Kid took air horn to the face (1 Viewer)

We can go to legal-dictionary and we get similar stuff.

Negligence

The duty to guard against negligence and supply a safe product applies to everyone in the chain of distribution, including a manufacturer who carelessly makes a defective product, the company that uses the product to assemble something else without discovering an obvious defect, and the vendor who should exercise greater care in offering products for sale. These individuals owe a duty of care to anyone who is likely to be injured by such a product if it is defective, including the initial buyer, that person's family members, any bystanders, and persons who lease the item or hold it for the purchaser.

Additionally, the duty to exercise care involves all phases of getting a product to the consumers or users. The product must be designed in such a way that it is safe for its intended use. It must be inspected and tested at different stages, made from the appropriate materials, and assembled carefully. The product's container or packaging must be adequate. The manufacturer must also furnish adequate warnings and directions for use with the product. The seller is proscribed from misrepresenting the safety or character of the product and must disclose all defects.

I think you're straining a muscle with that stretch.I hope your child is ok, but I hope you lose your lawsuit.
If his child is okay, there won't be much to collect in a lawsuit.
Punitive damages!

Don't take her to any gun shows.
How old should a kid be before they learn to fire a weapon?
your kid or a normal kid?I'm already dreading the next thread....
Normal kid, but I guess the fact my child could probably dominate you in a game of Jeapordy might make a difference.
Pretty sure she would lose since she would get so many points deducted for every time she hit the buzzer and didn't know the answer. Heaven forbid she only push it when she knows the answer. I mean it is just so inviting and all.

 And this kid is homeschooled? Oh my! Double good luck with all that then.
See, this is the problem with the American teaching system. Our teachers don't have basic reading and comprehension skills. In our exchange earlier we discussed that my wife participates in her classes at school. Our poor children. :(

 And this kid is homeschooled? Oh my! Double good luck with all that then.
Is this confirmed? If so, it pretty much explains everything.
Anyone that's been paying attention in the thread knows this isn't the case. Only a poor excuse for a teacher would believe otherwise.
Or someone who reads your fuzzy posting and tries to fill in the holes. Is your wife a teachers aid or something?

I fired my first rifle (bolt action 22) when i was five. By seven i was on to handguns and highpowered rifles (.270, 38 special, 410 shotgun, etc). Seemed pretty cool at the time. Now i really would like to see you try to sue the gun makers when something goes wrong with one of your kids around a gun or god forbid a gun store, that has never been tried before.

She's a stay at home mom, but also volunteers her time in my daughter's classroom. Teacher's are always looking for some help. We already went through this when Pick suggested my daughter's teachers probably hate us, but he's too stupid to remember. I just feel bad for any kid that has to pass through his classroom.

yeah, but has anyone tried the angle of suing the gun manufacturer because it doesn't label which end of the gun the bullet comes out of?

After this experience, I don't think she'll be pushing any buzzers anytime soon.

These dancers should be sued. They should put up a fence or something before doing ninja moves.

. My family sued the school, America's funniest home videos, spalding, the kid that threw it and the other team for making the game close enough to necessitate a buzzer beater attempt.

Haven't read through all the pages. But, have you contacted an attorney yet? Why is this 4 pages?
:lmao: :lmao: pretty much the same way all the rest of these get to 4 pages.I've seen longer threads in the shark pool for a player who didn't even make a roster.

My link

Was opening an air hogs toy earlier today and found myself very upset with Dr. J. The packaging was ridiculous. 9 twist ties, 3 plastic brackets, and lots of tape.

All because idiot parents can't watch their kids and keep them from eating parts or doing who knows what and then feel the need to blame somebody else and sue. Because of your suckitude it takes us more time and costs us more money. ****.

So we go to the outdoors store today, not sure I want to mention the name, end up going through the boating section. We're looking at the oars, and just a little bit away maybe 10 feet are emergency air horns. Our kid walks over there, one of them happened to have an opened package with an inviting "press button" sign. Wife sees her going to press this and shouts no, but before she can do anything she's is taking a blast with the air horn in the face. Now she's saying her ears are ringing some. A little ticked off about the whole thing for obvious reasons. The thing has a notice to keep out of reach of children on the actual horn itself, but it's down at kid level in this store. The packaging is flimsy and easy to open (kind of little plastic snap buttons in the corner) and this was open with wording inviting someone to press the button. Hoping this clears up, wondering if anyone has any thoughts on the course of action.
I would also love to know what is "flimsy and easy to open" regarding the packaging.
It's a plastic shell. But rather than being enclosed and requiring scissors like most products packaged in this fashion, it's just got two little plastic buttons that loosely snap together at the top. Not entire sure this matter, since the package was actually opened. But the manufacturer should consider packaging a dangerous product more carefully to prevent this possibility.
You mean make it idiot proof?

Keep a better eye on your kid, Captain Crybaby.
I don't think an 8-9 year old needs serious supervision in this context. I'm just surprised a kid that old would be raised to feel like doing something like that is fine.
In the end, it's all about personal responsibility (ie. the parent in this case).
I agree but I don't think the issue is supervision. I think it's deeper than that. In other words, I wouldn't be afraid for my 8-year-old kid in that scenario not because I supervise them constantly but because they know better.
your 8 year old never does anything "dumb"?
My 8-year-old would not have pushed that button.
You want to recreate the scenario and give it a go?
If you can't come up with a scenario where it doesn't happen, then you have no business letting her wander around the store unsupervised.

Some higher up in the store called us to apologize and says they're going to write a letter to the manufacturer and consider placing these better. Hearing test was yesterday, all was well. That's probably not going to help our suit. But the Doctor is on our side here and seems willing to be an expert witness if need be.

Seriously? What kind of damages are you seeking in this matter? How have you or your daughter been wronged in this instance?Have you been able to discipline your child yet and in what manner did you?
