He is a great writer, no doubt. But his crusade against Goldman Sachs and now Bank of America have gone overboard from hard hitting, investitagive journalism to outright axe grinding. I couldn't even make it through his last tirade against BofA. A barb here and a jab there is one thing, but littering your entire article with caustic insults is pretty childish.

That's his thing.

And I like it, but in moderation, man. I mean, I like a finger in my butt once in a blue moon, but don't ram a baseball bat up there like a Sybian machine.

Let's say I own the domain photoshoptutoring.com and I am selling photoshop resources on the site. Can adobe come slam the door on me? What if that's my domain but my actual company name is "photo editing solutions" and doesn't include the photoshop name?

Short answer (for my clients, anyway) is that even arguably infringing is going to be the equivalent of slamming the door shut. If a company like adobe can go after you for something like that, even if it's not a slam dunk, they will. To protect the mark And having adobe sue you is a crushing blow to a company just getting started.

I usually pay $15 for a haircut at Supercuts which I can walk to. There are a couple of chicks there that do a good job. There's also a barber in Oildale that I go to sometimes if I can squeeze it in on the way home. He charges $10. Also within walking distance is a Great Clips which makes Supercuts look like some Beverly Hills salon. I've gone there a couple of times and the cut wasn't bad. But the place is cramped and usually full of bratty kids.

There's an old-assed barber shop on the back side of this decrepit movie theater in Pasadena that I go to. You feel like you travel back in time.

The guy who owns the place is a #### who will charge you $35 for a cut if they use scissors on the sides and back instead of the clippers instead of the normal $17, but he's not there on Sundays and the guy who's there just charges me the normal amount for the scissor cut. I tip him well.

I'll also go to Supercuts but not the one on Washington Blvd. - that's all Armenian chicks who don't give a ####, so I'll inevitably get a bad haircut. If I go a little farther away to the one in East Pasadena there are white chicks and Latinas who give a damn and I actually look good if I steer them in the right direction. The best one is even farther away in Arcadia where all the Korean and Chinese ladies work. They'd sooner sacrifice their first born than leave you with a bad haircut, Supercuts rates or not.

Once they see the cuff links and the tommy bahamas they know to put their game face on.

so everything is fine...she just got home. from the outside, just looks like cosmetic damage. But this struck me as weird:

The other driver told the cop that she had a red light and made the right turn on red and didn't see my wife coming....clearly, it was her fault...but the cop didn't write her a ticket (or my wife). She said that the cop gave each of them a piece of paper with the other's insurance information on it. On the piece of paper, it says that police reports may be obtained in person, etc etc.

So I assume that each insurance company will take it upon themselves to obtain the police report...and I've got to hope that the cop wrote it up somewhere in the report...otherwise, the two insurance companies will try to figure it out?

I've never been in an accident before where there wasn't a ticket involved and I'm fearing the worst here. Any insight? Shuke, did you get a ticket when you tried to mow down that school bus?

They don't have to give a ticket. Some dumb#### rearended the #### out of me and another car a few months ago and he didn't get a ticket.

The thinking from the cop's perspective is that the less they have to do in follow up over one incident, the better. That means if they can avoid citing a person and thereby being an attractive witness in any civil lawsuit that's filed, so much the better.

Also, they almost never assign "fault". Instead they'll either cite one or more people for some traffic violation or not and leave it for others to determine overall "fault".

As a practical matter this means that if nobody ended up in the hospital or there isn't a very serious accident otherwise, they're likely not going to issue a citation to anyone.

Pick a trade name that doesn't include their name, but you can certainly reference the product that you're offering tutoring for in the text on your page. Just make sure to indicate that you're not formally affiliated with or endorsed by the product or its parent company.

What if the product name is in the website but isn't my conpany name? What if the domain name simply points to a company site with a different name?

That's what I'm saying. I believe you can mention the product name in the site as part of your description of your services, but you can't use the product name as (part of) your own name.

Beyond that I don't know as I'm not a patent/trademark attorney.
