I hope he wins the entire university in this case. Jane Doe should be facing criminal harassment charges. I wonder if she boiled his pet rabbit during this process.

 
strange dichotomy these days between promiscuous nature of college students and the draconian nature of how colleges handle sexual misconduct cases against young men.

 
This is a gross misuse of power by the university. I hope they end up paying a huge settlement. Also, I hope the girl is sued by the John doe for defamation, win or lose.

It really is a sad state of affairs. The guy has proof in the form of a witness the next morning, text messages and even a second sexy time encounter and still gets expelled? Sheesh.

 
You guys are being all critical of university administrators, but if people with Ph.D.s in history, modern British literature, and chemistry aren't qualified to investigate and prosecute cases of sexual violence, who is? It's not like there's anybody out there with any special professional training in this sort of thing.

 
The female student who lodged the charge against John Doe has claimed she was the victim of nonconsensual intercourse, or “gray rape,” what Cosmopolitan defines as “sex that falls somewhere between consent and denial and is even more confusing than date rape because often both parties are unsure of who wanted what.”

The plaintiff filed his lawsuit last December, stating the university subjected him to disciplinary actions “in an arbitrary and capricious way, and in discrimination against him on the basis of his male sex.” He accuses the private, liberal arts university in Lexington, Va., of gender bias in violation of Title IX.

The student claimed he was denied legal counsel and representation during the course of the school’s inquiry, that his case was mismanaged and rushed before the Student Faculty Hearing Board, and that Jane Doe’s decision to claim rape was influenced by controversial statements made by the university’s Title IX coordinator Lauren Kozak.
How crazy is it that they both have the same last name? I wonder if they are related and in reality this is a case of incest?

 
There's been a few recent cases in the UCs as well. Thankfully, the justice system is starting to push back on this crap. The UCs have a "yes" means "yes" policy where the male student has to prove consent was given. It's an impossible standard. These guys are getting totally railroaded.

We need to go on strike. start withholding our favors until woman cave and agree to swing the pendulum back to a more reasonable equilibrium. That will teach them. Of course to win the strike we will have to arrange an "appliance" and a produce shortage to hit at the same time.

 
In addition to the very real possibility of conviction/expulsion/etc for the young men accused in these 'cases', there doesn't seem to be much blow back from being proved absolutely false as the accuser. I'm glad to see some counter legal action in this situation.

Accused of rape(falsely):

Found guilty - Male serves time, expelled, sex offenders list, life ruined. Female - Got revenge, victim status

Found innocent and proved to be completely concocted - Male reputation ruined, lengthy battle to prove innocence (as assumed guilty). Female - Be on your way.

With crime this heinous, there should be very serious ramifications if allegations are proved fabricated. Currently the situation is a bit of, heads I win, tails you lose.

It's not like there's anybody out there with any special professional training in this sort of thing.
The article references a "Student-Faculty Hearing Board" making this decision, and I just kind of cringe reading that. Its probably an appointed panel made up of some students and some faculty, and you have to wonder what kind of teachers and students sign up for that. The discussion in here will likely conflate this kangaroo process with actual criminal or civil proceedings, when this student-faculty process likely has very little in common with any sort of fair adjudication process.

Keep in the mind that the article is based on a motion to dismiss, so not getting both sides of the facts, as you would if court was considering the merits.
