CPS took both the children again and now I have to prove the second child isnt mine so the papers can be amended again
