I would agree except that the complaint states his request was 'the younger the better'. Murder is a higher crime than any sexual assualt even on a minor. Should he get the death penalty? No, though that would feel right but for the legal system that would be out of place. I certainly would not shed a tear if he got shanked in prison and bled out on the shower floor after being abused- I have no sympathy for someone like him. NONE. And the 'younger the better' makes the actual age of the victims a matter of opportunity in my mind so I am not too worried about them being 16 or 17. He is still a sick pig.
7. A complaint is simply a list of allegations amounting to evidence which the state believes provides probable cause for the defendant to be charged with a crime. What is stated in the complaint are supposed facts that have not been subject to any sort of confrontation or refutation, whether by cross-examination or otherwise. In other words, when you see a complaint the alleged facts should be taken with a grain of salt. Here, we have no idea as to the credibility of the speaker providing the police with this hearsay statement and are not privy to the context of which the statement may have been made. Instead, a more reliable source of facts on this case would have been the "factual basis" provided by either the State or the defendant (which the other side confirmed) when the plea was taken. I have not seen any media reports providing a verbatim account of what the factual basis was for Jared's guilty plea. To your point, I think it's safe to call Jared a sick pig, but it's somewhat of a stretch to say he'd sleep with a pre-pubescent child or that he should be imprisoned for decades.

But it's not really that person's fault if nature/God/the universe wired them that way, is it? If it was up to them, they would never chose to have that type of attraction.

If they understand that society does not approve of their attraction, and they successfully deny their own urges, don't they get a little credit for not acting on them?
I think someone with these urges needs to seek professional help. As for not acting on the urges.... credit for what? Not violating child or contributing to those acts through consumtion of child porn? Do you give credit to the average guy who sees a woman and has all sorts of thoughts about her but does not rape her? No. There is no extra credit. It is what is expected.
How/where do we draw the line on where professional help is required? If it's a sexual preference due to "bad wiring" as some term it, or a bad childhood as Coeur de Lion stated, these people have been dealt a bad hand. If they never act on it and are otherwise unremarkable people, do they really need help?

Part of the case involves images Fogle received from Russell Taylor, the head of Fogle's foundation. According to the complaint, Taylor sent Fogle photos and videos from hidden cameras in Taylor's house, featuring children as young as approximately 6.

Uh, I'm pretty sure that is more of the problem.

Where are people getting this from?

Here is what is alleged in the charging document.

1. Taylor provided Fogle with child pornography that Taylor produced through hidden cameras in his house (featuring Minor Victims 1-12). Those victims were as young as 13-14.

2. Taylor provided Fogle with child pornography that Taylor had otherwise procured over the internet. That pornography featured children as young as 6 in some cases.

3. Fogle showed at least one other person child pornography he received from Taylor.

4. Fogle traveled to have sex with minors. The only two times mentioned with specificity are with a 17 year old.

5. Fogle conspired with escorts to procure prostitutes that were younger than 17. 16 was acceptable but "the younger the better." Presumably there is some limitation built into the age of girls that are involved in sex trafficking, so while it is safe to assume that he may have meant 13 or 14, it seems unlikely that he meant 6.

Yeah if you are looking for "minors" and you get a 17-year-old, where do you draw the line? At 14? 12?

There is a reason we have these laws, we simply can't have adult men in their 40s taking advantage of young people who still don't have the physical power to defend themselves, the maturity to discern adult situations, or the experience to really understand how bad people can be. Then there is the whole human trafficking culture which it seems Fogle was trying to manipulate to his advantage. He's not a good person. This isn't like banging some chick you met at the biker rally who said she's 20 but really is only 17. This is a conscious and unscrupulous decision to have sex with minors.

 
It'd almost be worth it to be thrown in prison just to hear them serenade him with "Five . . . Five Dollar . . . Five Dollar Footlong" his first night. You know it's going to happen.

Jared's attorney will argue for a "downward departure" and argue for factors that may convince the judge to drop below the five years. In my experience, it's incredibly rare for a judge to deviate below the bottom end. In my opinion, Jared will receive more than five years.

4. There is a Supreme Court case (U.S. v. Booker) which actually says that the guidelines are not mandatory so really Jared could get about anything. Nonetheless, it's likely the judge will find Jared should get somewhere between the 5-12.5 (my bet is around ten years).

I just heard something interesting a few weeks ago. The production of the Bronco stopped exclusively because of the negative relation to the OJ Simpson chase/story.

The Bronco is no more because of OJ. I had never realized that.

What are the chances someone that twisted never acts on it? I would say extremely negligable. If you have that wrong with you and you don't have enough awareness to know you need to seek help then I would say the chances of you never acting on it (and just viewing child porn is an act) are pretty much 0.

Yup- including marrying 10 year old girls off to 50 year old men. You think that is ok because you can find some sick bastards who think that is a good idea?

There is a lot of slavery around the world. Perfectly acceptable to people in parts of the world. Good with that?

Some parts of the world are inclined to favor a particular gender and if they find out they are pregnant with the 'wrong' gender, they abort the baby. Totally fine.

We are not talking about an 18 year old boy dating a 16 year old girl and then they have sex. We are talking about a grown man who has consumed child pornography and was involved in production of child porn with his non-profit org buddy that then crossed state lines to have sex with a young prostitute and asked that young prostitute to find younger women for him. "The younger the better".
