The government decided there was not enough evidence for a jury to decide that Winston is guilty "beyond a reasonable doubt" so he wasn't charged.

No one was ever forced to testify under oath to what happened that night. If rape victims are to be taken more seriously then taking this all the way to trial is start.
Exactly. Only two people know what happened. The truth is somewhere in the middle. The crusade for rape victims is better staked to another case.

Her attorney is going to do what's best for her.Which is almost certainly taking the money.
Cappy can probably chime in here. I would assume that once there's a large settlement on the table, the lawyer that took this on a contingency basis has met the bar and if it goes to court the client is risking having to shell out more to the lawyer percentage wise if they don't clear the settlement offer amount.
Going to trial always requires more to the lawyer in fees.

I'm also enjoying Cstu completely ignoring the rights of a nonparty witness in a civil case.

Yep sounds like all four people were in that bedroom at one point.
 
Erica Kinsman was never tested for 'roofies' (known by Flunitrazepam, Narcozep, Rohypnol, Rohipnol, Roipnol) and may not have been tested for GHB.

Urine and blood samples were taken during rape exam on 12/07/2012, however they were not sent to the lab until 11/15/2013 - almost a year later.

"Evidence collected from the victim of a suspected DFC must be properly sealed and secured. Biological specimens should be stored at 2-8 °C to help prevent degradation. Specimens should be transported refrigerated to the laboratory as quickly as possible; in any event minimizing the time they are kept at temperatures above 25 °C."

Both urine and blood samples were tested for 'Volatiles' (ethanol, etc.) and both tested positive for alcohol (she had a blood alcohol level (BAC) of 0.04).

Only her urine was tested for other for 172 drugs and none were found - none of those drugs included Rohypnol or any of the various names of the drug.

Also next to gamma hydroxybutyrate (GHB) it says (by request only) - so was that requested or not?

This whole thing is so ####ing shady - who takes urine and blood samples during a rape test and doesn't test for the most commonly used rape drugs (Rohypnol and GHB)?

Just found out that Georgia Cappleman is the daughter of former FSU quarterback Bill Cappleman.

She prosecuted Adrian McPherson's gambling trial that ended in a hung jury.

The defense attorney Grady Irvin Jr. appeared in his final arguments to give the prosecution a road map on where to improve. He pointed out a number of things the state could have done better. That included hiring a handwriting expert to match McPherson's handwriting on forms used at Western Union to forward money to an Internet gambling site.

McPherson acknowledged that it was difficult to sit in a courtroom and listen to two childhood friends, Otis Livingston and Melvin Capers Jr., try to implicate him as a regular football game gambler on the Internet. Cappleman had said that an investigator found 57 betting receipts over a two-month period last year from a computer used by the three men.
McPherson eventually plea bargained his gambling and theft charges to probation.

Interesting. This is going to wind up in a settlement, but I understand why you might be upset or think that something is horribly wrong here. This reeks, too.

His father, Antonor Winston, told USA Today he's working with the university on how to best manage the attention around his son and would like some form of security and supervision around his son at all times moving forward.

"He's supposed to have somebody around him 24/7," Antonor Winston told USA Today. "He's a Heisman Trophy winner so (he's) definitely not supposed to be by (himself)."

Florida State has added additional security to protect Winston on athletic trips, athletic director Stan Wilcox said in a statement to the paper, but it raises the question of how much is enough with an athlete as high-profile as Winston.

Antonor Winston said the latest incident has made it clear to his son that the spotlight on him is growing only larger, and he hopes it alerts FSU that additional attention is needed.

"We hope so," Antonor Winston said. "Not only him. I think it should show the university and us, I think we probably kind of dropped the ball on that a little bit."

"It's just a different standard for (Jameis) and Johnny (Manziel)," says Antonor Winston. "He's just got to endure, just make better decisions and he's just got to endure that."

Regarding the soda theft and the BB gun vandalism:

"Nobody would have ever heard of that at all," Antonor Winston says.
I imagine everyone reading this forum would need a "babysitter" if they were as famous as Jameis Winston when they were 19.

His Dad is spot on. The fact of the matter is there are thousands of guys like CSTU searching the internet for anything and everything to smear this kid. He wanted to be a normal college athlete, but it took him a couple minor incidents too long to figure out he couldn't be.

I don't think that is always true. Sometimes the girl who is raped is telling the truth and the rapist is lying, and sometimes the guy accused of rape is telling the truth and the so called victim is lying. And when the truth is in the middle, it is probably rarely close to the exact middle. It is probably 80% to 90% skewed toward one side or the other.

