I have a default judgment against an individual. The individual has insurance that likely covers the scenario that led to the default judgment. A "reach and apply" action is an action to make the insurance company answer for their insured. I would like to discuss how such actions work.

I don't directly, but I have good knowledge of whether a particular crime will get somebody deported. Not sure if that helps you.

I start a trial on Tuesday with a judge that hates last minute motions.

I'm currently drafting last minute motion number 5 and may have another to file. Not really my fault, although I do file a ton more motions in limine than the average defense attorney because I try to limit the number of speaking objections I have to do. Just crazy #### keeps happening with this case this past week (e.g. state's lead investigator gets charged with felonies and they don't tell me, I happen upon an awesome expert witness I didn't know about previously, etc.).

If you don't hear from me after Tuesday it's because this judge killed me.

So, realistically, the immigration issues won't ever matter because he won't divorce her?

I mean, the family law attorney in me, in the event your state's laws are anything like mine, would cause me to advise this hypothetical guy to speak to an attorney in his jurisdiction about getting a divorce ASAP.

I think she'll leave before he would kick her out. And your advice would be my advice as well.

My God. Sitting in a deposition of a third party witness. She's my client's employee, so I sent her an email telling her and her attorney what to expect and what to be prepared for, with a few documents for her to review and be familiar with.

She took 15 minutes to decide whether she'd ever seen the complaint, and asked her attorney for help when she was asked whether she had any employees. She's unable to explain what her job duties are without looking at her file.

FWIW, if I were the type of third party witness who really, really would rather not be called at trial, I'd probably make sure that it seemed like I was a spectacularly crummy witness at my deposition too.

If she has permanent residence status, game over. She lives here.

We have one of these guys in my jurisdiction. He's actually a decent attorney but he constantly looks like a slob. I had a private mediation where we were arguing over a significant sum of money and he wore sweatpants and a tee shirt. He often wears sneakers and no tie to court and I swear one time he wore dark sweat pants to court that he thought would pass as suit pants. So weird.

I was in court a couple weeks ago and the judge refused to allow an attorney past the gate to argue because he wasn't wearing a tie. They don't do that around you?

Depends on the judge - and honestly - alot of our more routine hearings take place with us standing on the public side of the bar so unless the judge really looks at you he/she can't tell the pants and shoes you are wearing.

I've seen this happen once in my jurisdiction, but that was to a young "city lawyer" that the judge hadnt seen before and likely wanted to teach a lesson for thinking anything goes in my more rural jurisdiction. However, the attorney I'm talking about apparently has been doing this a long time. Combine that with the fact that he's usually on top of his pleadings and argues his cases competently, and the judges have all just appeared to give him a pass. Personally, I take no issue with it b/c he can't come across well to the general public making my office more likely to get the court lobby business.

Whether you think the guy's claim is wrong or not, it doesn't appear to be objectively baseless. It's at least colorable. In those situations, he has a 1st Amendment right to petition through the court system and an action (for what, tortious interference, I guess?) generally won't lie.

I had a summary judgment motion filed last October. Judge didn't call it for oral argument until May.

At the hearing in May the judge didn't put any finding of fact or conclusions of law on the record or in his order so I had to file a motion for reconsideration before I file an appeal. Filed that by the end of May. Crickets since. It's going to approach October this year before that motion is heard. One full year for a Summary Judgment motion.

Needless to say, I'm not a huge fan of this judge, that court, or for that matter the case in general.

Whether you think the guy's claim is wrong or not, it doesn't appear to be objectively baseless. It's at least colorable. Ok. I have no idea what to expect so that's why I asked. I was hoping there would be a rough timeline but I understand I'm asking a pretty vague question.

Here was my original question:

"Anyone in here real estate lawyers? Can one sue for lost revenue for not being able to sell a condo due to another owner suing the HOA? Small rental condo that has always been seasonal. Other owner suing to winterize building. Condo docs used to say "shall" be closed jan and feb , but have always been shut from November to April due to harsh winters (maine). Owners lawyer found an amendment from 30 yrs ago that changed that wording to "may" be open year round. Most don't want to pay to winterize because it's always been that way and will be too expensive to do. It's also pretty much a seasonal community and a ghost town during the winter."

FWIW because of this lawsuit I am unable to sell or even take an equity loan-I don't have a mortgage and own it outright. This was an investment where it was to help pay for my kids college tuitions but now I can't even access a penny. Obviously putting a huge financial strain on my family. It's in summary judgement now and if it goes the owners way that means another year or two before I can do anything. I have lost several buyers already due to banks not willing to loan because of the lawsuit. Hoping for a cash buyer.

There is more to it-suing owner signed a false mortgage claiming it would be their second home for their private use and not to be put into a rental pool. It's been in the rental pool from day one. Banks don't care as long as they are getting paid. Also the docs she is relying on have an actual expiration date that ends in 2018. They are stopping at nothing. Doesn't make sense since they only paid 75k for it but have probably already spent 30k in laywer fees.

We could all give you some horror stories but no one in here will have the slightest clue unless they practice before the court your suit is in. These things vary wildly. You could be looking at anywhere from a couple months to well over a year.

Yeah, unfortunately, the question doesn't usually really turn on the legal issues themselves. How long a summary judgment opinion takes depends on the judge, the judge's staff, that Court's usual turnaround time, how busy the Court is right now, whether they understand the issues or have to research them, etc. etc. etc. And even if you win, there will be an appeal. So tack on 6 months to a year.

I've had Judgments issued in an hour, and I've had them take six months.

A company commissions a study, performs some research, and reaches some conclusions from the data, including for example the conclusion that it is 50% better to do X than Y.

Can I say the following for a commercial purpose: "According to a study by Company, it is 50% better to do X than Y" ?

Running in circles on this one, but it seems like this is is not copyrightable material, correct?

I've had Judgments issued in an hour, and I've had them take six months.

My wife has been waiting over a year for decision on a case where the judge said, in open court, that he was inclined to rule for her client but wanted to give the parties the benefit of a written decision. A company commissions a study, performs some research, and reaches some conclusions from the data, including for example the conclusion that it is 50% better to do X than Y.

Can I say the following for a commercial purpose: "According to a study by Company, it is 50% better to do X than Y" ?

Running in circles on this one, but it seems like this is is not copyrightable material, correct?
Facts are not copyrightable. Expression is.

 
My wife has been waiting over a year for decision on a case where the judge said, in open court, that he was inclined to rule for her client but wanted to give the parties the benefit of a written decision. And this isn't some schmuck. This is a senior federal judge in the District for DC. This after the case had already been around for 5+ years because of two stupid procedural battles that were appealed to the DC Circuit. Not the justice system's finest hour.
I had two SJ decisions take 18 months in the DDC and SDNY, respectively. When I was clerking the federal judges would rather be caught dead than have cases on their six month pending reports. It's weird.

 
Usual deal is -

marriage,

application for permanent residence,

approval of conditional residence status (for two years from date of approval),

Form I-751 (signed by both spouses)

Approval of permanent residence status.

If she has permanent residence status, game over. She lives here.
She may still be in process of getting the permanent but I don't think she has it yet.

After briefing was complete the judge gave herself 90 days to give a written opinion. Last week we showed up thinking we were going to get it. She told us she was taking another 60 days.

I had a bench trial that took something like 10 months to get a decision. :mellow:
