Pool drain hose from neighbor (1 Viewer)

Not a lawyer, but pretty sure it doesn't matter if the hose is on your property or not. He shouldn't be draining pool water onto your property. He can drain it on his.

The chemicals can kill your grass, bushes, trees, etc. And the excess water can cause unwanted erosion and even issues with your foundation depending on proximity to your house.

A simple call to your local city hall can help clear that up and find out what he can and can't do, I would think.

I read this thread to DW.  He noted that the hose is not a one-way flow item.  He noted that by raising the end on your property you could get flow back to your neighbor's pool, presuming a pump on the neighbor's end is not actively operating.  You can deliver any liquid you desire right back into your neighbor's pool.

understood, regarding prop line dispute. better to have the info in hand before that conversation so he doesn't turn it around into "it's still on my property".

regarding the other... look- these are the rules. I didn't make them. but as an FFA, you have to be awesome, have a nice season, and abide by these things or the whole thing falls apart.

 
Yeah, he’s not going to be reasonable, but the mature thing to do is ask him to remove it.

I’d probably cut it, and tie the excess around a mannequin’s neck placed at the property boundary.

 
Having a property line dispute with my neighbor. Walked to the corner hoping to easily find a survey marker (couldn't find it, so I guess I need to get a survey). Near where I looked for the marker I saw a hose coming under the fence into my yard. Not sure what action to take next. Any ideas?

Who owns that wooded lot behind you?  Can he discharge there?  I can not believe you are allowed to discharge this at all.

 
Hook it up to a pump and drain his pool.

If the valve is turned off at the pool, hook up the hose to the exhaust of a shop vac or leaf blower.  It will likely rupture the hose

Even if that's true the water run off would eventually get to an area that is not his property (assuming the property line isn't completely off with respect to the fence).

I would also think that draining pool water (assuming it has some sort of chemicals in it) into the ground water would be an environmentally big no-no regardless of who owns the property.

There is common land between my back yard and the other back yards. It is unmanaged and provides additional sound and sight privacy when I sit out on the deck, especially in the summer.

So why the hell isn't he dumping on that?  Or is it possible he thinks he is, and it's as simple as pointing it in the right direction?

 
Pretty sure that the portion of hose on your property now has squatters rights and is yours.  I would just start pulling on "my property" until something happens.  Or, if it is attached to a pump, put a reducer on the end and point it back towards his pool.  See if you can dial in the pressure/angle and get the water to land back in his pool and make a continuous loop. 

 
You all do understand he's dealing with a filter cleanout hose?  It's unlikely that hose carries anything but bugs but like 4-5 times a year. 

 
Not my property, but if its just a filter clean out hose that has minimal water discharge and it was being done onto a portion of my property that was unused and out of sight, I wouldn't care.   I have a similar situation with a neighbor that dumps leaves on the edge of my 1.5 acre lot that's out of sight.   I could care less.   Not worth the aggravation even if I did care.  

 
As a local government planning and zoning director, my advice would be for you to call your local Zoning Administrator and tell them what is going on. Also may want to call your local Drain Commission office. These two entities have legal means to stop him from doing this if illegal and usually police power utilization through municipal civil infraction.

The fence was put up over 10 years ago by the previous owner of that property. I have no issue with fence. It's inside the property line indicated by the GIS map from the city site.

I'm looking to get a survey done to verify the property line in case the GIS map is wrong. I've been trusting the combination of the location of the fence and how it's shown on the GIS map. If that's wrong then I'm gonna look stupid. I want to minimize the amount of stupid if that's the case. If I'm correct then I want him to stop claiming ownership of part of my property and be accountable for the drainage from the pool.

So you've already confronted him about the drainage hose and he's claiming that's his property?  Hence the dispute?

No. We had a confrontation about the property line. I lost my composure and it didn't go well.

I know the previous owner of that property had a survey done about 15 years ago and I hoped that the marker in that corner would be easily found without disturbing the ground too much. I walked back there and found the hose.

Right now I'm thinking that I'll ask him if he wants to search for the marker together and we can't find it I'll get a survey done.

This kind of stuff interests me.  Your thread did too.  I'm the guy who likes to cut down the trees.  My neighbor and his wife are the nature loving bird watchers.  Their yard is like a jungle.  Mine is pristine.  His stuff is always infringing over my fence because he takes care of nothing.  His weeds and leaves continue their all out assault on my lawn daily.  Drives me crazy.  If it's a millimeter over I cut it or spray it.
