While discussing what constitutes reckless disregard for the truth in regard to the actual malice standard, Judge Vyskocil asked Murphy, "Does somebody in Mr. Carlson’s position have the duty of inquiry?"

Murphy replied, "Not as to an actual malice standard. The Supreme Court could not be clearer." She argued malice isn't a negligence standard, and "failure to investigate" the truth of a statement doesn't suffice. 

The Fox News lawyer also argued that even if Carlson were aligned with Trump, that's not enough, and you can't reach the actual malice standard "just by saying someone has motive for lying."

Hypothetically if this were the rule, wouldn’t this be a license to defame, propagandize and desecrate? What sort of behavior could possibly result in liability?

If its a new issue...yes it would be allowed.  If it was a new “Trump supporters thread”. Locked.  If it was a new catch all “Trump” thread like the large one here...locked .  If it was another about the FBI...locked.

I was wondering about these resignations.

I'm not sure it's much of a noble gesture. Just thinking about your own career, if you are tying your ship to Tucker, and he goes all NewsMax-y on you, it's the smart move to cut the line.

I'm sure many people will agree with the premise of keeping wokeness out of the military, but this statement seems way out of bounds. I wish the video was not cut off there because I would have liked to see Tucker's response. That's a pretty gross statement imo. He (Jesse Kelly) retweeted it so I am sure he is getting the reaction he wanted.