In this case, she said she was drugged and was therefore raped. He said they had consensual sex. Either she was given a drug or she wasn't. If she was, she was raped as her ability to consent was impaired. If she wasn't, then she has lied about a key point and she most likely consented to sex and regretted it afterward.

Everyone who dares cast aspersions can only possibly have a specific and irrational anti-this-particular-kid agenda.

And those willing to brush off rape accusations, thefts, and the like as minor incidents are on the side of sanity, morality, wisdom, and decency. So sayeth...wait for it...Winston's dad. :lmao:

Oh, and also we'd have all needed 24/7 babysitting to avoid our own slew of felonies, when almost every prospect coming out did just fine without.

I haven't brushed off anything regarding the rape accusations, but as of now that's all they are and all they ever will be. People will hate him because he was accused. He can't change that now. People hate Kobe Bryant and Ben Roethlisberger too, but they are still highly successful athletes in the aftermath.

As far as "thefts" go you can't be serious.

Laugh it up. I would definitely take Jameis for the next five seasons on his rookie deal over Cam considering the impending franchise tag and then mega-deal he'll be signing.

 
Carroll (Kinsman's attorney) said despite the inconsistencies in Casher's statements, Meggs relied heavily on them in making his decision not to pursue criminal charges against Winston.

"I believe, as the victim's attorney, that the statements are patently false," Carroll said.

Cappleman acknowledged the problems with Casher's statements.

"I have concerns about their credibility," Cappleman said. "We didn't make our decision based on those affidavits alone. Any discrepancies in their testimony would have been exposed on cross-examination."

ESPN's Mike Sando reports that some NFL team models compare Florida State QB Jameis Winston to Tony Romo "based on their willingness to make riskier throws."
Winston's 18 picks last year rank as the fifth-most in college football over the past seven seasons. Interestingly, an NFL evaluator said his team's trait-based tool agreed with ESPN's comparison tool that Chad Henne was the closest match in terms of traits measured at the combine (which isn't to say they have similar passing skills, of course).

General manager Jason Licht knows everyone wants to know, but the Tampa Bay Buccaneers are preserving the drama surrounding the top pick in the 2015 NFL Draft for a few more days.

"If we had to pick today," Licht said Monday at a press conference, "we'd feel very comfortable making the first pick."

"It's huge. Personally, I think it's probably the biggest draft in the history of the organization," said Licht, who along with Smith is entering his second year on the job with the Bucs following a 2-14 clunker in 2014. "We've got a real chance to really put us over the top and get us to the level we think we're going to be at this year, which we think is competing for a championship. It's a great draft, and it's a great draft to have the No. 1 pick."
"We're very confident in the amount of work we've done. Maybe 25 years from now I'll write a book," Licht said. "But we feel very confident in the amount of work we've done internally, we've had work done externally through third parties, and on and on. There have been no surprises."

"Yes we are. We're in total agreement," Smith said. "As a staff, not just Jason and I."

"I think in the end, most decisions aren't that hard if you put the work in to try and get as many questions as you can answered on what you should do," Smith said. "What we will do … it isn't as hard as you might think.''

The Bucs have been using the world 'comfortable' about their choice for months. But with such a valuable selection, shouldn't they be 'confident' instead?

not the word I'd use to describe Winston. Not that it means anything, but it's looking like they're going elsewhere.

 
IF Winston isn't selected first, it may be great for him and his maturity/growth. It would be pretty humbling to know you're the most complete QB in the draft on the field, yet there are teams that aren't willing to risk taking you with your off field discretions. As it stands he probably feels pretty invincible...

ETA: I still think he's the pick though.

Maybe I should have been more clear? They've already made the decision. He said he was comfortable with the pick, comfortable with Winston the player, comfortable with Winston's background, etc. It's 100% Jameis. He didn't say "We're selecting Jameis Winston" exactly, but it's obvious if you're paying attention.

So at what point do negotiations begin with Winstons agent? Do players still sign early?

There is probably a trade window still open...but if that's vetted to completion, when does the conversation shift?

Licht mentioned on the radio today that contract negotiations don't happen pre-draft anymore. There isn't much they can do dollars wise. I guess there are some other things they can do with certain language, though. Hopefully there's something in there about him pursuing a baseball career...

:shrug: I hope they do. (mostly because this Titans fan doesn't want him) but how much should we buy into right now?

“Believe it or not the general public thinks we’ve spent 90% of our time on Jameis Winston, but we’ve spent almost as equal amount of time getting to know Marcus Mariota,” Licht said. “There’s more things with Jameis off the field that we had to become comfortable with than Marcus, but still no matter who you’re taking, if we’re taking one of those two with the quarterback position you need to know everything about them.”
