Will Smith shot and killed. (1 Viewer)

If someone says I'm gonna get my gun and starts walking towards his car and you proceed to shoot him is that self defense? I dunno. If I had a gun I wouldn't want to wait to find out.

Yeah, clearly not self defense but if someone said that to you and started walking to his car what would you do?
There are two other options to consider

Draw and warn or run away. I doubt I'd choose option "Shoot currently unarmed guy in the back"

Prolly the best thing to do if possible. Do they know what position Will was in when shot? If he shot Smiths wife in the leg and she was inside the truck, he must have been shot when he was at the truck reaching inside?

 
Let's not try to rationalize things here.  We have both parties doing two stupid things on camera:

1.  Will Smith fleeing the scene after hitting the hummer

2.  The hummer chasing Will Smith down and smashing into him.

Both of these are dumb and unnecessary.  And all that happened before words were had.

This guy is gonna end up with a plea deal for manslaughter. Hopefully his legal team will dry up the rest of his settlement money (and I assume it will).

 
Cardell Hayes charged with 2nd degree murder... Looking at his mugshots and other pictures, he was a monster himself - looks like 6'6 350... Guess he just didn't want a piece of another dude big like him, what a ####### #####, hopefully he gets life.

Unfortunately we live in a society with a lot of stupid people... The real issue here is getting 12 people that aren't morons on the jury, a tall task for any prosecutor. I'm confident this piece of garbage gets off. 

All I need to do is hear that Smith was shot in his back 6-8 times and his wife twice. If no gun was brandished, then there is no way in hell this is self defense, this was murder and attempted murder, nothing short of testimony from Smith's wife contradicting my opinion will change it.

Which accounts? The one where he rear-ended a vehicle and then fled the scene or the one where he went to get his loaded gun from his car to settle the score?

If he was trying to get a gun, at this juncture, wouldn't you say he was justified in doing so?

Myspace was big in the early to mid 2000's, then died when Facebook was opened up to the general public and took off. 

It was reborn around 2012ish when Timberlake and some others bought them and tried to re-brand it as a music oriented social network. Somehow it got semi-popular with the younger crowd for a bit, maybe because all of their parents were now on Facebook and Instagram hadn't taken off yet, but I think most of them just created accounts and don't actively use the network.

Most chicks I have met in the past 3 years in their early 20's have a Myspace account, they don't use them but they all have random pics from 2012-2013.

Smith was shot eight times, according to findings just released by the Orleans Parish coroner.
The report says seven of the wounds were in Smith's back and one was in his left side. Several bullets penetrated vital organs, including his heart and lungs, coroner Jeffrey Rouse said. A toxicology analysis is being done, but results won't be available for six to eight weeks, the report says.
Smith's wife, Racquel, was shot once in each leg and is recovering in a hospital, Thomson said.
In no world is this self defense...

 
I certainly like to think it wouldn't be, but if he was reaching for his gun in the glove box that could lead to getting shot in the back/side, no?

Thomson said Smith was behind the wheel of the Mercedes SUV when an orange Hummer pulled in front of them. Smith slammed on his brakes but the vehicles didn't strike each other, so Smith drove on, Thomson said.
A brief time later, the Hummer rammed the Mercedes at a high-rate of speed, causing the back windshield of the Mercedes to shatter, Thomson said. Smith got out of his vehicle, as did the driver and passenger in the Hummer, Thomson said.
"Words were exchanged," he said.
Racquel Smith and the other woman in the Mercedes SUV got out and tried to defuse the situation, Thomson said, and they talked Smith into walking back to his vehicle.
The driver of the Hummer followed and shot Racquel Smith in each leg, Thomson said, then "unloaded six to eight shots into Will's back." Smith was declared dead at the scene. Hayes stayed and waited for police, officials have said.

The one where a guy threatened him with a gun while his wife was standing there so he tried to get his own while she was shot twice and the shooter unloaded eight rounds into Smith from behind while he was unarmed.

You don't shoot an unarmed woman twice in the legs and an unarmed man in the side once and the back seven times in self defense.  Even in your own home.

 
& if the CNN account from the linked article is correct, why the #### is he shooting Smith's wife first if he felt his life was in imminent danger? Wouldn't you shoot the threat first? 

I'd also think one at most two shots neutralize any threat that isn't at least as large as a polar bear. 

 
Oh and specifically for the guys always defending the police in cases of deadly shootings: 

This non police officer was capable of shooting someone in the leg not once, but twice. Just saying....

It's troll morons (like some on display here) that make me confident this murderer walks. Unfortunately some people are so stupid that they'll never know it.

Reminds me of the Jodi Arias defense; I shot him in the face, stabbed him 30 times, and cut off his head in self defense :lmao:

1. Smith was at fault for the accident even if Hayes tried to cause it and committed a crime by driving away.

2. Hayes committed murder.

 
It gives the defendant ammo in his self defense case, no? That has to be spelled out? 
He was in thee driver's seat. His gun was in the glovebox and wasn't fired. Smith's wife and other witnesses probably will counter any claims made by the defendant that Smith came at him or even threatened him.

I agree, but nonetheless, better for the defendant than worse... Gives them something else to argue and cast some doubt on a jury.
