Jodi Arias case (1 Viewer)

Is there a minimum time she needs to serve once a sentence is handed down before an appellate court can review her case or is it right away and she could be in court again pretty quick here and probably receive a lighter sentence since the defense seems to have prepped for how she didn't receive the best representation with today's antics?
No minimum time. But the time tables for appeals are lengthy. What will happen is that an appeal will automatically be filed and the case assigned to a new attorney. Assuming death penalty deadlines are the same as normal cases, her new attorneys will have 90 days to file a memorandum (written arguments). The State then has 30 or 60 days (can't remember off the top of my head) to respond. The Court sets a date for oral argument, takes to to make a decision, etc. Jodi will be sitting awhile before there's a decision on her appeal by the appellate court.

In AZ, some issues are separated in a Rule 32 claim (like whether her lawyers were ineffective). That can be filed within 90 days after the appeal and is heard by her trial court. Different procedures and burdens and stuff, but to a non-lawyer it'll sound like Jodi got two appeals.

 
If anyone wants to watch what went down today:

The strategical decision on who to call as witnesses (except for the Defendant) is a call to be made by the lawyers. Jodi can't stop her lawyers from calling a particular witness. As has been discussed above though, there seem to be some serious pitfalls to calling each particular witness so it could be that her lawyers are explaining the pros and cons of each witness to Jodi and getting her input.

 
I love the Jodi is innocent site. If it isn't shtick, it's some of the most obtuse nonsense I've ever read. I can't help but picture LarryBoy's twin, in fishnet fingerless gloves, updating that site. Even more unreal is the site raising money for 'other' survivors of domestic violence.I can't decide if its funnier or sadder or both if its not shtick.
I can only spend about 5 minutes there and I start to feel icky. The way they trash Travis's relatives makes my stomach turn. They call his sister dog face. They call them pedo huggers. Really really sick stuff. Like even if you believe the crap Jodi says, what in the world did his siblings do except lose their brother? Sick.
To be fair, there's a decent percentage of society who would call clamoring for the death penalty of a human being to be pretty sick, too.

 
Darryl Brewer (the ex) did an interview with azcentral last night. I read some theories that it was all planned by the defense team. They didn't call anyone to the stand, but Darryl did that interview hoping some of the jurors would see it. That way he could say what he did without being cross-examined by Juan Martinez. I think this may be the case. I don't think they wanted anyone cross-examined. It still seems pretty dumb to me. If Jodi's mother got up there, I think it would have an impact. I would think it would be pretty hard to sentence someone to death after hearing their mother ask you not to.

Are you saying I was clamoring for the death penalty? I have been against the DP my entire life. In this case, for some reason, I wouldn't lose any sleep over it (probably because I've gotten so involved in it and I am so positive she is guilty and some of the other circumstances are just horrible for the family of the victim). But I agree that people with their pitchforks cheering for her to be killed is beyond weird and pretty medieval. My big thing is that this woman better never walk the streets a free woman again. I also hope that the family wins a civil case so she can never make any money off of her "celebrity".

Speaking as a juror who sat through the Death Penalty phase of the trial. I was more swayed by statements made from friends/family of the victims than from friends/family of the defendants. The victims family/friends statements had real emotion and pain behind them. The defendants friends/family didn't really carry the same emotion.

 
While I don't normally frequent the hln shows, I was bored tonight and swung over. A potential strategy was being discussed that made sense to me. JA has told so many lies, that any person that testifies for her can be potentially allow Martinez to rebut the testimony. For instance, it could allow him to introduce the interview she gave after the guilty verdict. But if JA is the only one who speaks, it's an allocution rather than testifying and therefore no rebuttal can be given. And therefore he cannot introduce that video. Martinez can also not question her because, again, it's an allocution.
That's why I watch hln because they do talk strategy. It's not all crap there. I like hln after dark where they have a mock jury listen to both sides and vote. NG & JVM give me a headache but I do like the lawyers and judges on the show giving their take and strategy.

I really don't think today was super offensive. The whole family thing did hit me. I guess I've been talking about this wondering why her family didn't testify. Her family really is going to be hurt a lot more than they already have been if she is executed. And they haven't done anything wrong. I do hate the fact that she will sit in prison for the rest of her life having a little harem and being the queen teaching people how to read and such. Who knows though. I have read that maximum security prisons are pretty brutal with gangs and things of that nature.

I guess I've known about the shirts for a while so the shock value wasn't there for me. She's been selling them to her followers for a while and her sister was wearing one in the courtroom yesterday.

I think you can play that card if she only killed him once. But to ask for the jury to spare her, but then to look at how she killed him is a little disturbing. If there was a single gun shot or one knife wound maybe you can pull that off. Not after you butcher the guy and then ask for some mercy. I'm surprised a juror didn't start laughing.

She likely won't be exposed to any gangs where she'll be. However, she will only get like 6 hrs out of her tiny cell. And I've been in the male equivalent of the cell she'll be put in and it's about 6 by 10 with some minor indirect sunlight.

My take on Jodi is that she's a narcissist. I cannot imagine the anguish a narcissist would face sitting in a solitary tiny cell for all but 6 hours a week.

I can't speak for CurlyNight, but I've been more invested in this one because I saw the hour long show that was done on her when she was claiming ninjas had done it. And then the trial began and it's been just one drama after the next. I really don't get into that many cases, but this one has just pulled me in.
