No minimum time. But the time tables for appeals are lengthy. What will happen is that an appeal will automatically be filed and the case assigned to a new attorney. Assuming death penalty deadlines are the same as normal cases, her new attorneys will have 90 days to file a memorandum (written arguments). The State then has 30 or 60 days (can't remember off the top of my head) to respond. The Court sets a date for oral argument, takes to to make a decision, etc. Jodi will be sitting awhile before there's a decision on her appeal by the appellate court.Is there a minimum time she needs to serve once a sentence is handed down before an appellate court can review her case or is it right away and she could be in court again pretty quick here and probably receive a lighter sentence since the defense seems to have prepped for how she didn't receive the best representation with today's antics?
In AZ, some issues are separated in a Rule 32 claim (like whether her lawyers were ineffective). That can be filed within 90 days after the appeal and is heard by her trial court. Different procedures and burdens and stuff, but to a non-lawyer it'll sound like Jodi got two appeals.
