In Texas, it’s the lawyer who can’t. And the lawyer can’t instruct or suggest that the client make such a threat.I can’t or my lawyer can’t?

One can be a successful trial lawyer without being a #####.I make no impression. Avenatti is a lot better lawyer than I am. The job is advocacy. Not analysis. He's an effective advocate. Which is why he's a successful trial lawyer and I'm a law firm washout.
I totally disagree here. He’s baiting Trump. He’s using every tactic he can to get him to bite on something that will help his client. I love this guy, but I only do plaintiff’s civil litigation.I would prefer that our colleagues at the bar would conduct themselves with a bit more decorum. I believe this reflects negatively on the profession. His self-promotion, his aggrandizement of his ego creates misperceptions in the consumer as to what services they can expect us to provide and the manner in which we can be expected to provide them. If we as a profession start acting like carnival barkers we can expect to get paid like them and to garner the same respect as they get.
Hopefully the impressions this guy makes are off set by the impressions made by folks like you, Henry Ford, Big Bottom, ....
Just read the LLC's memo. Solid considering the circumstances. It relies a lot on very favorable case law and avoids the facts as much as possible. In response, I think Avenatti will focus a lot on Section 8.6 of the NDA, which has language stating that the agreement is effective "when signed by all Parties." The LLC's position requires one to read the NDA's description of the Parties - "EC and/or Trump" - to mean "or" instead of "and," even though there is no basis in the contract for choosing that reading and in fact there is more support for the "and" reading. The LLC's argument is exactly what Schwartz said on TV the other night: the NDA gave Cohen (!!) the choice whether the agreement would be with EC or Trump, even though that is also contradicted by a lot of stuff in the NDA.
I think Avenatti is the right guy to take Trump on in this case, but this isMichael Avenatti is reportedly asking the Treasury Department to release information about "suspicious" bank activity surrounding Stormy Daniels' hush-money deal.

It's cool grandstanding. The ACLU has been able to get SAR's with a public records request.Michael Avenatti @MichaelAvenatti 40m40 minutes ago
Here is the letter we sent to the Sec. of the Treasury requesting that he publicly release the Suspicious Activity Report (SAR) relating to the $130k hush payment. This report may show the money trail and disprove the claims of Mr. Cohen.

Not if it rattles Trump's cage. It's cool grandstanding. The ACLU has been able to get SAR's with a public records request.
He'd be entitled to a copy of the SAR in discovery, so this is all unnecessary.
For some bizarre reason Trump has far better Attorneys for this civil matter than his existential criminal investigation. Not if it rattles Trump's cage.
He probably can't until they rule on the arbitration. I'm just saying he'll eventually get it if he can show he needs it.For some bizarre reason Trump has far better Attorneys for this civil matter than his existential criminal investigation.
Avenatti should file his response and get on with normal discovery like Fish indicates above.
I'm assuming this is sarcasm? For some bizarre reason Trump has far better Attorneys for this civil matter than his existential criminal investigation.

Luckily, Mueller isn't prone to exhaustion. He's our only hope.Seems to have lost some steam as we move on to other news. Exhaustion of our disgust seems to be his best and only defense.
That ought to be enough. That and the hubris of Trump really ought to be enough.Luckily, Mueller isn't prone to exhaustion. He's our only hope.
And David Schwartz has also apparently been yanked off the air. The wheels of justice grind slowly, but there will be a moment of truth in this eventually.Josh DawseyVerified account @jdawsey1
Trump says he did not know about the $130,000 payment to Stormy Daniels and is not sure where the money came from. "You'll have to ask Michael Cohen. Michael is my attorney. You'll have to ask Michael."

If Trump is stupid enough to talk to Mueller, he's going to commit a crime in about thirty seconds.Josh DawseyVerified account @jdawsey1

Yeah, I don't know how the agreement survives Trump saying he never even saw the thing, much less agreed to it. He has responsibilities under the term of the NDA.Michael Avenatti @MichaelAvenatti 10m
Good (actually GREAT) things come to those who wait!!! The strength of our case just went up exponentially. You can't have an agreement when one party claims to know nothing about it.

He simply can’t.By the way, Don,of advice: shut the hell up.
It's from Italian. Basically "Enough" or "Cut it out." Also "B.S."What does Basta mean?
One of the exceptions to the A/C privilege is when the lawyer is sued or faces discipline, so this should test Cohen's previous claim that he'd "do anything" for Trump.Matthias said:Seen a couple of articles that Cohen could be on the line for disbarment. Now that Trump has walked away from it, Cohen settled a matter regarding his client without his client's consent; failed to keep his client reasonably informed of matters relating to him; and advanced money for a client for a contemplated litigation, all prohibited by the New York ethics rules.
You work for the Donald, and he's going to burn you down eventually.
Otoh that statement will be used as proof against him.One of the exceptions to the A/C privilege is when the lawyer is sued or faces discipline, so this should test Cohen's previous claim that he'd "do anything" for Trump.
I didn't even think of that. I just assumed Trump was lying.Otoh that statement will be used as proof against him.
Yeah as soon as I saw that denial, the first thought I had was that Trump just screwed Cohen. Avanetti has been baiting Trump into saying something stupid, and this qualifies.Matthias said:Seen a couple of articles that Cohen could be on the line for disbarment. He or someone else did. It didn't look like Trump’s signature. When?
Trump's signature on what? What document? He or someone else did. It didn't look like Trump’s signature.
