Alleged victim in Reuben Foster case could be planning to refuse to cooperate
Most domestic violence cases ultimately hinge on the willingness of the alleged victim to cooperate. In the case involving 49ers linebacker Reuben Foster, some are speculating that the alleged victim will not be cooperating.
Matt Barrows of the Sacramento Bee reports that the alleged victim in Foster’s case has hired a lawyer. The lawyer, Stephanie Rickard, has confirmed her role, but she declined to say why the alleged victim, Foster’s former girlfriend, has retained counsel.
As Barrows explains it, some victims in domestic violence cases hire lawyers in order to explore and to understand their rights, if they want to not testify or not cooperate with the authorities.
If the alleged victim won’t cooperate, it becomes much more difficult to prove guilt beyond a reasonable doubt in criminal court, especially if the only witnesses to the incident were the two people involved in it. If the alleged victim in this case refuses to cooperate with the NFL, it becomes virtually impossible to find the player to be in violation of the Personal Conduct Policy.
In Ezekiel Elliott‘s case, the alleged victim submitted to multiple interviews with the league, making it easier for the league to harvest evidence that supported his suspension. If the alleged victim in Foster’s case refuses to speak to the NFL, the NFL will be required to find other evidence of wrongdoing.
It all means that, regardless of guilt or innocence, Foster could end up avoiding both a conviction and a suspension for domestic violence. (He separately faces a felony charge of possessing an illegal assault rifle.) Which could explain why the 49ers have opted not to make any quick decisions about the situation. In the end, there may be nothing that keeps Foster from continuing his NFL career.
I think they would prefer to move down if they can unless maybe Chubb falls to them which is doubtful. As it stands now my guess at 9 is Fitzpatrick or Edmunds if either is available.So whats your official prediction for our first pick? Will we keep #9 or trade down?

Yup. Hard to believe the prosecution didn’t see this coming, and still felt they had sufficient evidence anyway. Also, even if he is innocent, the organization doesn’t come off any better. They dumped Brock immediately under a similar scenario, and ultimately the charges were dropped against him. I think we all know Foster probably did everything that was first reported and now the dollar signs are being tossed her way to change her story....but there should still be some type of penalty for lying to the police....

Not sure how long Staley wants to play. He seems like a guy with the personality to do things in the broadcasting area and may decide he wants out while still healthy and mentally intact. Would be nice to be set up at OT if that happens.

True. Just a shame he didn't work out. Was top rated pass blocking tackle last year. If he wasn't so lazy and bought in we probably don't pick Mcglinchey and give our defense much needed help with possibly some extra picks to go with it. Really just pissed at Brown. Not sure if I'd say Jimmy G was a steal by Lynch as much as it was BB doing a favor for Jimmy G and giving a good friend in SHanahan who's father is good friends with BB a favor. I think that deal was putting Jimmy G in a favorable situation considering what I believe BB have some good feelings about Jimmy. I think the whole situation in NE is incredible real. BB looked like he wanted to give Jimmy to a team he knew he'd have a favorable outcome and great situation so he was gonna put him there no matter if the offer wasn't as good as others. It's a steal in terms Jimmy G should've gone for far more then what he did though. #49ers signed S Jaquiski Tartt to two-year extension worth $13m, max $15m. Had one year left on deal. Now signed through 2020.
Seems like a good deal. Would still like to see them sign Reid. Need the depth..................Tartt extension. Solid move IMO at a fair price. Tartt and Colbert gives us a very good safety tandem.

If he doesn't get a shot to start somewhere I could see that being a possibility. They seemed to be fairly high on Chanceller James last year as well so they may decide to go that route and use Ward as a backup CB / FS. Glad we have 4 picks to use today. Still don't like the pick, but hate the "slot receiver" stigma. He only ran 15 percent of his routes last year out of the slot and no way Shanahan moves up to take Pettis if he planned on playing him in the slot.
