She's very type A and has very high to unreasonable expectations of others (for example, she once got really upset with us because we refused to drive 7 hours round trip to attend my niece's 3 hr. birthday party). She also struggles to admit fault. Needless to say it's not fun to be on her bad side.

She recently got a criminal speeding ticket. Blew through a construction zone. She's never been in trouble in her life and the cop almost arrested her. I gave her the "family rate" - i.e. drinks on her next time - and today I just got her charged dismissed. Figure this buys me at least a year of being able to do no wrong.

I have decided that the only way I will take a new family case is to begin all retainers at a minimum of five figures, non refundable, and I will likely be increasing my hourly rate for them about 50%. After a careful review of the status of the cases, the type of client, the amount of work, and the amount of bourbon I drink when I get home after a day in that court, and factoring in the life expectancy I have as a result of it, it is simply not worth it unless I get buy a new car money up front before I even open a file.

This will result in less business. It will also result in me actually not dreading going to work on certain days. But the loss is already being felt and business is in the red something awful right now. That increases the stress in general but it's a different stress. I can work that out. At least I have my soul back from what family law was doing to it. I'll take less money and my soul over more money and finding comfort in a bottle because I can't talk to anyone about what these cases do to me.

It all came to a head in the past week or so. If I was just a slightly weaker person ( and I mean, slightly) I would have punched a certain client in the face repeatedly until someone had to pull me off the bloody mess that my hands caused. So, instead of doing something stupid, I'm just cashing in my chips and ignoring the smaller games at this point. If someone wants to stake me in a high end game, I'm in. But other than that, I've got better things to do.

Another condemnation jury trial for me this morning. Property owner was pro se and led us to believe she would not even show up at trial. Our statute requires a jury to assess compensation, so even if they didn't show, I had to put on my case to the jury. Lady shows at the last minute, sits at counsel table but basically declines to say anything for the entire trial.

I request the jury award $4,600 based on our appraisal. They deliberate about 20 minutes and return a verdict for $4,750.

Crazy plaintiffs in an $8000 case. I'm defense. Their attorney listed 18 witnesses (including yours truly), so I asked for a pretrial conference. The judge made him estimate the examination time for all of the witnesses, and it came out to 12 court days. My entire case is 3.5 hours.

Judge goes ballistic, says we get 5 days and that she won't assign it out so we're getting continued from Nov. 23 to Dec. 7. Dec. 7 comes, I show up to court, she's beginning a 3 week jury trial. We're getting assigned out. Sorry, someone should have called.

We're having torrential rainstorms and with the weather I'm 2-2.5 hours from the court. I'm now on standby, and could be called to begin trial on 2 hours notice any day. Nothing happens this week. Now we're into next week and my expert, who is the only real substantive witness in the case, will no longer be available, so if I don't start trial Monday I have to move to continue it to next year..only there isn't anyone available to hear that motion, since I'm no longer in the old judge's court and the presiding is out until next year. Oh, and court's open December 21-24, when I have my daughter for winter break, so I may be in trial for that.

Got an email from the clerk, saying you have a 4 day trial, so here are your 4 days...a half day on December 14, full days on the 15th and 16th, and a half day on the 23rd.

Better to get the attorney to sign the form. If he won't, tell him you'll notice a hearing at which you'll inform the court of his refusal to sign the substitution memorializing his termination.

-- Keep putting in the time, learning your craft. It's a bit of a slog, but good honest work.

-- Keep a regular exercise routine. 3-4 days a week. You'll be surprised how the quality of life goes down when you aren't working out.

-- If you are single, really . . . . enjoy it. Screw as much as humanly possible. If you were as undesirable as the rest of us were in high school and college, this is your time man! Years 27-37 or so should be a cakewalk. If you aren't tagging ### regularly by 35 (and I don't care how much of a troll you are, by 35 you should have it figured out), then go get a guru or something.

-- If you are married, really . . . enjoy it. You've chosen the love of your life, effing dedicate yourself to making this thing really work. There's nothing better than sharing a life with your true love. Oh, and don't forget to tag that ###, either.

-- As far as lawyerin', pick a field that you really love, and SPECIALIZE. I made the mistake of trying to remain a generalist for WAY too long (exception: if you are truly that rare small-town do-everything-that-walks-in-the-door practice. But it sounds like you aren't).

Lastly: Notice how 2 of the 5 bullets above aren't related to work? Keep that same principal in everything in life. And you'll make a heck of a lawyer, and a happy person.

Yeah, TRID was a good or even excellent idea on paper when announced by the CFPB, but the execution of it has been confused and chaotic. To borrow from another area in which I have experience, it reminds me a bit of a couple of occasions in which the DOL rewrote classification rules for exempt employees but forgot to integrate with other agencies like the NLRB. Anyway, interesting times.

It sounds to me like you are doing great. The recipe for "success" in the law changed really quickly; as recently as ten years ago it was a thundering truth that most people should head for as large a law firm as possible for prestige and practicality (debt retirement), but that path has really lost a lot of its luster now, and for many it has become sheer folly.

I part ways with some lawyers on specialization; I don't really believe in niching myself and I litigate (and conduct transactional work) in a fairly wide variety of areas because of certain aspects of my background that just came together to create that. But there's nothing wrong with specializing as long as you really like the work, won't get tired of it, and leave the door open a bit to migrate over to other areas to keep fresh and/or to increase your options down the road. (This is not a problem in most practice areas as there is almost always something - or several somethings - close enough to what you're doing that you can evolve your practice in that direction if needed or wanted.)

Meanwhile, keep that idea of working to live instead of the reverse.

Probably typical but still a little F'ed up.

Yeah, if that incident occurred in my jurisdiction I'd expect a little bit harsher outcome (a few of those charges probably could be felonies in AZ) but California is pretty consistently less harsh than Arizona. So, tough to say and my bet is that this guy got the "standard" outcome.

What I am confident in saying though is that pretty much every victim ever (or, maybe, at least 90%) of them walk away from a case thinking the outcome was way too lenient.

The guy is also a white collar white dude in his mid 30s with no priors (or non that I saw).
